Abstract

The puppse The purpose of this study was to determine the regulation of the legal relationship between patients in an emergency situation and the hospital and the factors that hindered the Regional General Hospital Dr. R Soedjono Selong in providing emergency services to patients. This research is an empirical legal research using a statutory approach, a conceptual approach, and a sociological approach. The results of this study are the regulations governing Law No.36 of 2009 concerning Health, Law No.44 of 2009 concerningHospitals, Decree of the Minister of Health No.129/Menkes/SK//II/2008 concerning Minimum Service Standards for Homes. and Decree of the Minister of Health No. 865/Menkes/SK/IX/2009 concerning Hospital Emergency Installation Standards, as well as factors that hinder the Dr.R Soedjono Selong Regional General Hospital in providing emergency services to patients consisting of internal hospital factors. namely the lack of quality human resources, incomplete equipment, less bureaucracy to facilitate services and external factors from patients who do not know about their rights and obligations and patients know about triage / patient emergency level.

Abstract

This research has the purpose to find out the legal basis, the rights, and duties of the businessman of a beauty salon and the legal responsibility of the businessman against consumer tooth damages because of dental braces. The type of this research is empirical-legal study, the approach method in this study uses the statute approach, the conceptual approach, and the sociological approach. The result of this study showed that the beauty salon has no legality to install a dental brace, this contrasted with their rights and duties. The beauty salon legality is only for beauty care. Moreover, the general doctor practitioners have also no legality to install a dental brace, the dentist (orthodontist) is the only medic who has legality to install a dental brace. Consequently, the beauty salon in the installment of dental braces has been done the malpractice, it has no legality to install, and it is the default in contract categorical, and torts. The businessman of the beauty salon has committed torts, disobeyed against freedom of contract, disobeyed halal requirements, and disobeyed certain thing principles. Because of this, there is no responsibility for a beauty salon in the installment of dental braces, because the agreement is null and void.

Abstract

Tujuan penelitian ini adalah untuk mengetahui dan memahami prosedur pelaksanaan jual beli hak atas tanah yang dilakukan atas dasar itikad baik serta perlindungan hukum terhadap pembeli yang beritikad baik dalam sengketa jual beli tanah berdasarkan putusan Mahkamah Agung Republik Indonesia Nomor 2949K/PDT/2016. Metode penelitian hukum yang digunakan adalah metode penelitian hukum normatif. Cara memperoleh bahan hukum yang diperlukan adalah melalui studi pustaka. Berdasarkan penelitian dan analisis yang penyusun lakukan, Putusan Mahkamah Agung Republik Indonesia Nomor 2949K/PDT/2016 telah memberikan perlindungan hukum terhadap pembeli yang beritikad baik yaitu Penggugat dengan beberapa argumentasi hukum. Pertama, Penggugat telah memenuhi syarat jual beli tanah berdasarkan hukum adat yakni terang dan tunai. Kedua, Tergugat I tidak mempunyai alas hak lagi untuk menjual objek sengketa kepada Tergugat II karena berdasarkan hukum adat telah terjadi jual beli antara Tergugat I dengan Penggugat. Ketiga, berdasarkan beberapa putusan Mahkamah Agung Republik Indonesia, pembeli beritikad baik tidak hanya ketika tidak mengetahui adanya kekeliruan dalam jual beli namun juga telah memenuhi syarat-syarat yang ditentukan oleh Undang-Undang. Penggugat telah beritikad baik dengan mengecek data fisik maupun yuridis serta memenuhi syarat-syarat jual beli tanah. Permasalahan mengenai pembeli yang beritikad baik dalam jual beli tanah kemungkinan akan terus ada. Untuk itu, diperlukan pengaturan yang jelas dan tegas mengenai pembeli yang dapat dikategorikan beritikad baik. Hal ini dilakukan untuk memberikan perlindungan hukum bagi pihak yang memang berhak.

Abstract

This research aims are to know the validity of unregistered sale and purchase agreement with the Title Certificate. Type of this research was normative legal research which applied conceptual, statute and case approaches. The used legal analysis of this study was legal interpretation. Result of this study shows that legal force in the verdict Number 3/PDT.G/2021/PN is valid and has legal force since there was witness statement in the court. The panel of Judges gave permission or power of attorney to the Plaintiff for and on behalf of the Defendant before the authorized Land Deed Making Officer (PPAT) to sign the Deed of Sale and Purchase/Transition of land rights with the ownership certificate. The transfer of land rights does not occur, while the agreement remains valid and has the same binding legal force as an authentic deed. It is better if every agreement is made by and before a Notary.
