Abstract

Law Number 16 of 2019 is a law that the main point is to regulate new regulation regarding the minimum age for marriage. Previously, the minimum age for marriage was 19 years for men and 16 years for women. Then this minimum limit was changed to 19 years for both. In Islam, the marriage contract (‘aqd) is a contract that is full of religious activities. However, in Islamic law or fiqh, there is no any evidence that clearly regulates the minimum age for marriage. This paper aims to analyze the rules for limiting the minimum age for marriage from a fiqh perspective. This type of research is normative-empirical legal research with a conceptual approach. The results of the study show that normatively, changes of Law Number 16 of 2019 have been in line with the provisions and principles in fiqh. However, in practice, this research proves that the changing of this law is not fully in accordance with the purposes and benefits in fiqh.

Abstract

Pengadilan Agama merupakan lembaga peradilan yang membantu pasangan suami istri dalam menyelesaikan sengketa perkawinan. Bentuk penyelesaian sengketa tersebut berupa mediasi. Mediasi merupakan penyelesaian sengketa di Pengadilan Agama dengan cara mendatangkan satu pihak netral sebagai penengah dalam memecahkan masalah. Mediasi dianggap sebagai cara penyelesaian sengketa paling baik, sebab dalam mediasi tidak ada pihak yang menang dan kalah sehingga keputusan yang dihasilkan bersifat win-win solution atau sama-sama menang. Dalam Islam, Rasulullah saw juga mengajarkan kepada umatnya apabila dalam menyelesaikan permasalahan sebaiknya dilaksanakan dengan musyawarah mufakat, sehingga menghasilkan kesepakatan antara dua belah pihak. Penelitian ini membahas mengenai sejauh mana keakuratan mediasi sebagai metode penyelesaian sengketa perceraian di Pengadilan Agama Slawi dan seberapa banyak penerapan metode mediasi berhasil dalam menyelesaikan sengketa perceraian di Pengadilan Agama SlawiPenelitian ini merupakan jenis penelitian lapangan (field research) dengan pendekatan normatif-empiris. Mediasi sebagai metode penyelesaian sengketa perceraian di Pengadilan Agama Slawi secara substantif sudah akurat, karena telah memenuhi asas cepat, sederhana, dan biaya ringan. Dan metode mediasi sudah sesuai dengan amanat al-Qur’an serta Undang-Undang, yakni setiap sengketa perceraian harus melalui proses perdamaian terlebih dahulu sebelum melangkah pada proses persidangan. Mediasi sebagai metode penyelesaian sengketa perceraian di Pengadilan Agama Slawi berhasil sebanyak 16 orang (4%) dari keseluruhan perkara yang masuk di Pengadilan Agama Slawi pada tahun 2022 yakni 370 perkara.

Abstract

Sebagai pemenuhan atas ketetapan yang telah ditetapkan dalam agama, sebagai kewajiban calon pasangan dalam pemenuhan perjanjian pranikah yaitu mengenai mas kawin (mahar). Penelitian ini berfokus pada dua persoalan. Pertama, bagaimana pemberian mas kawin dalam proses pernikahan Kedua, bagaimana pemberian mas kawin dalam proses pernikahan dalam Fikih munakahat. Syariat Islam memudahkan pernikahan, yaitu memberikan mahar (mas kawin) sesuai dengan potensi calon pasangan, bukan sesuatu yang harus dipaksakan pada diri sendiri, dan mahar juga tidak boleh menjadi beban calon pasangan, karena Islam tidak. membatasi jumlah mahar. Penelitian ini menggunakan metode kualitatif dengan pendekatan studi kepustakaan. As the fulfillment of the provisions set by Islam, as the obligation of the prospective partner in fulfilling the prenuptial agreement, namely regarding dowry (dowry). This research focuses on two issues. First, how to give dowry in the marriage process. Second, how to give dowry in the marriage process in fiqh munakahat. Islamic law facilitates marriage, namely giving a dowry (dowry) in accordance with the potential of the potential partner, not something that has to be forced on oneself, and dowry also cannot be a burden on the potential partner, because Islam does not. limit the amount of dowry. This study uses a qualitative method with a literature study approach.

Abstract

E-Court is a tool in court that functions as a service to the public in terms of registering cases through online platforms, calculating estimated court costs digitally as well as online payments, online summons and trials. The South Jakarta Religious Court started using the e-court since 2018, when the Supreme Court Regulation (PERMA) No. 3 of 2018 appeared regarding Electronic Administration of Cases in Courts. As time went on, the e-court process began to develop when the Supreme Court Regulation (PERMA) No. 1 of 2019 concerning Administration of Cases and Trials in Courts appeared electronically. The benefits for all parties for e-court users are that all parties will be helped by saving costs and time in the process. The deficiencies that occur are network problems in the e-court application. The type of research used in this writing is qualitative research which produces descriptive analytical data, supported by premier and secondary data sources then data collection techniques by means of observation, interviews and documentation. The results of this study indicate that the process of using e-court in proceedings at the South Jakarta Religious Court includes several stages starting from online case registration, online down-payment of fees, online summons, and online trials. There are several obstacles and opportunities that occur in the process of using e-court in proceedings at the South Jakarta Religious Court. Opportunities that occur are that all parties can benefit more such as saving energy, saving time, and saving costs. The obstacle that occurs is the lack of knowledge for previous advocates regarding existing technology from e-courts at this time. As for its effectiveness in using e-court in proceedings at the Religious Courts, it cannot be said to be fully effective because there are still several obstacles in the process..

Abstract

Hadhanah is a pattern of parenting children after a divorce occurs. The research method is qualitative with a literature study approach. Data collection techniques using documentation studies. Data processing techniques with data reduction and presentation. Data validity technique using source triangulation. The research results show: (1) hadhanah is child custody that occurs after a divorce where custody is resolved contractually for children who are not yet able to take care of themselves. (2) hadhanah after divorce is a pattern of parenting carried out by parents after obtaining custody rights from the divorce process. Parenting is carried out in accordance with religious rules and also the results of peace agreements.
