Abstract

The purpose of this study is to analyze the sanad hadiths related to garar and the law in buying and selling juzāf. This research is a qualitative research, the type of research is library research, and uses a thematic approach. The results of the study show that the hadiths that are raised and become references for the prohibition of garar in buying and selling are considered mutually reinforcing one another, especially because they are supported by the valid hadith li żātihi in Ṣaḥīḥ Muslim. Garar in buying and selling is unclear whether or not the object exists and the shape, size, weight or volume of the object is unclear. Garar in the sale and purchase of juzāf is permissible by the majority of scholars because the garar is small with conditions set by the scholars.

Abstract

This study aims to analyze the sociological considerations of enforcement and application of Islamic law in Indonesia. This research is a library research that is qualitative in nature. The results of the study show that the sociology of Islamic law is a reciprocal relationship between Islamic law (Syarī'ah, Fiqh, al-Ḥukm, Qānūn, etc.) and patterns of societal behavior in which Sociology is one approach in understanding it. In essence, Islamic law in Indonesia is legal norms originating from Islamic law that grew and developed in people's lives throughout the history of Indonesia. Theories of thought regarding the application of Islamic law in Indonesia are formalistic-legalistic thought theory, structuralistic thought theory, culturalistic thinking theory and substanialistic-applicative thinking theory. It turns out that the enforcement and application of Islamic law has many obstacles so that Islamic law seems very slow, especially in the field of jinayat (Islamic crime).

Abstract

This study aims to understand the law of buying and selling langsat fruit with the jizāf system in Posigadan South Bolaang Mongondow Regency. The type of research is a case study (field research) using a normative, historical and sociological approach. The research results found are as follows. First, the practice of buying and selling langsat fruit with the jizāf system in Posigadan South Bolaang Mongondow Regency, which is bought by wholesale without being measured or mined again to traders when the langsat fruit is still on the tree and ready to be harvested. Second, the sale and purchase transactions of langsat fruit carried out by farmers and wholesalers in jizāf in Posigadan are legal in accordance with Islamic law because they have fulfilled the pillars of buying and selling, namely: the existence of sellers and buyers, objects of sale and purchase, and sighat. In addition, buying and selling transactions carried out by farmers and contractors have met the requirements of jizāf sale and purchase, namely: the merchandise is visible to the eye during the contract or before the contract, the seller and the buyer do not know the quantity of the merchandise, the purpose of buying and selling in jizaf is to buy in large quantities. many and not units, merchandise must be assessed by people who are experts in assessing, merchandise in large quantities but not too much, one contract may not include buying and selling where one object can be measured while the other cannot.

Abstract

The purpose of the Real Work Lecture (KKN) of STIBA Makassar Batch IV is to carry out community service as a pillar of “Tri Dharma Perguruan Tinggi”. The method of implementation of the service program begins by mapping the problems and needs of the community using SOAR Analysis. After the analysis is done, the work program is arranged according to the needs of the community. The successful work program was Taklim Qur'aniyah Virtual for Youth, Taklim Qur'aniyah Virtual for Mothers, Tarbiyah Qur'aniyah Virtual for Fathers. All these programs have shown significant initial results in accordance with the objectives of the KKN of STIBA Makassar that have been proclaimed, and will be continued by the Department of Dakwah and Cadreization of DPD Wahdah Islamiyah Muna Barat.
