Abstract

This study examines the decision number: 79/Pid.Sus/2020/PN.Jkt.Tim in a case of criminal action of terrorism. This type of research is a normative legal research. The approaches used are the legal, case, and conseptual ones. The results showed that based on Decision Number: 79/Pid.Sus/2020/PN.Jkt.Tim found that the public prosecutor was not careful in formulating the charges, the indictment of the Public Prosecutor is not in accordance with the actions that have been carried out by the defendant as stated in the Terrorism Law. The public prosecutor does not meet the requirements in making an indictment as regulated in the provisions of Article 143 paragraph (2) of the Criminal Procedure Code regarding the formal and material requirements in making an indictment in a criminal act that is charged to the defendant. And based on the decision in Decision Number: 79/Pid.Sus/2020/PN.Jkt.Tim, the judge's consideration is not in accordance with what was done by the defendant who considered that the defendant had attempted to commit a criminal act of terrorism as stated in the facts revealed by the trial in the decision number: 79/Pid.Sus/2020/PN.Jkt.Tim.

Abstract

COVID -19 merupakan virus baru yang menyebabkan masalah kesehatan khususnya pada organ pernafasan dengan penyebaran yang sangat cepat . Sebagai kegiatan penanggulangan penyakit baru ini pemerintah melalui UU Kekarantinaan Kesehatan Pasal 15 ayat 2 melakukan program vaksinasi secara nasional. Pemberian vaksin tersebut ternyata memiliki efek samping yang tidak terduga bahkan berpotensi sampai menghilangkan nyawa.Resiko tersebut membuat keyakinan masyarakat terhadap vaksin menurun, apalagi belum ada kepastian perlindungan hukum terkait dengan kondisi pasca vaksinasi tersebut. Pertanggungjawaban hukum atas tindakan vaksinasi yang menimbulkan efek samping hingga menghilangkan nyawa sebagai kejadian ikutan pasca vaksin dan perlindungan hukum terhadap penerimanya merupakan tanda tanya besar yang perlu untuk dijawab. Berlatarbelakang hal tersebut penelitian ini menggunakan metode penelitian doktrinal dengan pendekatan perundang-undangan dan konseptual. Pengumpulan bahan hukum menggunakan studi pustaka yang terdiri dari bahan hukum primer, sekunder, dan non-hukum. Hasil penelitian ini menunjukkan bahwa, tenaga kesehatan sebagai pelaksana vaksinasi tidak dapat dimintai pertanggungjawaban pidana atas pelaksanaan vaksinasi sepanjang sesuai dengan tatalaksana yang berlaku dan atau tidak terjadi kelalaian yang disengaja. Sedangakn perlindungan hukum bagi penerima vaksin berupa pemantauan dan penaggulangan kementerian terkait serta pemerintah kabupaten /kota setempat terhadap kejadian pasca vaksinasi, dan kompensasi apabila terdapat efek samping penggunaan vaksin tersebut.

Abstract

Corporations’ important and strategic role is indispensable to the development of national economy. Even so, economic development should not be used to serve corporation as justification to sacrifice the environment and wellbeing of the society in order to gain maximum profit. Efforts to develop the mechanism of corporate liability for environmental offenses have been continuously done through the Environment Law issued from 1997 to 2009 and regulations in the Job Creation Law. However, the formulation of responsibility for environmental offenses is still relatively weak, coupled with the absence of a provision for when an environmental offense is committed by a corporation, and the inadequate arrangements for executing punishment for corporations. Through statutory and conceptual approaches, this study seeks to formulate criminal formulations that can be applied to corporations for environmental offenses. In this case, the research is focusing on the additional penalty of corporation dissolution which is seen as the ultimate punishment for corporate law subjects. The existence of dissolution as punishment might serve as an answer to other problems within the realms of environmental law enforcement. This study aims to present provisions of criminal penalties against corporations that pollute and/or damage the environment through editorial norms construction.
