Abstract

This gender perspective of qualitative research explores the shape, causes, impact of dating violence; and access to justice for dating violence victims. Data collection using, observation, interviews, questionnaires, and literary studies. The analysis uses an interactive model. The results showed that, the shape of dating violence, i.e: verbal-emotional, physical, sexual, and economic. The main causes of dating violence are patriarchal culture and a lack of understanding of gender, thus causing gender inequality, parenting gender biased; women stereotype, and the absence of regulation about dating violence. Dating violence affects not only victims but also the perpetrators. The dating violence victims have not gained access to justice, because the legal system, which includes the substance, structure, and legal culture is still gender-biased and patriarchal. This condition is confirmed by the fact that the community and victims do not know, understand, and be aware of their rights to justice. Therefore, we needed efforts to understand gender and dating violence, including access to justice for victims, through student activity in and out of the campus. Lawmaking about eliminating dating violence in the future (ius constituendum) must be made a political agenda for the government and legislative.

Abstract

Legal handling of violence against women, including dating violence, ideally fulfills three elements of the legal system, namely legal structure, legal substance, and legal culture. However, in its implementation, the legal handling of violence during dating is still gender biased. This article is the result of qualitative research with a gender perspective that explores the forms, causes, impacts of dating violence and access to justice for the victims of dating violence at Islamic Universities in Pekalongan. Data collection used observation, interviews, questionnaires, and literary studies and they were analyzed through an interactive model. The results showed the shape of dating violence, i.e.: verbal-emotional, physical, sexual, and economic. Abstract

ABSTRAK Paper ini mengkaji efektivitas penegakan hukum corporal punishment di sekolah. Argumen teoritis yang telah dikembangkan adalah, corporal punishment dianggap sebagai cara efektif untuk mengubah perilaku siswa, namun juga dianggap mengandung muatan kekerasan terhadap anak, sehingga melanggar norma perlindungan terhadap anak. Metode penelitian yuridis empiris, sumber data primer diperoleh dengan observasi dan wawancara. Hasil penelitian menunjukkan, corporal punishment disebabkan oleh perilaku siswa dan dari dalam diri guru sendiri. Dampak corporal punishment terhadap siswa, yaitu: 1) tidak mengulangi perbuatannya; 2) malu dan minder; 3) prestasi menurun; 4) semakin nakal, tidak patuh dan melanggar peraturan.; 5) terluka secara fisik. Efektivitas penegakan hukum corporal punishment di sekolah, disebabkan oleh faktor: 1) belum ada peraturan yang khusus mengatur tentang corporal punishment di Sekolah; 2) guru sebagai pelaksana hukum di Sekolah belum memahami substansi peraturan perundang-undangan;3) sarana dan fasilitas tidak representatif, sehingga kurang mendukung penegakan hukum; 4); masyarakat di lingkungan sekolah sebagai tempat diterapkannya norma hukum belum memiliki kesadaran hukum dan; 5) budaya hukum berbasis pada otoritarian. Oleh karena itu, seharusnya melakukan reformasi hukum (law reform) secara menyeluruh mulai dari pembentukan peraturan perundang-undangan yang secara khusus mengatur tentang corporal punishment, membangun budaya hukum non otoritarian tanpa kekerasan di Sekolah, meningkatkan kesadaran hukum memperbaiki sarana dan fasilitas yang mendukung penegakan hukum di sekolah. Kata kunci: corporal punishment; guru; penegakan hukum; sekolah; siswa. ABSTRACT This paper examines the effectiveness of corporal punishment law enforcement in schools. The theoretical argument that has been developed is that corporal punishment is considered as an effective way to change student behaviour, but is also considered to contain the content of violence against children, thus violating the norms of protection against children. The research method empirical juridical, primary data sources obtained by observation and interviews. The results showed that corporal punishment was caused by student behaviour and from within the teacher himself. The impact of corporal punishment on students, 1) not repeating their actions; 2) shame and inferiority; 3) decreased performance; 4) getting naughty, disobedient and breaking the rules; 5) physically injured. The effectiveness of corporal punishment law enforcement in schools is caused by factors, 1) there is no specific regulation about corporal punishment in schools; 2) teachers as law enforcers in schools do not yet understand the substance of laws; 3) The facilities do not support law enforcement; 4); the community in the school environment as a place for implementing legal norms, does not yet have legal awareness and; 5) legal culture based on authoritarianism. Therefore, law reform should be done as a whole, starting from the law-making about corporal punishment, building a non-authoritarian legal culture, non-violent in schools, increasing legal awareness and the supporting facilities law enforcement in schools. Abstract

This paper analyzes strategic policies for preventing child marriage in Rembang Regency. This evaluative research uses interviews, questionnaires and literature studies for data collection. The study results show that the gender-integrated policy of child marriage prevention in the Rembang district can be seen in regulations, budgets, strengthening of child groups, institutions and cooperation. Sufficient budget and human resources, including the openness of information systems, are the strengths of the policy on child marriage prevention in this area. Programs are still partial; weakness in monitoring- evaluation; weakness in gender mainstreaming commitment; gender biased organizational culture; budget politics that often change; and the fewer activity children's forum are weaknesses in this policy. There are national and international policies; orderly population administration; gender and child disaggregated data; Information Technology; collaboration with NGOs and the private sector an opportunity that must be considered for the success of this policy. Another hand, attention must be on policy threats, namely: low education; high poverty; patriarchy; child marriage traditions; ngemblok tradition; information technology; changes in the age limit for marriage; minimal community involvement; gender insight uneven and; understanding of child rights is low. Child marriage prevention policies have an impact on target groups, non-target groups, and direct and indirect costs. Optimization of child marriage prevention policies should be carried out using scheme 1, maximizing strengths to minimize threats; scheme 2, optimizing gender equality in regional apparatus organizations and; scheme 3, monitoring-evaluation is carried out periodically and structured. These schemes must pay attention to the five "appropriate" namely the appropriate choice of policies and programs, implementation, targets, environment and process appropriate.

Abstract

Pekalongan City Investment and One Stop Integrated Service (DPMPTSP) Office launched an online-based licensing system called Sistem Perizinan Online, Ringkas, dan Ekonomis (SAKPORE) so that the people of Pekalongan City can take care of their business licensing online. Previously, licensing services still used a manual system which was feared to create increasing risk on data storage, such as corrupted data. The public also required to come to the office to obtain information about what requirements needed when submitting an application, which costs a lot of money, and to make it worse, lack of information about the processing timeframe are still persist in the whole process. Therefore, this study aims to determine the licensing services using the SAKPORE system. The type of research is empirical juridical with a qualitative approach. The data analysis method that being used is data reduction, data presentation, and drawing conclusions. The results conclude that the ease of applying for online licensing using the SAKPORE system at the Pekalongan City Investment and One Stop Integrated Service (DPMPTSP) can shorten service procedures, service completion time frame, and service completion costs.

Abstract

This study analyzes the legal awareness of the communi5ty in the general election and its implications for political participation, especially among the people in Pemalang Regency. They were referring to the Pemalang district general election in 2019 and that the community should actively participate in the general election process. However, based on the results of interviews with the community, it shows that the community’s understanding or mindset in the implementation of the general election, is often faced with deeprooted obstacles, ranging from the low level of understanding and ability of the community to implement democracy, as well as confusion about how to participate through legal, constitutional and moral political procedures and methods. This study aimed to determine the legal awareness of the people of Pemalang Regency in the 2019 general election and the implications of public legal awareness on political participation. This study uses a type of empirical juridical research, namely where the research is carried out by combining legal materials with data obtained from the field. With the type of qualitative research approach. Based on the results of the study, it can be concluded that the public’s understanding of the contents of the regulations is still relatively shallow because they do not know how the goals and missions of the regulations that have been made and new policies in the general election strategy.

Abstract

This paper analyzes about the implementation of the PKH program and the factors that influence the implementation of the program. This policy evaluation research uses a qualitative approach. Data obtained by observation, interviews, and documentation. The selection of informants used a purposive technique and was developed using the snowball method. The analysis technique uses an interactive model. The results of the study show that the implementation of PKH in North Wanarejan village is in accordance with the Regulation of the Minister of Social Affairs of the Republic of Indonesia Number 1 of 2018 concerning PKH. Supporting factors in the implementation of PKH include: 1) the enthusiasm of the residents in responding to the Program; 2) the presence of PKH recipients participating in activities; 3) active recipients of PKH assistance in implementing the program; 4) PKH recipients are easy to accept suggestions and directions from PKH facilitators. Meanwhile, the inhibiting factors in the implementation of PKH include: 1) the community does not understand the regulations related to the PKH mechanism; 2) the data received by the PKH facilitator is direct data from the central government, so the data is different from the facts on the ground; 3) The names of PKH participants who are not entitled to receive assistance cannot be exchanged, replaced or added. This fact contradicts the Regulation of the Minister of Social Affairs No. 1 of 2018 concerning PKH.

Abstract

This paper analyzes the fulfillment of workers' rights in Termination of Employment Relationship during the Covid 19 Pandemic at PT Sukorintek and legal remedies that can be taken to fulfill workers' rights.This empirical juridical research uses a qualitative approach. Data collection techniques using interviews and documentation studies. The analysis technique uses an interactive model. The results showed that, Fulfilling workers' rights in Termination of Employment Relationship during the Covid 19 Pandemic at PT. Sukorintex Indah Textile is not in accordance with the provisions of the labor laws and regulations. PT. Sukorintex only provides severance pay to workers as much as 0.40 (40%) of the amount that should be received by workers. Whereas according to the labor laws and regulations, workers who are laid off due to force majeure which do not cause the company to close as in the case of PT Sukorintek are entitled to severance pay of 0.75 (zero point seventy five) times of service; 1 (one) time service award in accordance with the period of service and compensation for other entitlements in accordance with the period of service. Legal remedies that can be taken in the case of PT. Sukorintex, among others: using non-litigation, namely bipartite negotiations, mediation, and conciliation or using litigation, namely through the Industrial Relations Court at the District Court in the legal area where the worker/laborer works.

Abstract

Praktik gadai sawah sudah menjadi tradisi yang dilakukan masyarakat Desa Pedagung. Gadai dilakukan tanpa adanya perjanjian tertulis, sehingga tidak ada kejelasan jangka waktu berakhirnya gadai. Penulis tertarik untuk meneliti mengapa gadai sawah masih dilakukan di Desa Pedagung dan bagaimana pelaksanaan perjanjian gadai sawah yang di lakukan masyarakat Desa Pedagung. Jenis penelitian yang di gunakan ialah yurudis empiris. Pendekatan yang digunakan ialah kualitatif. Hasil yang didapatkan penulis bahwa gadai sawah yang di lakukan oleh masyarakat Desa Pedagung tidak sesuai dengan ketentuan hukum islam yang mengatur tentang gadai maupun Peraturan Pemerintah Pengganti Undang-Undang No. 56 Tahun 1960. Ketidak sesuaian perjanjian gadai sawah yang dilakukan oleh masyarakat Desa Pedagung tidak sesuai dengan hukum Islam sebab memiliki faktor riba, karena akad gadai bertujuan meminta keyakinan ataupun jaminan atas utang untuk orang yang menggadaikan, bukan buat mencari sesuatu keuntungan. Karena dalam perjanjian yang dilakukan oleh masyarakat Desa Pedagung tidak menentukan jangka waktu gadai dan pemanfaatan barang gadai oleh penerima gadai.

Abstract

mbabar ialah istilah yang dipakai masyarakat Kota Pekalongan untuk menjalin hubungan kerjasama antara pengusaha batik dengan pengrajin batik dalam memproduksi batik. Pada proses pembabaran tidak luput dengan adanya bs (kecacatan dalam membatik). Dalam ilmu hukum bs tersebut dikenal dengan istilah wanprestasi. adanya bs tersebut dapat merugikan pengusaha batik dalam memperoleh laba ketika mendistribusikan produknya dipasaran. Sehingga, ketika terjadi bs, pengusaha batik meminta ganti rugi sesuai kerugian yang dialaminya. Akan tetapi, terdapat beberapa pengrajin batik yang merasa fonomena ini menarik untuk diteliti terkait sebab terjadinya hal tersebut dan penyelesaian wanprestasinya ketika terjadi itikad tidak baik. Penelitian ini merupakan penelitian lapangan (field research), dengan menggunakan pendeketan kualitatif. Objek penelitian ini yaitu wanprestasi pada perjanjian kerjasama (ijarah). Teknik pengumpulan data menggunakan observasi dan wawancara. Teknik analisis menggunakan flow model dan penyajian data. Hasil penelitian menunjukan bahwa faktor penyebab pengrajin memiliki itikad tidak baik yaitu karena ingin menghindari pertanggung jawaban dari adanya wanprestasi. Karena jika terdapat bs dengan jumlah yang besar, maka dapat merugikan si pengrajin. Penyelesaian yang dilakukan yaitu musyawarah. Akibat hukum dari adanya wanprestasi berupa pemberian ganti rugi sejumlah kain yang mengalami bs.
