Abstract

Abstract: The Ayat Mutasyabih is frequently become interesting materials of discussion among Muslims due to the unclear content of its meaning. Moreover, if the Ayat is related to the name of Allah or monotheism, it can lead to disbelievers. The word that is most often debated by scholars today is the word Istawa, because this word in the Qur'an is directly attributed to Allah. There are various ways by which scholars interpret the ayat, some interpret it as it is without interpreting it to other meanings, and some the other way around. So this is the main object of study in this paper. This paper was written using the literature study method, namely by looking at books related to the title of this paper. From the sources obtained, it can be concluded that the scholars in understanding the word istawa are divided into two groups, namely groups that do not seek other meanings just as they are without questioning, simulating, and assuming anything. The second group is the scholars who are looking for Takwil from the word IstawaKeyword: Mutasyabih, Takwil, Istawa.

Abstract

Penelitian ini bertujuan untuk menganalisis legalitas tanah garapan yang dijadikan sebagai objek jual beli ditinjau dari perspektif hukum Islam dan hukum positif. Banyak masyarakat yang memanfaatkan tanah garapan yang dalam hal ini tanah bekas HGU PTPN II. Pemanfaatan itu berupa dengan menanaminya, mendirikan bangunan di atasnya, dan bahkan memperjual-belikannya. Dalam menganalisis masalah ini, penulis akan menggunakan metode penelitian hukum empiris, dengan pendekatan kasus dan memakai teori istishab. Temuan yang didapat di lapangan adalah bahwa status tanah bekas HGU PTPN II tersebut merupakan tanah yang dikuasai langsung oleh negara. Untuk itu, tanah bekas HGU PTPN II tidak boleh dijadikan sebagai objek transaksi jual beli jika tidak ada izin dari negara.

Abstract

Islamic law is required to be able to answer all problems that occur today. There needs to be a new innovation in getting the law out of the Koran. This is what an Arab thinker named Muhammad Syahrur did. He established a theory in interpretation of the Koran. This theory is named after the theory of huddle (limit). This theory is a new theory that in the golden age of Islam itself never came across. For this it is interesting to examine how the huddle theory of interpretation of the Quran can answer the problems that arise in the midst of modern society today. For this reason, the author will create articles using library research methodology (library research) in answering this problem. Thus a conclusion was reached that God's law had a minimum limit and a maximum limit. Keywords: Muhammad Syahrur, hududud, Islamic Law
