Abstract

Tujuan penelitian menganalisis pemeliharaan pemanfaatan pengelolaan hak atas tanah terlantar untuk kepentingan umum dan faktor-faktor yang mempengaruhi. Penelitian ini menggunakan penelitian hukum empiris. Hasil penelitian ini menunjukkan bahwa : (1) Evektifitas Pemanfaatan Hak Atas Tanah Terlantar masih sangatlah kurang, dengan hal ini menunjukkan tidak mencapai tujuan utama dari Undang-Undang No.5 Tahun 1960 Tentang Undang-Undang Pokok Agraria (UUPA). (2) Faktor-faktor yang mempengaruhi kurangnya keefektifan pemanfaatan hak atas tanah terlantar dipengaruhi faktor pemenrintah, masyarakat, kurangnya sarana dan prasarana, serta penertiban pemerintah. The research objective is to analyze the maintenance of the utilization of rights over abandoned land for the public interest and the influencing factors. This study uses empirical legal research. The results of this study indicate that: (1) The effectiveness of the Utilization of the Right to Abandoned Land is still very lacking, which means that it does not achieve the main objective of Law No. 5 of 1960 concerning the Basic Agrarian Law (UUPA). (2) Factors that affect the lack of effectiveness in the use of rights over abandoned land are influenced by factors from the government, society, lack of facilities and infrastructure, and government control.
