Abstract

There are so many content creators that lost their video because of false claim using DMCA notice and takedown. When YouTube receive a report of copyright infringement using notice and takedown, YouTube must takedown that content video as soon as possible. There are three questions related to the problems. They are 1 How do the YouTube’s indicators related to copyright infringement look like reviewed using Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta 2 Are the content creators that lost their content video able to ask YouTube about the clarification of the copyright infringement 3 How is YouTube conduct reviewed using Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta. In order to answer those questions, the researcher used normative research as and secondary data sources. Then, the researcher explained the result of the research using qualitative descriptive. It showed that YouTube does not have copyright infringement indicators. When taking down a content video, YouTube is only using the description provided by the claimer. That conduct did not match the theory of legal certainty. For the content creators that lost their content videos can do an appeal by sending a counter notice and takedown and sending a restoration content request to YouTube. The opportunity that is given by YouTube to the content creators that lost their content was match with the theory of justice. Reviewed using Undang-Undang Nomor 28 Tahun 2014 Tentang Hak Cipta, YouTubes conduct is not violating any terms of that regulation.

Abstract

The implementation of business strategies by Construction Holding Company in business diversification is very vulnerable to violations of Business Competition Law. Violations of business competition by Group Companies / Holding Companies are very crucial Business Competition Law issues. Conflicts of interest in business diversification connected with the jurisdiction of state sovereignty are a polemic of Business Competition Law. The occurrence of Monopolistic Practices and Unfair Competition by the Holding Company against the business world in a country is a violation of the law and contrary to the Business Competition Law. As for knowing the Implementation of Holding Company Business Strategy to Avoid Violation of Business Competition Law and Implementation of Business Competition Law against Prevention of Violations in the Implementation of Business Strategy in Holding Company Companies. From these problems the authors conducted research using normative juridical methods that emphasize the legal norms and laws and regulations and analyzed using descriptive qualitative methods. From the results of research and analysis it can be concluded that the Implementation of Business Strategy on Construction of holding must be guided by the law of business competition and apply good corporate governance and comply with it and carry out with ethics and morality. KPPU embodies business competition law against Prevention of Violations in the Implementation of Business Strategy in the business world by means of advocacy, consultation, namely by developing compliance programs with business competition law such as seminars / outreach and executive forums. In this way it is hoped that business actors, stakeholders and stakeholders can understand and disseminate knowledge in the business world.

Abstract

Penelitian ini bertujuan untuk mengkaji perlindungan hukum konsumen jasa kesehatan pada penyedia layanan khitan rumahan di Kota Yogyakarta, mengkaji tanggungjawab penyedia layanan khitan rumahan di Kota Yogyakarta sebagai pelaku usaha dalam hal terjadi tindakan malpraktik yang menimbulkan kerugian pada konsumen jasa kesehatan, dan mengkaji upaya konsumen jasa kesehatan apabila terjadi tindakan malpraktik oleh penyedia layanan khitan yang menimbulkan kerugian terhadap kesehatan atau keselamatan jiwanya. Dalam rangka mencapai tujuan penelitian tersebut, dilakukan penelitian kepustakaan dan penelitian lapangan. Setelah data diperoleh baik dari penelitian kepustakaan maupun penelitian lapangan, kemudian dianalisis menggunakan metode deskriptif kualitatif yaitu menggambarkan hasil penelitian dengan cara memberikan penjelasan atas data yang diperoleh dan kesesuaiannya dengan ketentuan yang berlaku, diarahkan, diartikan, dan diberi penjelasan kemudian disimpulkan untuk menjawab permasalahan yang dikemukakan. Perlindungan hukum konsumen jasa kesehatan pada penyedia layanan khitan rumahan di Kota Yogyakarta dilaksanakan dengan adanya sejumlah aturan dan perangkat hukum yang melindungi hak-hak konsumen serta dengan pemenuhan sejumlah hak konsumen jasa kesehatan oleh penyedia layanan khitan rumahan. Tanggungjawab penyedia layanan khitan rumahan di Kota Yogyakarta sebagai pelaku usaha dalam hal terjadi tindakan malpraktik yang menimbulkan kerugian pada konsumen jasa kesehatan secara keperdataan dengan memberikan ganti kerugian, secara pidana menerima pemidanaan, dan secara administratif menerima pencabutan ijin praktik.Upaya yang dilakukan konsumen jasa kesehatan apabila terjadi tindakan malpraktik oleh penyedia layanan khitan yang menimbulkan kerugian terhadap kesehatan atau keselamatan jiwanya adalah melalui upaya di luar lembaga peradilan non litigasi dan melalui lembaga peradilan (litigasi) serta meminta bantuan lembaga perlindungan konsumen, seperti LKY, BPSK, dan LO DIY.
