Abstract

Upaya pemulihan aset hasil kejahatan merupakan salah satu perhatian utama dari komunitas global dalam menanggulangi kejahatan keuangan saat ini. Hal ini menjadi salah satu kaidah yang diatur dalam United Nations Convention Againts Corruption (UNCAC) tahun 2003. Dimana, negara-negara pihak diharapkan dapat memaksimalkan upaya-upaya perampasan aset hasil kejahatan tanpa tuntuan pidana. Melalui Rancangan Undang-Undang (RUU) Perampasan Aset yang sudah digagas oleh pemerintah, diharapkan upaya pemulihan aset hasil kejahatan dapat diefektifkan. Beberapa tantangan yang harus dihadapi pemerintah diantaranya terkait dengan isu hak atas harta kekayaan dan juga proses peradilan yang adil. Mengingat pendekatan perampasan in rem telah menggeser nilai kebenaran materil tentang kesalahan dalam hukum pidana menjadi sebatas kebutuhan akan kebenaran formil atas asal-usul harta kekayaan. Dalam pengimplementasian RUU Perampasan Aset nantinya, pemerintah setidaknya harus menegaskan bahwa mekanisme yang digunakan sama sekali tidak membuktikan kesalahan seseorang, melainkan hanya membuktikan bahwa suatu aset merupakan hasil kejahatan.

Abstract

Diamond transactions involve steps such as contact through social media or WhatsApp, choose diamond package, provide account information games, make payments, send proof of transfer, and receive diamonds after payment. There is also a list of diamond prices based on quantity. This thesis analyzes aspects of diamond buying and selling transactions from an Islamic perspective. Diamond buying and selling transactions in the online game Mobile Legends seen from perspective of Islamic law, where the pillars and conditions of buying and selling transactions are observed, including consideration of greeting contracts that allow for postponement of delivery goods. This transaction is considered valid if it meets these criteria. However, There is debate among Islamic scholars about the laws of playing games on line. Some consider it prohibited if they neglect their obligations and detrimental to one's productivity, while others consider it permissible as a form of entertainment. The research also warns of potential risks addicted to playing games. The conclusion of this research states that selling buying diamonds in the online game Mobile Legends is acceptable in view Islam as long as it complies with the principles of the sale and purchase agreement and does not violate the principles of Islamic law. However, this research also warns of dangers potential addiction to playing games

Abstract

E-Learning has changed the traditional learning paradigm that is limited to a certain physical space and time. Through eLearning, students can access various educational contents, such as learning modules, learning videos, interactive exercises, and discussion forums, which can be accessed anytime and anywhere by using electronic devices such as computers, laptops, or smartphones.User Satisfaction with IT (USIT) was developed by DeLone and McLean in the context of Information Systems Evaluation in 1992. DeLone and McLean proposed a framework for measuring the success of information systems based on several dimensions including user satisfaction. This USIT framework has undergone development and modification from time to time by researchers and practitioners in the field of Information Systems Evaluation. This study aims to determine the level of satisfaction on the online simulation using the USIT model which is serious in user satisfaction which consists of variables in USIT.This study shows the level of satisfaction of students as e-learning users. It can be concluded that the majority of students are satisfied with their experience using the e-learning platform. This can be seen from the level of positive responses to questions relating to user satisfaction.
