Abstract

Penal sanctions in Islam on more. Because the basic principle of criminal practice in Islamic justice is "better guilty, than punish innocent people". This paradigm may provide a philosophical explanation and Dawah Islamiyah as a forgiving in the judicial process is much more severe, both for criminal actors and other communities. Therefore, the philosophical judgment of Dawah Islamiyah against criminal law in Islam will be able to provide enlightenment in the judicial process in general.

Abstract

The development of Islamic banking, especially in Indonesia, is currently very perspective. Therefore there is trust from the community must always be maintained. Efforts to develop and trust must support two aspects, namely the implementation of transparency with Islamic ethics and a sense of foundation that provides certainty and a sense of justice. As a sharia banking, the operational basis is Islamic law, thus the readiness of Islamic law must always exist and be able to overcome the development of the development of the Islamic banking world. This paper is only a small part of the discussion to be approved and legal norms of sharia banking are made.

Abstract

Hukum Islam dalam wacana kajian usul al-fiqh menempatkan Alquran, sunnah rasul, ijma dan qiyas sebagai sumber standar. Namun dalam aplikasi dan perkembangannya ditemukan aneka ragam sumber dalam konsep maupun formulasinya.Keragaman tersebut bukan hanya dipengaruhi oleh faktor adanya mazhab-mazhab fikih, tetapi juga merupakan suatu keniscayaan dari perwujudan salah maqasid al-Syari?at.Guna merespon keragaman itulah diperlukan sumber hukum ?eksternal? sebagai metodologi alternative dalam menghadapi perkembangan global.

Therefore, the philosophical judgment of Da'wah Islamiyah against criminal law in Islam will be able to provide enlightenment in the judicial process in general.
