<![CDATA[Tujuan dari penelitian ini untuk mengetahui keabsahan dari perjanjian sharing yang dilakukan oleh penguna akun Netflix premium dengan pihak ketiga dan perlindungan hukum bagi pengguna akun Netflix premium sharing yang diperoleh atau dibeli secara illegal. Penulisan ini menggunakan metode penelitian normative dengan pendekatan peraturan perundang-undangan dan menggunakan pendekatan konseptual. Hasil dari penelitian ini menjelaskan bahwa perjanjian yang terjadi antara kedua belah pihak tersebut tidak memenuhi syarat-syarat sahnya perjanjian yaitu syarat sebab yang halal karena pihak penjual akun ilegal telah berbuat tidak jujur dalam melakukan kegiatan usaha dan ingin mengambil keuntungan untuk dirinya sendiri. Pihak penjual akun ilegal tidak sesuai dengan asas-asas dalam perjanjian yaitu asas itikad baik (good faith) dan telah melanggar syarat dan ketentuan (term and conditions) dari pihak resmi Netflix. Maka dari itu, perlindungan hukum terhadap pengguna akun Netflix premium sharing dan penjual ilegal tidak dapat diberikan karena akibat tidak terpenuhinya syarat objektif (sebab yang halal) sebagai syarat sahnya perjanjian yang tercantum dalam Pasal 1320 BW (Burgerlijk Wetboek). Syarat objektif suatu perjanjian dapat dikatakan sah, yaitu adanya suatu hal tertentu dan suatu sebab yang halal. Dalam syarat-syarat objektif membahas tentang objek dari perbuatan hukum yang telah dilakukan. Jika, tidak terpenuhinya syarat-syarat sah dalam perjanjian, maka perjanjian tersebut menjadi tidak sah atau batal demi hukum (null and void) dan dianggap bahwa perjanjian tidak pernah ada. ABSTRACT The purpose of this writing is to find out the legal protection for users of Netflix premium sharing accounts obtained or purchased illegally and to find out the validity of the agreements that occur between users and third parties. This paper uses normative research methods with a statutory approach and uses a conceptual approach. The results of this study explained that the agreement that occurred between the two parties did not meet the conditions for the validity of the agreement, namely the halal condition because the illegal account seller had been dishonest in carrying out business activities and wanted to take advantage of himself. The seller of illegal accounts is not in accordance with the principles in the agreement, namely the principle of good faith, and has violated the terms and conditions of the official Netflix party, therefore, legal protection for users of Netflix premium sharing accounts and illegal sellers cannot be provided due to the non-fulfillment of objective conditions (halal causes) as a condition of the validity of the agreement contained in Article 1320 BW (Burgerlijk Wetboek). The objective terms of a treaty can be said to be valid, namely the existence of a certain thing and a lawful cause. In objective terms discusses the object of the legal action that has been carried out.
