<![CDATA[Tujuan penelitian menganalisis pelaksanaan asas proporsionalitas dalam perjanjian kerjasama antara pengusaha SPBU dan PT Pertamina Dalam penyaluran bahan bakar minyak di SPBU Pantai Marina Kabupaten Bantaeng. Metode penelitian ini menggunakan tipe penelitian yuridis empiris. Sifat penelitian ini adalah deskriptif analitis. R4Hasil penelitian ini menunjukkan bahwa perjanjian kerjasama antara PT. Pertamina dengan PT. Nur Aulia Pratama Karya dalam bentuk pengusaha SPBU CODO Penerapan asas proporsioanliatas dala perjanjian kerjasama antara PT. Pertamina (Persero) dengan PT. Nur Aulia Pratama Karya dalam bentuk pengusaha SPBU CODO belum sepenuhnya diterapkan karena PT. Pertamina (Persero) mendominasi kontrak sehingga perjanjian Kerjasama tersebut dirancang atas dasar kepentingan bisnis dari PT. Pertamina. Upaya hukum yang dapat dilakukan apabila salah satu pihak melakukan wanprestasi terhadap perjanjian kerjasama penyaluran bahan bakar minyak di Kabupaten Bantaeng melalui jalur musyawarah, apabila jalur tersebut tidak ada kesepakatan maka ditempuh jalur hukum di Pengadilan Negeri Makassar. The research objective is to analyze the implementation of the principle of proportionality in the cooperation agreement between gas station entrepreneurs and PT Pertamina in the distribution of fuel oil at Marina Beach gas stations, Bantaeng Regency. This research method uses the type of empirical juridical research. The nature of this research is analytical and descriptive.
