<![CDATA[Penelitian ini bertujuan untuk mengetahui bagaimana bentuk penyelesaian kecelakaan lalu lintas melalui Restorative Justice. Dan untuk mengetahui hambatan Penyidik Kepolisian dalam melaksanakan penyelesaian kasus kecelakaan lalu lintas melalui Restorative Justice di wilayah hukum Polres Bulukumba. Jenis penelitian Empiris, yakni penelitian yang dilakukan dengan pendekatan pada realitas hukum dalam masyarakat. Lokasi penelitian di kantor Kepolosian Resort (Polres) Kabupaten Bulukumba. Pengumpulan data dilakukan melalui kuisioner dan wawancara. Data-data dianalisis menggunakan pendekatan kualitatif. Hasil penelitian menunjukkan: 1) Penyelesaian kecelakaan lalu lintas melalui Restorative Justice mengacu pada Peraturan Kapolri Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restorative Justice untuk bersama-sama mencari penyelesaian yang adil antara pihak korban dan pihak pelaku dengan metode perdamaian musyawarah untuk mufakat melalui perantara kepolisian berdasarkan ketentuan syarat formil dan materil dengan menekankan pemulihan kembali pada keadaan semula. 2) Hambatan Penyidik Kepolisian dalam melaksanakan Penyelesaian Kasus Kecelakaan Lalu Lintas melalui Restorative Justice wilayah Hukum Polres Bulukumba adalah Tidak tercapainya kesepakatan damai dari pihak korban dan pihak pelaku, Tidak kooperatif dalam pemeriksaan Berita Acara Perkara (BAP), Adanya intervensi dari pihak ketiga, Korban tetap ingin melanjutkan kasus ke pengadilan, Benturan kepastian hukum, dan Adanya batasan dalam pelaksanan keadilan restoratve yang diatur dalam peraturan perundang-undangan. This study aims to find out how to resolve traffic accidents through Restorative Justice. And to find out the obstacles of Police Investigators in carrying out the settlement of traffic accident cases through Restorative Justice in the jurisdiction of the Bulukumba Police. This type of empirical research, namely research conducted with an approach to legal reality in society. The research location is at the Polres Resort (Polres) office of Bulukumba Regency. Data collection was carried out through questionnaires and interviews. The data were analyzed using a qualitative approach. The results of the study show: 1) The settlement of traffic accidents through Restorative Justice refers to the Chief of Police Regulation Number 8 of 2021 concerning Handling of Criminal Acts Based on Restorative Justice to jointly seek a fair settlement between the victim and the perpetrator with the peace method of deliberation to reach a consensus through police intermediaries based on formal and material conditions with an emphasis on restoration to its original state. 2) Obstacles to Police Investigators in carrying out the Settlement of Traffic Accident Cases through Restorative Justice in the jurisdiction of the Bulukumba Police are the failure to reach an amicable agreement between the victim and the perpetrator, not being cooperative in examining the case report (BAP), intervention from a third party, the victim remains want to continue the case to court, conflicting legal certainty, and the existence of limitations in the implementation of Restorative Justice regulated in laws and regulations. 2. Disputes arising from the implementation of mining profit sharing in the Libureng sub-district, Bone Regency, there is no conformity between reality and the delivery of results, the environment has become polluted due to waste, the community's land is no longer fertile, and there have been many fatalities and landslides]]>
