Abstract

Buying and selling is an activity that is carried out by many people, but in the transaction process it must be carried out with the consent of both parties, so that the sale and purchase is only valid according to law. This can also be interpreted in the buying and selling of gold between Budi Said as the buyer and also PT Antam as the gold provider. However, the problem was that when PT Antam employees sent gold to Budi Said, it was explained that the gold received was not in accordance with the weight agreed upon at the beginning. This made Budi Said file a lawsuit against PT Antam for the discrepancy between the gold he received and the amount agreed upon and promised together. The lawsuit was accepted by PT Antam for violating the law, even though clarification should have been made and employees were also responsible. If we look at it from the other side, then when Budi bought gold from PT Antam which he promised, namely through Eksi who was one of PT Antam's employees, this was explained by PT Antam that they had never sold gold below the price set in the company profile. , but in fact the agreement made by Eksi with Budi was far below the normal price or that explained by PT Antam.

Abstract

At this time the Social Security System is expected to make a positive contribution to improving people's rights. Therefore, the community is expected to be actively involved in development activities, especially in social security. The contents of this journal aim to recommend efforts that can be made to maximize the existence of improving the community's economy, analyzing social changes that occur in society. And provide information regarding factual conditions of activities in the form of fulfillment of welfare and steps that can be taken to encourage improvement.

Abstract

Kegiatan jual beli merupakan suatu kegiatan yang sering dilakukan oleh banyak orang. Secara umum, dalam kegiatan jual beli terdapat persetujuan dari kedua belah pihak. Adanya persetujuan dari kedua belah pihak membuat kegiatan jual beli dapat dikatakan sah sesuai dengan hukum yang ada. Penelitian ini akan membahas adanya perjanjian jual beli atau persetujuan dari kegiatan transaksi jual-beli antara Budi Said yang merupakan pembeli dan PT Antam sebagai penyedia barang yang dalam penelitian ini adalah emas. Pada kasus ini, permasalahannya dimulai ketika Budi Said membeli 7 ton emas dari Antam. Budi Said hanya menerima emas tersebut sebanyak 5,9 ton. Oleh karena itu, Budi Said merasa ditipu dan mengirim surat ke Antam Cabang Surabaya, tetapi tidak pernah dibalas. Akhirnya, Budi mengirim surat ke Antam Pusat Jakarta dan dinyatakan bahwa PT Antam tidak pernah menjual emas dengan harga diskon. Maka, kasus wanprestasi ini pun dibawa ke pengadilan. Budi Said menggugat PT. Antam dan Eksi Anggraeni untuk mengganti kerugiannya sebesar 1,1 ton emas.
