Abstract

Abstrak Perkawinan di Indonesia diatur dalam Undang-Undang Republik Indonesia Nomor 1 Tahun 1974 tentang Perkawinan dan Instruksi Presiden Republik Indonesia Nomor 1 Tahun 1991 tentang Kompilasi Hukum Islam. Kedua produk perundang-undangan ini mengatur masalah-masalah yang berkaitan dengan perkawinan termasuk perkawinan antar agama. Dalam Undang-undang Republik Indonesia Nomor 1 Tahun 1974 tentang Perkawinan pasal 2 ayat (1) disebutkan: “Perkawinan adalah sah, apabila dilakukan menurut hukum masing-masing agamanya dan kepercayaannya itu”. Ketentuan hukum positif Indonesia tidak secara tegas melarang tentang perkawinan beda agama. Namun dari ketentuan-ketentuan yang ada serta posisi Indonesia sebagai negara yang non sekuler maka dimaknai bahwa di Indonesia tidak dapat dilangsungkan perkawinan beda agama. Hukum perkawinan di Indonesia tidak mengatur secara khusus mengenai perkawinan pasangan beda agama sehingga ada kekosongan hukum. Mengenai sahnya perkawinan adalah perkawinan yang dilakukan sesuai agama dan kepercayaannya sebagaimana telah diatur dalam Pasal 2 ayat (1) UUP. Penelitian ini menggunakan jenis penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan (statute approach) dan penelitian kepustakaan. Hal ini bertujuan untuk mempelajari lebih jauh terkait dengan pengaturan perkawinan beda agama dalam Undang-Undang Nomor 1 Tahun 1974. Kesimpulan dari penelitian ini adalah keabsahan perkawinan beda agama tetap dikembalikan kepada hukum agamanya masing-masing, sedangkan berkaitan dengan hubungan keperdataan yang timbul dari perkawinan, apabila perkawinan tersebut telah mendapat pengakuan secara hukum, maka semuanya dianggap sah dan dilindungi oleh hukum sedangkan untuk mengatasi kekosongan hukum yang disebabkan ketidaktegasan Undang-Undang Perkawinan dalam mengatur perkawinan beda agama tersebut yakni dengan melihat Pasal 35 huruf a Undang-Undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan. Kata Kunci : Perkawinan Beda Agama; Kekosongan Hukum; Undang-undang Perkawinan Abstract Marriage in Indonesia is regulated in the Law of the Republic of Indonesia Number 1 of 1974 concerning Marriage and the Instruction of the President of the Republic of Indonesia Number 1 of 1991 concerning the Compilation of Islamic Law. These two products of legislation regulate issues related to marriage, including inter-religious marriages. In the Law of the Republic of Indonesia Number 1 of 1974 concerning Marriage, article 2 paragraph (1) it is stated: "Marriage is legal, if it is carried out according to the law of each religion and belief". The provisions of Indonesia's positive law do not explicitly prohibit interfaith marriages. However, from the existing provisions and Indonesia's position as a non-secular country, it is interpreted that in Indonesia interfaith marriages cannot be held. Marriage law in Indonesia does not specifically regulate the marriage of interfaith couples so that there is a legal vacuum. Regarding the validity of marriage, marriage is carried out according to religion and belief as regulated in Article 2 paragraph (1) of the UUP. This research uses normative legal research, using a statute approach and library research. It aims to study further related to the regulation of interfaith marriages in Law Number 1 of 1974. The conclusion of this study is that the validity of interfaith marriages remains to be returned to the laws of their respective religions, while relating to civil relations arising from marriage, if the marriage has received legal recognition, then everything is considered valid and protected by law, while to overcome the legal vacuum caused by the indecisiveness of the Marriage Law in regulating interfaith marriages, namely by looking at Article 35 letter a of Law Number 23 of 2006 concerning Population Administration.

Abstract

The study aims to determine how important the code of ethics of the legal profession is, in Indonesia, and how the application of the code can improve the quality of legal services and increase public confidence in the legal system. The purpose of the Code of Ethics is to ensure that legal practice is conducted with integrity, honesty, and responsibility, as well as to protect the public interest and preserve the dignity of the law profession. In addition, the study examines the problem and the efforts made to solve it. The research uses a qualitative approach by looking at literature, regulations, and case studies related to the code of ethics of the legal profession. According to the research, although the law profession has good codes, they often face problems such as lack of supervision, lack of ethical awareness of practitioners, and external pressure that affects professional decisions. This study shows that sustained ethical education, more surveillance, and firm sanctions for violations of the code of ethics are crucial.Thus, the integrity and professionalism of legal practice can be enhanced and public confidence in the legal system can be preserved.

Abstract

The purpose of this study was to improve the social emotional development of children in group B through the local cultural game mak-mak ambo at the CEMPAKA PAUD Unit, Gunung Egypt Village, Semidang Alas Maras District, Seluma Regency. Classroom Action Research (PTK) which is focused on classroom situations, or commonly known as classroom action research, the procedure used is in the form of a cycle. The main subjects in this study were 15 children in group B. This Classroom Action Research uses the John Elliot model where each cycle consists of four main activities, namely planning, implementing, observing, and reflecting which are carried out through two cycles, namely cycles I and II, each cycle consisting of one meeting. Data collection techniques using observation and documentation methods. Data analysis was carried out in a qualitative-quantitative descriptive manner with the emphasis being used to determine process improvements expressed in a predicate, while quantitative data analysis was used to determine yield improvements using percentages. The results of increasing children's social emotional development through the local cultural game mak-mambo in the CEMPAKA Early Childhood Education Unit, Seluma Regency, in the first cycle of the first meeting was 74% and in the second cycle of the first meeting there was an increase of 90%. The conclusion of the study that through local cultural games mak-mambo can improve social emotional development in group B children in the CEMPAKA Early Childhood Education Unit, Seluma Regency, it is proven that in cycle II there was a significant increase, the percentage of achievement was 90% with very good development criteria (BSB).
