The Circular No. 5/SE-100/I/2015 dated January, 29th 2015 issued by the Ministry of Agrarian and Spatial Planning/Head of National Land Agency, gives order to all ranks of working environment of the Land Agency to use the computerized system in the service of land registration, as long as the facilities and infrastructures are adequate. The strategy is aimed at; easing the access to land registration services for society and modernizing the agrarian management and service, Spatial Planning, and Land service. This is due to some reasons, which also affects the Mortgage Right registration system which, according to respondents, more than one registration of deed of imposition of mortgage but still in one credit agreement, cannot be registered at the same time. This study is an empirical research or non-doctrinal legal research. With regard to this the present study examines implementation of Mortgage Right registration at the Land Office of Badung District based on a computerized system after the issuance of the Circular 5/2015, to identify the obstacles faced in registering Mortgage Right in that new system and to seek for solutions to solve it.

ABSTRAKUrban sprawl mengakibatkan hilangnya lahan pertanian secara terus menerus dan masif di kawasan pinggiran kota, terdegradasinya kualitas hidup manusia dan rusaknya lingkungan, sehingga perlu diketahui kompleksitas masalah yang dihadapi dan diatur. Penelitian yuridis Normatif, bersifat eksplanatoris, dan penerapannya berfokus pada permasalahan (problem-focused research) dan pemecahannya. Suatu tuntutan (das Sollen, ius constituendum) untuk adanya Pengaturan dan Penetapan kawasan pinggiran kota secara konstruktif sebagai Kawasan Ketahanan Pangan dalam Kawasan Strategis Nasional, sebagai bagian dari Percepatan Proyek Strategis Nasional, yang menentukan tatanan kehidupan perdesaan dimasa depan, yang bertujuan untuk perbaikan struktur agraria, melalui penguatan usaha pertanian, penciptaan perumahan dan permukiman baru, peningkatan kualitas hidup manusia dan pencegahan kerusakan lingkungan. Kompleksitas permasalahan yang dihadapi untuk pengaturan kawasan pinggiran kota meliputi seluruh unsur-unsur dalam struktur sistem hukum pertanian, baik faktor teknis, ekonomi, maupun sosial, dan sistematisasi hukumnya yang berlatar belakang permasalahan perturan-perundangan agraria, yang harus direkonstruksi, ditafsirkan kembali, dan diciptakan. Kata kunci: pertanian; pinggiran kota; penataan ruang.ABSTRACTUrban sprawl resulted the continuous and massive loss of agricultural land in suburban areas, degradation of human life quality, and environmental damage, so it is necessary to know the complexity of the problems and to regulate. This is juridical Normative, explanatory research, and its application focuses on the problems and its solutions. There is a demand for constructively regulation and designation of suburban areas as Food Security Areas in National Strategic Area as part of Acceleration National Strategic Project, which determines the future order of rural life, which aims to improve agrarian structures, through strengthening agricultural enterprises, creating new housing and settlements, improving the quality of humanlife and prevention of environmental damage. The problems complexityfor regulating Peri-urban areas comprise in all of the elements of the agricultural law system, both technical, economic and social factors, and the systematization of laws against the background of agrarian law problems by reconstructing reinterpreting and creating.Keywords: agriculture; suburban; spatial planning.

AbstractThe land of Manggarai Timur and Ngada in Flores, Indonesia, is facing complexities in the agrarian sector. There is an overlap of laws on land tenure in the border area between the regencies based on the Regional Spatial Plans of both Manggarai Timur and Ngadha regencies. Not only that this creates horizontal conflicts between the peoples, but the overlap of mining policies also affects the environment. This research investigates the problems and discovers that the complexity can only be untangled by creating a ‘Strategic Area’ which can be implemented with a reconstruction of the current system of spatial planning law. IntisariTanah Manggarai Timur dan Ngada di Flores, Indonesia, menghadapi kompleksitas serius di sektor agraris. Ada tumpang tindih hukum tentang kepemilikan lahan di daerah perbatasan antar kabupaten berdasarkan Rencana Tata Ruang Wilayah Kabupaten Manggarai Timur dan Ngadha. Hal ini menyebabkan konflik horizontal antara masyarakat. Selain itu, tumpang tindih kebijakan terkait pertambangan juga mempengaruhi lingkungan. Penelitian ini menyelidiki masalah dan menemukan bahwa kompleksitasnya hanya dapat dilepaskan dengan menciptakan 'Kawasan Strategis' yang hanya dapat diimplementasikan dengan adanya rekonstruksi terhadap sistem hukum penataan ruang saat ini.
