<![CDATA[Abstrak Penjualan obat telah diatur dalam pasal 196 Undang-Undang Kesehatan, sehingga semua penjualan harus memenuhi persyaratan atau prosedur sesuai dengan aturan tersebut. Praktiknya masih ada orang yang menjual obat penggugur kandungan tanpa izin, namun proses penyelesaian perkara pidana yang terjadi hanya sampai penyidikan saja dan tidak diproses lebih lanjut. Tujuan dari penelitian adalah untuk mengetahui proses penegakan Tindak Pidana terhadap pelaku penjualan obat penggugur kandungan secara ilegal di Polresta Sidoarjo beserta faktor-faktor penghambatnya. Penelitian ini merupakan penelitian deskriptif kualitatif dengan informan dari anggota Polresta Sidoarjo. Data diperoleh dengan cara wawancara dan dokumentasi. Data yang terkumpul dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa proses penegakan hukum Tindak Pidana terhadap pelaku penjualan obat secara ilegal untuk penggugur kandungan di Polresta Sidoarjo tidak menggunakan sistem peradilan pidana pada umumnya, namun hanya dilakukan penyitaan barang bukti serta denda sejumlah uang yang nantinya akan masuk ke buku kas Polresta Sidoarjo dengan dasar hukum Standar Operasional Prosedur (SOP) atasan. Di sisi lain, Faktor yang menghambat proses penegakan terhadap pelaku penjualan obat penggugur kandungan secara ilegal ada antara lain aparat penegak hukumnya tidak memahami proses penyelesaian tindak pidana dan kesadaran hukum masyarakat masih rendah. The practice is that there are still people who sell abortion drugs without permission, but the process of resolving criminal cases that occur only until the investigation and is not processed further. The purpose of the study was to find out the process of enforcing the Criminal Act against the perpetrators of ilegal drug sales in the Sidoarjo Regional Police along with its inhibiting factors. This research is a qualitative descriptive study with informants from members of the Sidoarjo Regional Police. Data obtained by interview and documentation. The data collected is analyzed qualitatively. The results showed that the criminal law enforcement process against ilegal drug traffickers for the abortion in Sidoarjo Regional Police did not use the criminal justice system in general, but only confiscated evidence and fined a sum of money which would later enter the treasury book of the Sidoarjo Regional Police based on superior standard operating procedures (SOP) law. On the other hand, the factors that hinder the enforcement of ilegal ilegal drug sales agents include law enforcement officials who do not understand the process of resolving criminal acts and public legal awareness is still low.
