<![CDATA[ABSTRAK Tujuan penelitian ini untuk mengetahui arah politik hukum Indonesia dalam upaya memberikan perlindungan bagi korban kejahatan melalui upaya restorative justice dan untuk mengetahui implementasi kebijakan hukum pidana dalam upaya melindungi korban kejahatan melalui upaya restorative justice. Metode yang digunakan dalam penelitian ini adalah menggunakan penelitian kepustakaan. Berdasarkan hasil penelitian menunjukan bahwa arah politik hukum Indonesia yakni menuju pada arah terwujudnya penegakan hukum yang berkeadilan, hal ini dapat terlihat bahwa penyelesaian perkara pidana melalui restorative justice dipandang sebagai terobosan. Adapun implementasi kebijakan hukum pidana yang mengatur penyelesaian perkara melalui restorative justice ini tersebar dalam berbagai peraturan perundang-undangan, baik secara tersirat maupun tersurat termasuk juga terkait pengaturan diversi yang mendukung terwujudnya keadilan restoratif. Oleh karena itu, dalam menerapkan restorative justice perlu adanya pedoman pemidanaan yang jelas dengan memperhatikan karakteristik dari masing-masing perkaranya guna dalam mewujudkan keadilan bagi para pihak. Oleh karena itu, penting dilakukan pembaharuan hukum guna terwujudnya keadilan.ABSTRACTThe purpose of this study is to determine the direction of Indonesian legal politics in an effort to provide protection for crime victims through restorative justice efforts and to determine the implementation of criminal law policies in an effort to protect crime victims through restorative justice efforts. The method used in this research is library research. Based on the results of the study, it shows that the direction of Indonesian legal politics is towards the realization of fair law enforcement, it can be seen that the settlement of criminal cases through restorative justice is seen as a breakthrough. The implementation of criminal law policies that regulate the settlement of cases through restorative justice is spread in various laws and regulations, both implicitly and explicitly, including those related to diversion arrangements that support the realization of restorative justice. Therefore, in implementing restorative justice, it is necessary to have clear sentencing guidelines by taking into account the characteristics of each case in order to achieve justice for the parties.
