<![CDATA[Anak yang berkonflik dengan hukum dalam dalam sistem peradilan pidana anak wajib untuk di upayakan diversi. Diversi adalah pengalihan penyelesaian perkara anak dari proses peradilan ke proses diluar pidana dengan menggunakan keadilan restorative. Tujuannya adalah untuk menghindarkan stigma negatif serta memperhatikan kepentingan terbaik bagi anak. Setiap anak yang berkonflik dengan hukum mendapatkan hak untuk dilakukan upaya diversi di setiap tahap pemeriksaan peradilan. Salah satunya dalam tahap pemeriksaan di pengadilan. Pengadilan merupakan lembaga terakhir untuk dapat di upayakan diversi begi anak yang sedang berkonflik dengan hukum sebelum masuk ke persidanga. Namun berdasarkan data di Pengadilan Negeri Marisa, terdapat 12 perkara anak yang berkonflik dengan hukum, 6 diantaranya dilakukan upaya diversi sedangkan 6 perkara anak lainnya masuk ke proses persidangan. Penelitian ini dilaksanakan di Pengadilan Negeri Marisa Kabupaten Pohuwato. Pertimbangan hakim dalam penerapan diversi yaitu, dari hasil laporan Pembimbing Kemasyarakatan BAPAS. Children who are in conflict with the law in the juvenile criminal justice system are obliged to seek diversion. Diversion is the transfer of settlement of juvenile cases from the judicial process to non-criminal proceedings using restorative justice. The goal is to avoid negative stigma and pay attention to the best interests of the child. Every child in conflict with the law has the right to undertake diversion attempts at every stage of judicial examination. One of them is in the examination stage in court. The court is the last institution to seek diversion for children who are in conflict with the law before entering trial. However, based on data in the Marisa District Court, there were 12 cases of children in conflict with the law, 6 of which were attempted to be diversified while 6 other cases of children entered the trial process.
