Abstract

Penelitin ini di latar belakangan oleh fenomena bahwa efektif tidaknya penjatuhan sanksi tindak pidana korupsi dikabupaten jayapura papua kebanyakan korupsi terjadi pada lingkup pemerintah maupun swasta tetapi kebanyakan juga korupsi yang terjadi di bidang pertanian terutama dampak negative pada sector perekonomian serta kehidupan pada petani sehingga menghambat kemajuan dan pertumbuhan disektor pertanian. Penelitian ini dilaksakan di kabupaten jayapura papua pada kantor polres jayapura, Kejaksaan Negeri Jayapura dan Pengadilan Negeri jayapura dengan alas an bahwa instansi yang terjadi di kabupaten jayapura selama tiga tahun terakhir. Hasil penelitian ini menukkan bahwa dalam waktu tiga tahun terakhir ini. Tingkat efektifitas penjatuhan sanksi tindak pidana korupsi mengalami peningkatan. Hal ini di sebabkan karena kekurangna kepekaan apparat penegak hokum dalam hal mencegah serta mengurangi terjadinya tindak pidana korupsi disamping itu pula kesadaran hukum dan oknum pemerintah sendiri yang melakukan tindak pidana korupsi yang seharusnya ia mengetahui hukum sebagai unsur pemerintah tetapi malah ia sendiri yang melakukan perbuatan korupsi. Padahal yang melakukan korupsi diancam dengan sanksi penjatuhan yang berat. This study was in the background by the phenomenon that the effective absence of the rationing of corruption criminal sanctions in the district Jayapura Papua most corruption occurs in the scope of the government and private but most of the corruption in the field of agriculture, especially negative impact on the economic sector and life on the farmers, thereby inhibiting progress and growth of agricultural disetor. This research was established in Jayapura Papua District at the Jayapura Police Office, Jayapura state Attorney and the District Court of Jayapura with the base that the agency occurred in Jayapura district for the last three years. The results of this study have been inserted in the last three years. The level of effectiveness of criminal offence sanctions has increased. This has been caused by the Kekurangna sensitivity apparat the law enforcement in preventing and reducing the corruption of criminal acts besides the legal awareness and the Government itself who committed criminal acts of corruption that he should know the law as an element of the government but instead he himself doing corruption. In fact, corruption is threatened with heavy allotment sanctions.

Abstract

This research aim to analyzes the authority of the Regional Police of Riau Islands in a criminal act of corruption investigation. The method used is normative-empirical research. The results found that investigation of criminal corruption in Regional Police of Riau Islands conducted according to the authority of police investigators. In addition to proving the deeds of perpetrator, criminal investigation of corruption is also a means of restoring the state's financial losses as much as possible. In its implementation, corruption criminal investigation is influenced by legal factors, law enforcement factors, supporting facilities or facilities supporting law enforcement, community factors, and cultural factor.

Abstract

The purpose of this research is to study the role of justice collaborator in uncovering who is the mastermind behind a major crime in the act of criminal law, and also not only end on a minor defendant (field defendant). The empirical law research methods is conducted on the Commission Eradication Commission (KPK) and the Witness and Victim Protection Agency (LPSK). The results shows that the role of justice collaborator facilitates the verification in the criminal judicial process in order to totally reveal the well-organized transnational crime. In this context, corruption in Indonesia is committed collectively, the existence of regulations on justice collaborator is a legal instrument that is expected to strengthen the collection of Form of Evidence dan Real Evidence at the trial

Abstract

Penelitian bertujuan untuk untuk mendeskripsikan kedudukan anak dalam perkawinan poligami, dan untuk mendeskripsikan perlindungan hukum hak anak dalam keluarga poligami. Tipe penelitian ini adalah normatif, Pendekatan yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan dan dan pendekata konseptual, kemudian dilakukan analisis deskripsi, argumentasi, interpretasi dan sistematisasi. Hasil Penelitian penulis mendapatkan bahwa: Kedudukan anak dalam perkawinan poligami berdasarkan hukum islam adalah melekatnya hak radla yakni hak anak untuk mendapatkan pelayanan, hak hadlanah yakni hak anak untuk diasuh serta didik sejak bayi, hak walayah yakni hak perwakilan yang diberikan sampai anak tumbuh dewasa balig, hak nafkah yakni hak berhubungan langsung dengan kedua orangtua (nasab). Sedangkan menurut undang-undang perkawinan adalah kedua orang tua wajib memelihara dan mendidik anak-anak mereka sebaik-baiknya, kawajiban yang dimaksud disini, berlaku sampai anak itu kawin atau dapat berdiri sendiri. Didalam Peraturan Perundang-Undangan di Indonesia pemberian perlindungan hak anak dalam izin poligami belum diatur secara khusus, namun ada beberapa pasal yang terkait dengan perlindungan hak anak dalam izin poligami diantaranya, Pasal 55 Ayat 2 sampai Ayat 3 Kompilasi Hukum Islam. Undang-Undang Nomor 1 Tahun 1974 tentang perkawinan Pasal 4 dan 5 dan Peraturan Pemerintah Nomor 10 Tahun 1983 juga membahas mengenai poligami. The study aims to: describe the position of a child in a polygamous marriage, and to describe the legal protection of children in polygamous families. This type of research is a normative approach used in this study is the approach of legislation and and pendekata conceptual, then analysis the description, argumentation, interpretation and systematization. Results The study authors found that: The position of the child in a polygamous marriage under the laws of Islam are sticking right radla the child's right to get the service, right hadlanah the rights of children to be raised as well as students from infancy, the right Walayah the rights of representation granted until the child grows up puberty, rights or the right living in direct contact with both parents (nasab). Meanwhile, according to marriage law is both parents are obliged to maintain and educate their children as well as possible, our obligations in question here, valid until the child is married or can stand alone. In Regulation Legislation in Indonesia providing protection of children's rights in the permission for polygamy is not specifically regulated, but there are several articles related to the protection of children's rights in the permission for polygamy among others, Article 55 Paragraph 2 to Article 3 Compilation of Islamic Law. Act No. 1 of 1974 on the marriage of Articles 4 and 5 and Government Regulation No. 10 of 1983 also talked about polygamy.

Abstract

Peneltian ini bertujuan untuk mengetahui apakah dengan dikeluarkannya Peraturan Pemerintah No. 92 Tahun 2015 tentang pelaksanaan KUHAP berkaitan dengan naiknya besaran ganti kerugian dapat dilaksanakan dengan proses mudah sesuai degan prinsip kemudahan dan keadilan. Penelitian ini merupakan penelitian yuridis sosiologis (sosiological jurisprudence). Penelitian ini berbasis pada ilmu hukum normatif (peraturan perundang-undangan), mengamati berbagai reaksi dan interaksi yang terjadi ketika sistem norma itu bekerja di dalam masyarakat .Penelitian ini dikategorikan sebagai hukum doctrinal tentang hukum in concerto dengan sumber data primer melalui teknik wawancara dengan pihak terkait yang serta data sekunder berupa teknik pengumpulan data dilakukan dengan teknik studi pustaka dengan mengkaji bahan-bahan hukum dan dianalisis dengan menggunakan logika deduksi. Berdasarkan hasil penelitian dan pembahasan diketahui bahwa proses pelaksanaan upaya ganti rugi berkaitan dengan biaya ganti kerugian belum bisa terlaksana dengan mudah karena masih harus mengacu pada keputusan Menteri Keungan No. 983/KMK.01/1983 yang memang sudah perlu direvisi karena terlalu banyak tahapan yang mengakibatkan prosesnya menjadi lama tidak sesuai dengan Peraturan Pemerintahan No. 92 Tahun 2015 yang mensyaratkan pada pasal 11 ayat 2 yang berbunyi “ Pembayaran ganti kerugian dilakukan dalam jangka waktu paling lama 14 (empat belas) hari kerja terhitung sejak tanggal permohonan ganti kerugian diterima oleh menteri yang menyelenggarakan”. This research aims to find out whether the issuance of Government Regulation No. 92 of 2015 concerning the implementation of the Criminal Procedure Code relating to the increase in the amount of compensation can be carried out with an easy process in accordance with the principle of convenience and justice. This research is a sociological juridical study (sociological jurisprudence). This research is based on normative jurisprudence (laws and regulations), observing various reactions and interactions that occur when the normsystem works in the community. This research is categorized as doctrinal law about law in concerto with primary data sources through interview techniques with related parties as well as secondary data in the form of data collection techniques carried out with literature study techniques by reviewing legal materials and analyzed using deduction logic. Based on the results of research and discussion, it is known that the process of implementing the compensation effort relating to compensation costs cannot yet be carried out easily because it still has to refer to the Minister of Finance's decision No. 983 / KMK.01 / 1983 which indeed needs to be revised because there are too many stages which cause the process to be longer than in accordance with Government Regulation No. 92 of 2015 which requires Article 11 paragraph 2 which reads "Payment of compensation is made within a maximum period of 14 (fourteen) working days from the date the request for compensation is received by the implementing minister".

Abstract

Penelitian ini bertujuan Untuk menganalisis dan menjelaskan peran kepolisian dalam penyidikan tindak pidana korupsi pengadaan barang dan jasa di wilayah hukum Polres Pelabuhan Makassar. Untuk menganalisis dan menjelaskan faktor-faktor yang mempengaruhi fungsi kepolisian dalam penyidikan tindak pidana korupsi pengadaan barang dan jasa di wilayah Polres Pelabuhan Makassar. Berdasarkan analisis terhadap data dan fakta penulis berkesimpulan bahwa Fungsi kepolisian dalam penyidikan tindak pidana korupsi pengadaan barang dan jasa di wilayah hukum Polres Pelabuhan Makassar terimplementasi. Faktor-faktor yang mempengaruhi fungsi kepolisian dalam penyidikan tindak pidana korupsi pengadaan barang dan jasa di wilayah Polres Pelabuhan Makassar adalah struktur hukum dan budaya hukum masyarakat. The aims are: To analyze and explain the role of police corruption investigation procurement of goods and services in the jurisdiction of port resort police makassar; To analyze and explained the factors influencing the police investigation of corruption procurement of goods and services in the port resort police makassar. Abstract

Tujuan penelitian ini adalah untuk mengetahui dan menganalisis penerapan restorative Justice dan dampak penerapannya dalam penyelesaian perkara kecelakaan lalu lintas oleh anak di kota Makassar. Metode penelitian ini kalau dilihat dari tipenya adalah tipe penelitian empiris. Hasil penelitian menunjukkan bahwa dalam penyelesaian perkara pelanggaran lalu lintas yang terjadi di Polres Makassar, maka jalan yang terbaik adalah dengan menerapkan penyelesaian restorative justice (keadilan restoratif) yaitu mempertemukan antara pelaku-korban, dan pihak keluarga untuk menyelesaikan perselisihannya dengan disaksikan oleh Polisi setempat. Adapun dampak yang ditimbulkan dari penerapan prinsip restorative justice dalam penyelesaian perkara tindak pidana lalu lintas yaitu tidak ada lagi konflik antara korban dan pelaku, Tidak berlanjutnya kasus ke pengadilan, serta dapat mempengaruhi sanksi pidana terhadap pelaku. The purpose of this study was to determine and analyze the application of Restorative Justice and the impact of its application in solving cases of traffic accidents by children in the city of Makassar. This research method when viewed from the type is the type of empirical research. The results showed that in resolving cases of traffic violations that occurred at the Makassar Police, the best way is to implement restorative justice settlement, namely bringing together the perpetrator-victim, and the family to resolve the dispute in the presence of the local police. As for the impact arising from the application of the principle of restorative justice in the settlement of cases of traffic crimes, namely there is no more conflict between victims and perpetrators, cases of continuing to court, and can affect criminal sanctions against the perpetrators.

Abstract

Paradigma baru dalam undang-undang nomor 23 tahun 23 tahun 2014 tetang pemerintahan daerah menghendaki hubungan yang sejajar antara DPRD dengan pemerintah daerah. Hubungan sejajar tersebut menandakan bahwa posisi DPRD dan pemerintah daerah adalah menempati posisi yang sama kuat. Hal itu di perlakukan guna mewujudkan pemerintahan yang baik (Good Government) yang di imbangi system pengawasan yang efektif dan efesien melalui mekanisme Check and Balance. Pemerintahan baik Good Government adalah pemerintahan yang di jalankan berdasarkan pada norma atau peraturan perundang-undangan yang mengaturnya secara konsisten dan bertanggung jawab dalam rangka mencapai tujuan negara yang di landasi prinsip transparan, angkutabel, bersih, jujur dan amanah. Untuk mewujudkan pemerintahan daerah yang baik, maka fungsi Dewan Perwakilan Rakyar Daerah di dalam melakukan pengawasan atas pelaksanaan urusan pemerintahan daerah adalah sangat penting. Pengawasan DPRD ini termasuk keputusan yang sanagt umum di luar peraturan perundang-undangan seperti kebijkan kepala daerah. The new paradigm in law number 23 of 23 of 2014 regarding regional governance requires an equal relationship between the DPRD and local governments. This parallel relationship indicates that the position of DPRD and local government is in the same strong position. This is done in order to create a good government (Good Government) which is balanced by an effective and efficient monitoring system through the Check and Balance mechanism. Good governance Good Government is a government that is run based on the norms or laws and regulations that regulate it consistently and responsibly in order to achieve the country's goals which are based on the principles of transparency, transportation, cleanliness, honesty and trustworthiness. To realize good regional governance, the function of the Regional People's Representative Council in supervising the implementation of regional government affairs is very important. This DPRD oversight includes decisions that are very general outside the statutory regulations, such as the policies of the regional head.

Abstract

The research objective is to analyze the applicable customary criminal law, as well as the principles of national criminal law contained in the customary criminal law in Tana Toa Kajang, and to analyze the prospects for the application of the principle of material legality to customary criminal law in Tana Toa Kajang in the Criminal Law Reform in Indonesia. The research method used is sociological or empirical legal research. The results of the research show that the material customary criminal law applicable in Tana Toa Kajang is about customary criminal acts and their sanctions. The implementation of customary criminal law in Tana Toa Kajang, is carried out by holding a deliberation called the abborong which is led by Ammatoa and other customary stakeholders. The principles of national criminal law contained in the customary criminal law in Tana Toa Kajang are the principle of ultimum remedium, deliberation, principle, active national / personality, principle of national / passive protection, principle of territoriality, prospects of applying the principle of material legality to the applicable customary criminal law. in Tana Toa Kajang, not all customary criminal acts that apply in Tana Toa Kajang can be processed in court because there is a parameter of the principle of material legality, which is not against Pancasila.

Abstract

Tujuan penelitan ini adalah untuk 1) untuk mengetahui pertimbangan Majelis Hakim dama penilaian sah tidaknya alat bukti dalam menjatuhkan putusan bebas terhadap tindak pidana korupsi. 2) untuk mengetahui putusan bebas terhadap yang dijatuhkan oleh Majelis Hakim dan tindak pidana korupsi sesuai dengan ketentuan hukum pidana materil dan hukum pidana formil. Penelitian ini merupakan penelitian normatif yaitu dengan mengkaji putusan besar diputuskan oleh majelis hakim di pengadilan. Hasil penelitan menunjukan bahwa pembahasan terhadap putusan bebas perkara tindak pidana korupsi Pengadilan Negri Makassar hakim dalam menjatuhkan Putusan bebas terhadap tindak pidana korupsi dengan pertimbangannya tergantung kesesuaian antara keterangan saksi dan alat bukti, serta keluarga ahli. 3) bahwa putusan bebas yang diputuskan oleh Majelis Hakim tindak pidana materil dan hukum formil. The purpose of this research is to 1) to find out that the Judges' assessment is invalid as evidence in issuing a free decision against a criminal act of corruption. 2) to find out the verdicts free from those imposed by the Panel of Judges and corruption in accordance with the provisions of material law and formal criminal law. This research is a normative study that examines major decisions made by judges in court. The results of the research refer to the discussion of the case-free verdict in the Negri Realtor Court 3) that the acquittal is decided by the Panel of Judges for material and formal criminal acts.
