<![CDATA[Tujuan penelitian menganalisis penerapan asas perundang-undangan yang demokratis dalam pembentukan peraturan daerah oleh pemerintah daerah kabupaten bantaen dan faktor-Faktor yang mempengaruhi. Penelitian ini dilakukan di Kabupaten Bantaeng. Hasil penelitian Pembentukan peraturan daerah yang demokratis oleh pemerintah daerah Kabupaten Bantaeng belum terlaksana secara demokratis disebabkan partisipasi masyarakat sebagai wujud demokrasi dalam proses pembentukan peraturan daerah hanya bersifat seremonial sehingga ruang aspirasi bagi masyarakat untuk ikut menanggapi atau mengkritisi secara langsung suatu kebijakan daerah yang dikemas dalam peraturan daerah tidak dapat terlaksana. Faktor-faktor yang mempengaruhi dalam pembentukan peraturan daerah Kabupaten Bantaeng diantaranya faktor struktur hukum yakni pemerintah daerah dan DPRD kurang memberikan ruang bagi masyarakat untuk menyampaikan aspirasi, substansi hukum yaitu prinsip demokrasi yang dituangkan dalam Undang-Undang Pembentukan Perundang-undangan masih bersifat relatif disebabkan publikasi peraturan daerah kepada masyarakat bukanlah menjadi suatu keharusan dan budaya hukum masyarakat yakni peran serta masyarakat yang masih kurang dipahami. The research objective is to analyze the application of democratic statutory principles in the formation of regional regulations by the Bantaen district government and its influencing factors. This research was conducted in Bantaeng Regency. Research results The formation of democratic regional regulations by the local government of Bantaeng Regency has not been implemented democratically due to community participation as a form of democracy in the process of forming regional regulations which is only ceremonial so that the aspiration space for the community to participate in responding or directly criticizing a regional policy is packaged in regional regulations cannot be done. Factors that influence the formation of local regulations in Bantaeng Regency include the legal structure, namely the regional government and the DPRD that do not provide space for the public to convey their aspirations, the substance of the law, namely the principles of democracy as outlined in the Law on the Formation of Legislation, are still relative due to the publication of regulations. the area to the community is not a necessity and the legal culture of the community is the role of the community which is still poorly understood.]]>
