<![CDATA[The research objectives of this thesis are: to find out and analyze the basis of judges' considerations in the sentencing of narcotics traffickers in case Number 61/Pid.Sus/2017/ PN.KLT. The problem that will be discussed is what is the basis for the judge's consideration in deciding the case Number 61/Pid.Sus/2017/PN.KLT? The research method is normative juridical using legislation approach, conceptual approach and case approach. The results showed that the judge in convicting the perpetrators of the crime of narcotics dealers in case Number 61/Pid.Sus/2017/PNKTL stipulates the death penalty for defendant I DRANNY PUTRAWIRA Als PUTRA Bin ZAITUL IKHLAS and imprisonment for 15 (fifteen) years for the defendant II SARAH RAHYAN FERI Als FIKA Binti RAHYAN. This has been decided by considering the juridical facts, the facts at trial, and the sociological facts in the two decisions so that the criminal decisions are different. Abstrak Tujuan Penelitian skripsi ini adalah: untuk mengetahui dan menganalisis dasar pertimbangan hakim dalam pemidanaan terhadap pelaku tindak pidana pengedar narkotika pada perkara Nomor 61/Pid.Sus/2017/PN.KLT. Permasalahan yang akan dibahas adalah bagaimanakahasar pertimbangan hakim dalam memutuskan perkara Nomor 61/Pid.Sus/2017/PN.KLT? Metode penelitian adalah yuridis normatif dengan menggunakan pendekatan Perundang-undangan, pendekatan konseptual dan pendekatan kasus. Hasil penelitian menunjukan hakim dalam pemidanaan terhadap pelaku tindak pidana pengedar narkotika pada perkara Nomor 61/Pid.Sus/2017/PNKTL menetapkan hukuman pidana mati pada terdakwa I DRANNY PUTRAWIRA Als PUTRA Bin ZAITUL IKHLAS dan pidana penjara selama 15 (lima belas) tahun pada terdakwa II FERI SARAH RAHYAN Als FIKA Binti RAHYAN. Hal tersebut telah diputuskan dengan mempertimbangkan fakta yuridis, fakta dipersidangan, dan fakta sosiologis pada kedua putusan tersebut sehingga putusan pidananya berbeda.]]>
