<![CDATA[Tujuan penelitian menganalisis pertimbangan hukum hakim Terhadap Putusan Pidana Bersyarat Pelaku Tindak Pidana Kekerasan Dalam Rumah Tangga (KDRT) pada putusan: Nomor 164/Pid.B/PN.KLK, dan 2). Untuk mengetahui dan menganalisis Prespektif Rasa Keadilan Masyarakat Terhadap Penjatuhan Pidana Bersyarat pada Putusan Nomor: 164/Pid.B/PN.KLK. Tipe penelitian ini adalah penelitian hukum normatif. Hasil Penelitian penulis mendapatkan bahwa: 1). Pertimbangan hukum hakim terhadap putusan pidana bersyarat pelaku tindak pidana kekerasan dalam rumah tangga (KDRT) dengan nomor perkara 164/Pid.B/PN.KLK bahwa majelis hakim telah mempertimbangkan syarat formil dan syarat materil dimana terdakwa melanggar peraturan pidana dan korban telah memaafkan terdakwa atas perbuatannya. 2). Prespektif rasa keadilan Masyarakat terhadap penjatuhan pidana bersyarat dimana dimana hakim semestinya menjatuhkan pidana lebih optimal kepada terdakwa. The research objective is to analyze the judge's legal considerations regarding conditional criminal decisions for perpetrators of crimes of domestic violence (KDRT) in decisions: Number 164/Pid.B/PN.KLK, and 2). To find out and analyze the Perspective of the Community's Sense of Justice Regarding Conditional Sentencing in Decision Number: 164/Pid.B/PN.KLK. This type of research is normative legal research. The author's research results found that: 1). The judge's legal consideration regarding the conditional criminal decision for the perpetrator of the crime of domestic violence (KDRT) with case number 164/Pid.B/PN.KLK is that the panel of judges has considered the formal conditions and material conditions where the defendant violated criminal regulations and the victim has forgiven the defendant for his actions. 2). The perspective of society's sense of justice towards the imposition of conditional sentences where the judge should impose a more optimal sentence on the defendant.]]>
