Abstract

Religiosity experiences moderation through encounters with sublime local cultures inherent in the Kei community in Maluku, Indonesia. This makes it worthy of research, especially regarding the integration of custom and religion. Kei culture was formed by the collective memory of their ancestors from Bali, Java, Banten, and other tribes in the archipelago. Conflicting gaps may arise due to paradoxes in cultural and religious life. This paper highlights the paradoxes and gaps between religious egalitarianism and traditional authority structures. It reports on interviews conducted with religious and traditional leaders, social and religious practitioners, and observations made during customary and religious activities in the Kei Islands. Data shows that religious followers' attitudes towards culture have a different quality. However, inclusion through traditional ceremonies is still maintained but the caste layer in custom has internal religious affairs. Likewise, in terms of national life, they have self-meaning as an open society. This paper concludes that accepting customary law can potentially create distortions and exacerbate the problem of changing diversity in life. If customs are managed well, they may stay within and outside the Kei community. Further research is necessary to explore how to rejuvenate the connection between traditional law and religion each time.

Abstract

Divorce mediation carried out outside the court (community) and within court, institutions has yet to be effective even though the government has issued a Supreme Court Regulation regarding mediation in court. The achievement of mediation success, which is still below 5%, has encouraged the Supreme Court to add an article on good faith (article 7, Supreme Court Regulation No. 1 of 2016) as a principle of mediation and the threat of sanctions for parties who do not have good faith. This study aims to reveal how the good faith clause is implemented in resolving divorce conflicts through mediation and sanctions for parties who do not act in good faith at the Pekalongan Religious Court. The data mining method was carried out through interviews with mediators, mediator judges at the Pekalongan Religious Court area, parties to the conflict, and experts in the field of mediation. Data mining was carried out through observational and documentation of domestic conflict studies. The collected data was analyzed through descriptive analysis. This paper concludes that (1) the principles of mediation have not been fully carried out in good faith in resolving divorce conflicts through mediation outside the court, so mediation fails and results in the neglect of protracted conflict issues, (2) mediation in the majority of courts lack of success due to internal and external factors, and (3) the mediator or mediator judge experiences difficulties in implementing sanctions against parties who do not have good intentions in resolving family conflicts. This research recommends that outsied of the court mediation be carried out by professional mediators who support the success of the mediation process in the justice system.

Abstract

Abundant studies on Islamic art have been written, ranging from those based on the dimensions of universality, philosophy, and legal aspects. Yet, how it represents a sense of moderation, which can be found in Islamic semantic legal theory is something underdeveloped. The present research hence aims to reveal this aesthetic dimension examined in the context of Yūsuf al-Qaraḍāwī's jurisprudence for Muslim minorities (fiqh al-aqalliyyāt). Apart from the descriptive analysis, this qualitative research will employ a content analysis method to figure out al-Qaraḍāwī's paradigm in Islamic art, moderation, and fiqh al-aqalliyyāt inherent in his multiple works and interrelate to each other. This study concluded that the aesthetic moderation of the Islamic semantic legal theory lies in the four terms falling under the theory of meaning clarity (naẓariyyat al-wāḍiḥ al-dilālah), i.e., manifest (al-ẓāhir), explicit (al-naṣṣ), unequivocal (al-mufassar), and perspicuous (al-muḥkam). The terms produce beautiful meanings, moving gradually from particularity to universality and corresponding to characters of perfection (symmetrical) and elasticity (asymmetrical). In al-Qaraḍāwī's fiqh al-aqalliyyāt's issues like religious pluralism, greeting other religions' festivals, and democracy, the beauty crystallizes in a thesis that every Muslim must have perfect faith and, at the same time, elastic social association with people of other religions. These findings are expected not only to provide new avenues for the discourse of Muslim minorities but also of Islamic art and semantic law.
