Abstract

This study focuses on adjudication of the judges of MK in which in the tradition of law research, it is called law propositions. It means that based on ideal scientific activities of law science, this study enables to cover several activities: inventories, interpreting, systemizing, and evaluating rules of law, both written and unwritten. According to Gustav Radbruch, of all four activities, interpreting and systemizing are more important. Idealization of such a scientific activity will just get the precision of its verification when it has been completed try an empirical research through deep interviews with the judges of MK. All this time, the writer’s has not conducted distillation or construed the law hidden behind the texts of law. This paper is the writer's initial observation or his preliminary research. Based on religious and law norm of the material of adjudication of judicial review of MK, this study is still normative. According to the writer, the characteristics of the adjudication of the judges of MK is a crucial point or a hard case because it deals with the sensitive areas covered several dimensions such as religion, human right, nationalistic politics. The writer argues that such a kind of crucial adjudication is not proper if the judges only rely on the procedures of formal law, but it needs an innovation or rule of breaking as a form of law innovation (rechtsvinding), indeed rechtsvinding plus. This is a farm of law construction, in which in the tradition of inference of Islamic law it is similar to logical reasoning “al-'illah al­ mustanbathah”: to reach beneficence in the context of state life.Keywords: Mashlahah, rechtsvinding, diyani, qadlai

Abstract

Studying knowledge is studying archeology of human creativities in understanding the process of dialectic. Therefare, knowledge is always promising and dynamic process of progression. In this context, Ibn Hazm adds the importance of values in the process. Axiological dimension in knowledge seems so strongly emphasized in the reading of Ibn Hazm descriptivly. However, the critical-hermeneutical reading of his ideas more fully and precisely shows how widespread Ibn Hazm emphasized the importance of the role and the epistemological dimension of knowledge. This article tries to present both these dimensions.

Abstract

Sunna, based on the Islamic Law perspective, has a fundamental role and position. Sunna is one if Islamic Law sources. It always becomes an object of scientific study because it covers God and human aspects. Many studies on Sunna have been studied by many scholars. Muhammad Syahrur, a Syrian intellectual, is one ef scholars who tries to restudy the concept of Sunna. He views that all this time, there is a Jew mistakes of understanding on Sunna among Muslims. He divides Sunna into two categories, sunna risalah and sunna nubuwwah. The former is eternal while the later is sunna dealing with knowledge so that it may change quite the thing. Such a division is an effort to differentiate between transcendent aspect and profane asped in Sunna. Key Words : Sunna, Treatise, Nubuwwah.

Abstract

In many economic literatures, economy is divided into two sectors, real sector which covers seroice market and goods market, and monetary sector which consists of money market and equity market. In a part of economic system, monetary that runs in a country will affect the economic rate. Monetary economy can be applied in a polity, called monetary policy. In a conventional discussion, a monetary policy is run in order to reach the increase of national income, to stabilize market price, and to control the inflation rate. To get the goal of that macro-economy, the interest rate is used, in which it becomes the weakness of conventional monetary system. The use of interest rate, furthermore, has caused the economic crisis, indeed global financial crisis. In term of new economic system needs, Islamic monetary system riflers a solution to overcome financial crisis. The riffered system is asset based transaction, free of interest, avoidance of transactions containing speculation (maisir) and uncertainty (gharar). Moreover, it also uses stable curencies, i.e. dinar and dirham. Keyword: Monetary system, interest rate, fiat monry, dinar, dirham.

Abstract

The development policy in the reformation era gives priority to the paradigm of human development that puts people as the development actors and places local economy as a vehicle for community welfare. However, the government policy as stated in the national budget precisely contradicts with the role of government that should create the community welfare. This study uses the qualitative approach by using historical and verstehen methods. The management of the national budget shows the existence of the government's role in regulating the sources of general revenue and expenditure budget. The practices of the state financial management used for development purposes to create the public welfare have been conducted since the time of Prophet Muhammad. The management of the national budget in the reformation era uses performance-based budget structure that aims to improve the performance of government with good governance that requires the effectiveness, efficiency, transparency, and accountabilicy in its management. However, the abuse of the budget in the form of corruption still occurs in the management of this national budget. Key words: National Budget, Budget-Politics, Corruption, Islamic Economy.

Abstract

This paper is written to answer two main questions (1) how many were there 'the fruits' of literate movement in Banten, especially as reflected in literature written in Roman scripts (2) whether the rise of 'those fruits' is corelated with the geographical dispersion and intensive growth of the number of the alumni of so called Dutch School? To deal with these two main questions, the present writer will discuss two sub-topics: first, the degree of literacy of Banten indigenous population, and secondly, a number of accessible literatures which were published in 1900-1942, fruits' of the competency of reading and writing of literate group of Bantenese population. Historical approach applied in this study necessitate the present writer to undertake the fallowing steps: (1) heuristical, gathering relevant historical sources and data, (2) data intetpretation, and (3) historiography or historical naration. The reconstruction of those two sub-topics are solely based on the availability of primary sources, collected from National Library and National Archives of Indonesian Republic (PERPUSNAS and ANRI), both in Jakarta. The conclusion which can be taken in this study is that (first), despite of the fact that Banten is recorded as one of residences in Java with the lowest degree of literacy among its population, the product of literacy of its people is quite rich and quality. Secondly, there was a corelation between the growth of the number of alumni of the dutch school and the degree of the productiviry in literate movement.
