Abstract

Obligasi daerah sesuai Peraturan Menteri Keuangan Republik Indonesia Nomor 111/PMK.07/2012 tentang Tata Cara Penerbitan Dan Pertanggungjawaban Obligasi Daerah, yang telah dirubah oleh Peraturan Menteri Keuangan No. 180/PMK.07/2015 tentang Perubahan Atas Peraturan Menteri Keuangan No. 111/PMK.07/2012 tentang Tata Cara Penerbitan dan Pertanggungjawaban Obligasi Daerah, adalah Pinjaman Daerah yang ditawarkan kepada publik melalui penawaran umum di pasar modal.Sejak berlakunya Undang-undang UU No. 32 tahun 2004 tentang Pemerintahan Daerah yang menganut azas Otonomi daerah, penataan pemerintahan dan keuangan daerah semakin menempatiperan yang penting. Kekurangan danadalam APBD dapat dilakukan melalui pinjaman dari masyarakat atau obligasi daerah yangdituangkan dalam Peraturan Pemerintah No. 54 tahun 2018 tentang Pinjaman Daerah.Obligasi ini tidak dijamin oleh Pemerintah Pusat (Pemerintah) sehingga segala resiko yang timbul sebagai akibat dari penerbitan Obligasi Daerah menjadi tanggung jawab Pemerintah Daerah.Tujuan dari penerbitan Obligasi Daerah adalah untuk membiayai kegiatan investasi sektor publik yang menghasilkan penerimaan dan memberikan manfaat bagi masyarakat. Hasil penerbitan obligasi daerah harus dialokasikan dalam APBD. Apabila terjadi penyimpangan dalam pengelolaan obligasi daerah, berarti harus dipertanggung jawabkan pemerintah daerah melalui pertanggung jawaban penggunaan APBD. Jika pengelolaan obligasi daerah ini diserahkan kepada BUMD, bagaimana pertanggungjawabannya manakala terjadi penyimpangan ataupun fraud ? Sehingga mekanisme pengelolaan hasil penerbitan obligasi daerah tersebut mencerminkan kepastian hukum.

Abstract

The transfer of land functions which is quite ambiguous is faced by the government in relation to regulating policies on agricultural areas, especially in Jember district. Regional government obliged to accelerate the pace of economic growth through development housing and industrial development along with increasing population growth,while the government also needs to pay attention to efforts to  maintain as well maintain the existence of agricultural lands to meet the needs of the community incidentally is productive land. Without any effort to overcome the dilemma through improvement of regulations and policies issued previously, namely Regional Regulations Number 1 Year 2015 which is highly irrelevant to current conditions, the rate of decline agricultural land in Jember which has decreased since 2005-2013 will be increasingly high. In 2005 the area was 74,884.13 Ha decreased to 74,229.26 Ha in in 2013, where the area decreased by 654.87 hectares. This fact is also clouded with the rise of housing permits that are adjacent to water sources that hamper their use for irrigation purposes. In fact, the land crisis was caused by developers namely, land that is close to a water source is purchased by the developer so that the impact is not productive land around due to the impact of lack of water flow so that the soil with Such conditions can be considered a crisis land. Such conditions can categorized as an act of wetsonduiking (legal smuggling).

Abstract

The high rate of early marriage in Talagasari Village, Kadungora Garut District. Make local government intervene and move quickly in dealing with underage marriages. Because underage marriages are considered one of the increasing numbers of divorce. Departing from this background, the composer wants to take the following main issues. What are the efforts made by the Talagasari Village Government in reducing the number of underage marriages. And what is the perspective of the law and Islamic law about marriages under age. This type of research research used is field research. That is aimed at solving problems by telling, analyzing, and classifying. The results of research in the village of Talagasari concluded that the efforts of the local government in reducing the number of underage marriages by 1). Conducting socialization and educating the public about the impact by presenting experts in the field.

Abstract

Sumbersari District is a densely populated City District and is the center of education in Jember Regency. At least in Sumbersari District, there are one SMPN, two SMANs and four State Universities. So it is not surprising that the use of land as a regional development in the evacuation of housing development is mostly carried out in the District of Sumbersari, Jember. The use of land in regional development is an option that does not need to be eliminated, but significant solutions must be sought: how to reduce the various impacts that occur as a result of development and how to prevent the environment and natural resources from becoming damaged and depleted (unsustainable) in the programreaching a level growth. Every development carried out in an area must be directed, so that it is balanced, harmonious, efficient, effective, cultured and sustainable in order to improve the welfare of the people with justice. For that, it is necessary to formulate a plan called a spatial plan. Spatial plans that are national in nature, meaning that they "cover the national sector", some only apply to certain regions or regions, such as the General Spatial Plan (RUTR) for special areas, for example the Sumbersari city district. Public policy regarding land cultivation in the regional development sector is needed to assist the area in Sumbersari District to develop land management in regional development in the housingdevelopment sector. The presence of government policies in the form of perda or other policies has a major impact on the implementation of land use in regional development from a housing development perspective.

Abstract

The independence of judicial power is something that is difficult to negotiate and is a complementary element that must be present in the rule of law. At present the judicial authority has many other interventions of the branch of power. Explanation of the 1945 Constitution prior to the amendment said that judicial power is an independent power, but in reality the independence of judicial power has not yet been fully trusted by the public. Judicial power independence is not without limits, but must be accompanied by transparency and accountability so as to prevent abuse of authority. Independent power without a clear mechanism of transparency and accountability will turn into absolute power. Poor image of the law in the eyes of the community one of the causes is distrust in the world of justice which has lasted for quite a long time. In the world of law, there is a practice of judicial corruption that has reached an alarming stage, because it is carried out by law enforcement officials in various strata and layers. This is due to the very lack of professionalism, competence, independence and impartiality possessed by law enforcement officials. Another influence that has been provoked by law enforcement officials is the consumptive culture.

Abstract

Recent criminal law has been applied since 1946, passed in the law number 1 Year 1946 which is the legacy of European colonial era, and since the Indonesian independence has undergone rapprochement with the needs or requirements of an independent nation, even though the process has not been easy and through such a long thought-provoking throes between varied views of criminal law experts from time to time. How the renewal of national criminal law can be realized is the problem faced by the experts in law and politics in the legislative body which has not hitherto been passed yet. The latest issue about criminal law is not only related to the criminal matters, but also including criminal responsibility as well as ideal, humanistic and rational criminalization. Rather, how the reform of criminal law needs to promote the values contained in Pancasila thus the purpose of criminalization can be completely acceptable by the people.

Abstract

Many people argue that customary law is not a law because it has become a habit factor and done over and over again in a certain tribal area. Customary law has occurred from the old days of the Dutch colonial era, which can be wrong in law both punishment of torture and death law. As in the Borneo area if caught stealing will be in the punishment of torture by local residents, just as in today if there is caught stealing or grab if caught will be in the period when it has become the habit of almost all regions in Indonesia as well as in the area of Papua which if his brother died his finger on the piece indicates the lost brother lost his fingers, and it has been done over and over and has become a habit of the area until now. In today's customary law is still going on in the era of globalization but only in certain areas such as the developed areas of customary law has begun to change has started to follow the era, for example in the sophistication of the era of many crimes are done using sophisticated era such as news that often occurs in Hoax nowadays.

Abstract

Garbage is the residue of human business or activities in solid form, either in the form of organic or inorganic substances that are biodegradable or non-biodegradable and are considered no longer useful so that they are disposed of into the environment. The phenomenon of the distribution of waste in Indonesia is currently rampant, due to the lack of public awareness to dispose of waste in the places provided. This causes the amount of waste to increase every year. In addition, the distribution of waste is caused by the absence of legal firmness regarding waste policies, the lack of waste management efforts, uneven means of transporting waste, the inadequate Final Disposal Site (TPA) system and the lack of public awareness in reducing the volume of waste. The waste management is regulated in Article 19 of Law Number 18 of 2008 concerning Waste Management which is carried out by handling and reducing waste. In addition, there is also a principle to regulate the increasingly rampant distribution of waste, namely the principle of good environmental governance. This principle in a regional regulation will produce a permanent legal force that is coercive. It is intended to preserve the environment through environmentally sound waste management.

Abstract

This research is a normative type of research carried out with a legal and historical problem approach so that with prescriptive analysis a discussion can be found as an answer to the problems in regulating village head elections in relation to village administration as a form of village autonomy. One important aspect of Village governance is the aspect of village head elections. Therefore, in the formation of regulating village heads, of course, must pay attention to village autonomy authority. The existence of conflicting norms in the Regulation of the Regent of Sumenep Number 54 of 2019 (Article 26 paragraph (1) number 3 and paragraph Article 26 paragraph (2)) with the Regional Regulation of Sumenep Regency Number 3 of 2019 (Article 16 and 17 letter (a)) shows that Village administration has a very important position and has full authority, especially in producing rules regarding village head elections.
