Abstract

Studi ini memperkirakan pengaruh faktor tingkat organisasi pada motivasi kerja dan kinerja manajer menengah usaha kecil dan menengah (UKM) .Hasil kajian menmenukan bahwa filosofi dan kebijakan, kompensasi dan tunjangan, sistem tujuan, dan kepemimpinan berpengaruh positif signifikan terhadap motivasi kerja manajer menengah yang diteliti. Kedua, terdapat pengaruh positif signifikan motivasi kerja terhadap prestasi kerja. Namun tidak terdapat indikasi bahwa peluang pertumbuhan, lingkungan kerja, sistem evaluasi berpengaruh signifikan terhadap motivasi kerja responden. Berdasarkan temuan, penelitian ini menyarankan empat rekomendasi bagi UKM untuk meningkatkan motivasi dan kinerja manajer menengah, yaitu (1) memastikan kejelasan dan kesehatan kebijakan dan filosofi organisasi, terutama kebijakan sumber daya manusia yang meningkatkan motivasi kerja karyawan. ; (2) membangun sistem kompensasi dan tunjangan yang komprehensif untuk menarik dan mempertahankan karyawan berbakat; (3) mengembangkan sistem tujuan yang jelas dan memadai; (4) meningkatkan kemampuan kepemimpinan manajer tingkat atas.

Abstract

COVID-19 telah menyebar ke seluruh dunia dalam dua tahun terakhir, mengurung orang di rumah mereka dan menutup bisnis dan pasar. Dunia saat ini sedang mengalami krisis ekonomi dan sosial yang dahsyat. Untuk memberi manfaat bagi orang dan untuk melindungi mereka, industri menciptakan produk baru. Produk-produk ini dibuat oleh usaha kecil dan menengah di seluruh dunia. Artikel ini bertujuan untuk menganalisis dampak pandemi COVID-19 terhadap adopsi E-commerce melalui strategi inovasi terbuka dan hasil review menunjukkan bahwa persepsi kompatibilitas dan kompleksitas memiliki pengaruh positif terhadap adopsi E-commerce. Dalam keadaan normal, bagaimanapun, model inovasi terbuka adalah layak. Berbagi pengetahuan dan pengalaman dan sikap manajemen memiliki dampak moderat pada adopsi E-commerce. Hasil ini bermanfaat bagi para peneliti dan pengelola UKM mengatasi tantangan pandemi COVID-19 dan meningkatkan jumlah tenaga terampil yang dipekerjakan. Studi ini menyarankan bahwa UKM harus mempekerjakan pekerja terampil untuk meningkatkan sistem mereka.

Abstract

Budaya berbagi membawa banyak manfaat bagi perusahaan, menciptakan inisiatif dan efisiensi dalam kinerja manajer dan karyawan. Review ini bertujuan untuk menguji korelasi antara budaya Berbagi, perilaku oportunistik, dan efektivitas manajemen karyawan di perusahaan. Hasil Review menunjukkan bahwa budaya berbagi memiliki dampak langsung dan negatif pada perilaku oportunistik, positif pada efektivitas manajemen karyawan di perusahaan. Dalam korelasi ini, kepercayaan karyawan dan komitmen Organisasi bertindak sebagai mediator. Pada saat yang sama, perilaku oportunistik juga telah terbukti memainkan peran mediasi dalam hubungan antara dampak budaya Berbagi terhadap efektivitas manajemen karyawan. Berdasarkan hasil tersebut, Review menyarankan beberapa rekomendasi untuk meningkatkan efektivitas manajemen karyawan. Temuan Review ini menunjukkan pentingnya budaya berbagi dan korelasi langsung dan tidak langsungnya dengan perilaku oportunistik dan efektivitas manajemen karyawan. Ini adalah kontribusi yang berarti baik dalam teori dan praktek Review, dan mereka akan menjadi dasar penting untuk Review lebih lanjut

Abstract

Tujuan dari artikel ini adalah untuk menyelidiki hubungan antara manajemen sumber daya manusia dan manajemen rantai pasokan pariwisata, serta pengaruh rantai pasokan sumber daya manusia dan pariwisata terhadap kepuasan pelanggan dan kinerja operasi. Temuan studi mengungkapkan hubungan antara sumber daya manusia dan manajemen rantai pasokan dalam bisnis pariwisata. Selanjutnya, penelitian ini menemukan bahwa ketidakpastian manajemen sumber daya manusia berdampak pada kinerja organisasi.

Abstract

The culinary business is one of the businesses that is in great demand by the public. This is also supported by the development and changes in lifestyle patterns. Food and beverage is indeed one of the basic needs needed by everyone, but besides that, basic needs can be said to be one of the values of today's lifestyle. Torcheat is one of the industries engaged in culinary tourism by providing all food through torch / baked cooking techniques. The menu provided will start from appetizer to dessert and beverage. This business feasibility study is intended to analyze all aspects and factors that support and influence Torcheat. In addition to collecting information in a primary manner, namely through several data sources such as books, websites and research reports. The authors also collected secondary data by distributing questionnaires and obtaining 154 respondents. The author also conducted validity and reliability tests aimed at testing the accurate level of data results obtained through the dissemination of questionnaires. By carrying out several tests and analyzing all the factors concerned. Torcheat has become more detailed, accurate, and mature conceptual.

Abstract

The legal arrangement of the Business Competition and Partnership Supervisory Commission has accommodated the needs of large business actors and UMKM in improving the economy of the Indonesian people through the implementation of partnership agreements between large business actors and small business actors properly, the KPPU Regional Office I Medan is authorized to carry out supervision. The role of the KPPU's Regional Office I Medan from 2015-2019 there was 1 case of partnership in the core-plasma pattern of oil palm plantations that had been handled by the KPPU's Regional I Medan Office, the handling was stopped for further advocacy. And since 2020 until now received 5 reports of which 1 partnership pattern and 4 forms of core-plasma partnership in oil palm plantations and conducted research case initiatives totaling 2 studies with core-plasma partnership pattern and followed up with advocacy. The handling carried out by the KPPU Regional Office I Medan has followed the procedures of the central office. However, the role of the KPPU in the Medan Region I office has not been effective. The application of sanctions to business actors is carried out by the commission assembly in the form of administrative sanctions and the KPPU Regional Office I Medan has never recommended revoking a business license nor has it been declared a violation of the recommendation. This reality is inseparable from the existence of obstacles in the implementation of the KPPU's Regional Office I in supervising partnerships, both internal constraints, related to distance, costs, human resources, technology, and time, as well as external constraints related to awareness of the legal culture of business actors. Finally, it is hoped that the government should increase the costs for carrying out the commission's duties to play an effective role and provide education to business actors in understanding partnership agreements.

Abstract

A merger is the merge of two or more banks, by maintaining the establishment of one bank and dissolving the other banks with or without liquidating as stated in Law no. 10 of 1998 concerning Amendments to Law no. 7 of 1992 concerning Banking. Mergers carried out by a company must take into account the interests of the company, minority shareholders, employees of the company, creditors, and other business partners of the company as well as the community and healthy competition in doing business as this is mandated in Law no. 40 of 2007 concerning Limited Liability Companies. As a result of the merger of BUMN Sharia Banks, it affects many things, including the Company itself, Bank Customers, Shareholders, and other Creditors who are directly or indirectly related to the merging bank. Therefore, the purpose of this study is to analyze the legal consequences and legal protection for customers after the merger of state-owned Islamic banks. The approach method used is normative juridical, data obtained from a literature study. Based on the results of the study, it can be concluded that the merger of BUMN Syariah Banks resulted in the merging companies, namely PT Bank Syariah Mandiri (BSM) and PT BNI Syariah (BNIS) end because the law was effective from the date of the merger. The dissolution of BSM and BNIS occurred without any prior liquidation. The end of the legal entity status of the merging company is also followed by the transfer of assets and liabilities of the merging company to the merging company. The transfer of assets and liabilities resulted in the shareholders of the merging Company legally becoming the Company's Shareholders who received the Merger, but with voting rights and share conversion agreed upon by the parties involved. According to the Indonesian banking legal system, legal protection for depositors can be carried out in 2 (two) ways, namely implicit and explicit protection, and the existence of a Deposit Insurance Corporation (LPS) which guarantees deposits belonging to depositors in bank mergers.

Abstract

In the application of criminal sanctions against criminal acts of theft in Indonesia, there is currently a paradigm shift from which initially still adheres to a system of retaliation against perpetrators of criminal acts into restoration to its original state, and not retaliation. This is expected to be one of the solutions to the problem of over capacity in Correctional Institutions. This type of research in legal writing is normative legal research with the nature of descriptive analytical research and a statutory approach, while the data collection technique uses library research and field research and data processing is carried out qualitatively. In the implementation of restorative justice there are several obstacles both at the investigator level and at the court level, including refusal from the parties involved to meet, the perpetrator does not want to pay the compensation proposed by the victim, the judge has not fully implemented restorative justice, there is no law that regulates explicitly regarding restorative justice and its application is only limited to minor crimes and imprisonment with a threat of five years in prison. Most law enforcers (police, prosecutors and judges) still have the mindset that crimes must end retributively (punishment) or still prioritize prison sentences besides that the level of public legal awareness is still low and one of the parties violates the agreement.
