Abstract

This article aims to describe and analyse the regulation of International Law relating to the protection of stateless people through the case of Rohingya in Myanmar. The types of approachment use in this article are statute, case and historical approaches. As a normative study, this article shows that the ethnic protection from discrimination and violence in International Law has been carried out by the United Nations through various international declarations and conventions. Myanmar should ratify Convention Relating to The Stateless Person 1954 and the Convention on the Reduction of Statelessness 1961 as part of its obligations and responsibilities to protect and ensure that Rohingyas have their citizenship.

Abstract

Budaya tidak berwujud merupakan warisan budaya dari leluhur yang diturunkan dari generasi ke generasi dimana sangat bernilai dan memiliki daya guna yang tinggi, oleh karenanya sangat penting untuk dilindungi. Penelitian ini bertujuan mengetahui bagaimana Perlindungan Hukum terhadap budaya tidak berwujud benda yang diatur dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 serta mengetahui upaya yang perlu dirumuskan oleh Indonesia untuk melindungi budaya tidak berwujud tersebut dalam kerangka penerapan Convention for the Safeguarding of the Intangible Cultural Heritage 2003. Permasalahan terkait hal ini yaitu perlindungan hukum mengenai warisan budaya tak berwujud benda di Indonesia melalui sistem hukum yang berlaku positif di Indonesia belum mampu secara maksimal, belum optimal dan unikatif dalam memberikan perlindungannya. Penelitian ini merupakan penelitian yuridis normatif dimana penelitian yang dilakukan dengan cara meneliti bahan pustaka terkait Perlindungan hukum terhadap budaya tidak berwujud berdasarkan Convention for the Safeguarding of the Intangible Cultural Heritage 2003 dan Penerapannya di Indonesia. Berdasarakan hasil penelitian dapat disimpulkan perlindungan terhadap budaya tidak berwujud sudah diatur dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 serta Peraturan Menteri dan Kebudayaan Nomor 106 Tahun 2013 Tentang Warisan Budaya Takbenda. Selain itu perlunya dibentuk sanksi dalam Convention for the Safeguarding of the Intangible Cultural Heritage 2003 bagi negara pihak yang tidak menjalankan kewajiban pelestarian dan perlindungan budaya tidak berwujud di tingkat nasional.

Abstract

West Papua as one of the regions in Indonesia that integrates with the New York Agreement between Indonesia and the Netherlands carries the right of self-determination in an effort to separate from Indonesia. This research discusses how the regulation of the right to self-determination as part of Human Rights and examines the basis of West Papua in carrying out the right to self-determination and declaring itself as a state. This type of research is normative, with statutory (statue) and historical approaches. This research concludes that the right to self-determination is part of human rights, while West Papua’s claim as part of the Indonesian State in demanding the right to self-determination is clashed with the Uti Possidetis Juris and Territorial Integrity.

Abstract

This study aims to determine and analyzes the arrangement of non-discrimination principles based on GATs and its implementation in Indonesia from the regulation on the National Payment Gateway. The research method used in this article is a normative legal research by using historical, statutory and case approaches. The research shows that the regulation regarding the principle of non-discrimination is set in the Article II of GATs on the principle of Most Favoured Nation and Article XVII of GATs on the principle of national treatment. The non-discrimination principle states that a country must not be treated differently from other countries that are members of the GATs-WTO as stated in the Schedules of Specific Commitments. Indonesia issues regulations regarding the National Payment Gateway where several articles in the regulation differ from the commitments registered and restrict market access from other countries' services.

Abstract

This article aims to find out and analyze the personality and responsibilities of multinational cooperation in international law. The type of research is normative studies by using statutory, conceptual and historical approaches. It is shown that the personality of multinational cooperation in international law is limited as a quasi subject of international law, which is applied in the context of: 1) party in the settlement of international disputes, limited to the cases of investment disputes through, international arbitration; and 2) party in the drafting of investment contracts using the principles of international trade law, in particular the principles of National Treatment and Most Favored Nations. The responsibilities of multinational cooperation in international law are based on soft law provisions yet applied through host country as the intermediary actor by the regulation in national legal provisions.

Abstract

The state is a continuation of the human desire to interact with each other to complete all the necessities of life. The wider the interpersonal relationship, the greater the need, the greater the need for a state that protects and sustains his life. On February 17, 2008, the Kosovo parliament proclaimed Kosovo an independent state, leaving Serbia at a parliamentary session attended by 109 members. Previously Kosovo was a province under Serbian rule with an ethnic Albanian majority. The purpose of this research is to find out how international law is regulated regarding the formation of a state using the right to self-determination and what is the importance of recognition in the formation of a country. The research method used is a normative juridical research type. The results showed that the right to self-determination has been recognized as a human right in international law. With this right, every country can determine its political status and freely pursue economic, social and cultural development. However, in international law, self-determination is a type of independence that aims to free oneself from colonialism and foreign powers / powers. Regarding the issue of recognition, it is difficult to separate clearly between political and legal elements because the process of granting and refusing recognition by the state is usually influenced by political factors, while the result is legal binding. The definition or elements of the state is contained in the Montevideo Convention 1933, where recognition is a declarative element and if all constitutive elements have been fulfilled by the political community, then automatically it has become a State and must be treated as such by other States.

Abstract

Global warming becomes as an inevitable issue. This phenomenon has an impact on all aspects of life. One of the impacts is the rise in sea level which can cause the sinking of an island. The study discussed the effect that global warming will have on national borders at the UNCLOS 1982 and that new international policies will be needed to deal with the effects of global warming on country areas. This type of research was normatif yuridis, which sourced in secondary data. By taking several approaches, the approach of legislation (approach approach) and the case approach (case approach). Based on the study, the 1982 sea law convention asa rule in imposing maritime limits has not been able to answer the question of the sea's level rise and impact on the region's capital.

Abstract

Abstract Globalization and liberalization have caused many economic actors from developing countries to be eliminated because they cannot compete with economic actors from developed countries. Developing countries are increasingly dependent on developed countries and international economic institutions such as the IMF and World Bank. The World Trade Organization as a world trade organization pays special attention to the interests of developing countries through the provisions of Special and Differential Treatment (S&D). Developing countries under certain conditions can be given special treatment that is more beneficial in their trade relations with developed countries. However, the provisions of S&D to date are still unfair and have a significant impact on the development progress of developing countries as expected. If seen based on MDGs Report data, many developing countries are still in a low level of economic prosperity.

Abstract

In many countries where peacekeeping missions are carried out, gender-based violence and conflict-related sexual violence occur in alarming numbers. Both civilians and fighters, women and children are the most victims in a conflict. Armed conflict becomes a traumatic experience for each individual who experiences it. Women peacekeepers representing the United Nations are in a State to help restore the trust of people experiencing post-conflict trauma. However, to date the number of women is still very low compared to men in the United Nations Peacekeeping Mission. The UN Charter mandates the Security Council to maintain international peace and security. The study discusses how women play a role in international peacekeeping and security missions as well as actions. This type of research is a normative juridical sourced in secondary data. The results of this study show that in all areas of peacekeeping, female peacekeepers have proven that they can perform the same role, by standards and in the same difficult conditions. Therefore, it is an operational imperative of the United Nations to recruit and maintain female peacekeeping forces.

Abstract

Abstract Dumping is a trade activity by the exporter do by selling commodity in international markets at a price less than normal value or under than commodity price in the importer countries. until this cause problem as unfair trade practices. Some dumping prevention polices born to protect domestic market from unfair trade practices. However that polices often misused, not uncommon developed countries doing the protection for their domestic industry. In trade who abused can trigger unfair  trade practices. This type of research is normative juridical. This study  discusses and analyze how impact of application Article VI of Agreement on tariff and trade in preventing dumping dictionary, dumping in value as unfair trade practices, but in reality Anti-dumping and protectionism practice towards developing countries shows that application of anti-dumping duties and protectionism need to be given special attention and must match with procedures contained in Anti-dumping code. This has purpose to reduce protection measures which can be harmful to other countries who do export activities especially developing countries. World organization need towatch over trade activities against all forms resistance who created unfair trade practices by considering policies which already existed.
