Abstract

The issue of inheritance is a matter that is inherently related to human beings, as every individual will inevitably encounter the event of death. Inheritance law governs the rights and obligations concerning the transfer of inherited property to the surviving heirs after the deceased's death. Among the eligible heirs entitled to receive an inheritance from their parents are children, including those born through test tube baby procedures. This research aims to analyze the inheritance status of such children by Islamic law and inheritance law in Indonesia. This study employs a qualitative literature review methodology. The research findings indicate that in Islam, the inheritance rights of children born through the use of sperm and egg from a legitimate couple, where the embryo is transferred into the wife's womb, are considered equivalent to the rights of biological children. The child does not receive the inheritance if a third party is involved. Suppose the child is born out of wedlock (an illegitimate child). In that case, their share is attributed to the mother and her family. In Indonesia, there are three rules governing inheritance cases: customary inheritance law, determined by local customs; Islamic inheritance law, established by the Religious Courts; and civil law, which determines the inheritance share of legitimate children recognized by law. Meanwhile, children born out of wedlock only receive inheritance from the mother and her family.

Abstract

One of the objectives of moral education in this era is to overcome various problems in education and describe the meaning and objectives of education according to the Law of the National Education System. This research attempts to describe the akhlak education of Ibnu Miskawaih, and its implementation in Islamic education at Darussalam University (UNIDA) Gontor. The method used in this research is a qualitative method with a descriptive case study approach. Research data were collected through documents in the form of books and journals that discussed the moral education of Ibnu Miskawaih and his moral philosophy, field observations related to the implementation of Ibn Miskawaih's moral education in the educational environment at UNIDA Gontor, and interviews with lecturers and students regarding academic and non-academic activities. Relevant to the thought of Ibn Miskawaih. This research is expected to be a reference in viewing the implementation of Islamic education by a figure in an institution or educational institution

Abstract

A marriage proposal, or 'meminang' in Indonesian, is a promise a man makes to marry a woman he proposes to. This promise is subject to cancellation due to various factors, either from the man or the woman. However, according to the prevailing customs in Aceh, Indonesia, when a marriage proposal is canceled, the party responsible for the cancellation is subjected to customary sanctions. This research explores the forms of customary sanctions imposed for the cancellation of marriage proposals and examines their compatibility with the concept of 'Mashlahah Mursalah' (public interest). This study employs a qualitative method with an empirical juridical approach. The findings reveal that customary sanctions for canceling a marriage proposal involve the forfeiture of the gold given as a symbol of the bond if the man initiates the cancellation. On the other hand, if the cancellation is initiated by the woman, the gold must be returned twofold. The 'pinangan' gift is considered a non-refundable grant in case of cancellation, regardless of whether the man or the woman initiates it. However, when evaluating the customary sanctions for canceling marriage proposals in light of Mashlahah Mursalah, they are deemed invalid as they contravene several principles of Mashlahah Mursalah, including conflict with the consensus of scholars regarding the law of dowry, contradicting the evidence from the Quran and Sunnah regarding the prohibition of unlawfully taking others' property, and negating greater public interest while opening the door to potential harm.

Abstract

The Qur'an is Muslims' main miracle and encompasses values covering all aspects of life, including education methods. In the Qur'an, various methods are offered for education, such as dialogue, lectures, analogies, stories, advice, wisdom, rewards and punishments, and others. This article discusses implementing teenage education methods found in the Qur'an at SMAS Islam Roudlotun Nasyiin in Mojokerto Regency. This institution is relevant to the theme being discussed: teenagers entering adulthood. The research method used in this study is qualitative, employing two types of research: library research and field research. The survey results indicate that the most favored implementation of teenage education methods from the Qur'an at SMAS Islam Roudlotun Nasyiin is the dialogue method, which involves active interaction between teachers and students. However, this does not mean that other methods are neglected. Besides the dialogue method, habituation is also consistently practiced, such as performing Mutlaq sunnah prayers, giving alms, reading the Qur'an, and greeting teachers upon arrival at school. These methods aim to shape good morals and habits in teenagers.

Abstract

There has been controversy among the community, headmen, and heads of KUA regarding the Circular Letter of the Directorate General of Islamic Guidance Number: P-005/DJ.III/HK.007/10/2021 concerning marriage during the Wife’s Iddah Period, which among its provisions, prohibits the husband's marriage within the iddah period of his wife. The controversy was triggered by the question of whether or not there was iddah for men. This study aims to find out the maqāṣid syarī'ah perspective of Imām al-Syāṭibī on the Circular Letter on Marriage during the wife's iddah. This normative research uses conceptual and historical approaches. The legal analysis uses the concept of maqāṣid syarī'ah Imām al-Syāṭibī both maqāṣid kulliyah and juz'iyyah theories. Results of this Research show that the substance of the Circular Letter is relevant to Imām al-Syāṭibī's maqāṣid syarī'ah principles in that each of its provisions can protect religion, soul, lineage, mind, and property, including the provision prohibiting the husband's marriage during the wife's iddah period. The prohibition is specific to divorce with the status of divorce raj'ī because the maqāṣid is that the existence of iddah in divorce raj'ī serves as a period for both parties (husband and wife) to think clearly about their marriage relationship. Therefore, the Ministry of Religious Affairs, as the formulator of the regulation, needs to disseminate this Circular Letter and especially provide counseling to all KUA so as not to cause different perspectives on this Circular Letter.

Abstract

One of the separate studies in hadith scholarship is Imam Malik's narration model using sighat tahammul which is different from other scholars. That is with the hadiths balâghât (hadiths beginning with "بلغني" or "أنه بلغه" In the study of sanad in general, the hadith belongs to the category of munqathi' (sanad interrupted. This study focuses on the hadiths of Balaghât Muwattha' which are categorized as mu'allaq (dependent), by using the method of takhrîj hadith with the approach of I'tibâr, which examines the existence of other hadiths al-kutub at-tis'ah that support the narration of Imam Malik. From research it can be concluded, that the hadith balâghât mu'allaq in Kitab al-Muwaththa' has a muttashil supporting history from other hadith books, especially al-kutub at-tis'ah, so that with the existence of other muttashil narrations, making the hadith balâghât mu'allaq Malik can be used as a hujjah.

Abstract

This study aims to explain how the Pancasila Student Profile is implemented in the Islamic Religious Education (PAI) curriculum at Salatiga State Vocational School and the methods used to strengthen character according to the Pancasila Student Profile. This research uses a type of qualitative research with a descriptive approach. The methods used are observation, documentation, and interviews to collect data. Before data analysis, the steps followed were data reduction, data presentation, drawing conclusions, and verification. The study results show that: (1) The Pancasila Student Profile is applied in PAI learning by applying habits according to the indicators of the Pancasila Student Profile. (2) The methods used to strengthen the character according to the Pancasila Student Profile in PAI learning include incorporating the Pancasila Student Profile into the subject matter, fostering student discipline, giving good advice and examples from the teacher, explaining ethics to students, emphasizing the meaning of Islam and its application in everyday life. as well as encouraging activities such as congregational prayers, Duha prayers, and reading the Koran. Pancasila Student Profile, if applied in accordance with the indicators set, students will have a character that is in line with the noble values of Pancasila.
