Abstract

This study examines a comparative study of the crime of adultery in Aceh Qanun Number 6 of 2014 concerning the Jinayat Law and Article 284 of the Criminal Code which applies as positive law in Indonesia. From the results of the study it was found that the comparison between the two laws lies in the elements of the crime of adultery, sanctions and procedures for applying the law to the perpetrators of the crime of adultery. In Aceh Qanun Number 6 of 2014 concerning the Jinayat Law, the adulterer was handed down 'Uqubat Hudud lashes one hundred times for married (muhsan) and unmarried (ghairu muhsan) adulterers. Meanwhile, in Article 284 of the Criminal Code, a maximum prison sentence of nine months is imposed on adulterers who are already bound in marriage.

Abstract

This study examines the legal analysis of marriage isbat according to the Civil Code, Law Number 1 of 1974 concerning Marriage and the Indonesian KHI. Based on the results of the study, it was found that marriage isbat is regulated in the Civil Code Articles 100-102. Regarding marriage isbat, the Civil Code does not provide strict limits on the elements that can be considered by the judge in determining the validity of a marriage. However, it has weaknesses, namely the disparity between the Indigenous, foreign and Chinese residents, this is what causes the absence of unification of a regulation and is the background for the birth of Law Number 1 of 1974 concerning Marriage. Law Number 1 of 1974 concerning Marriage also does not provide limitations regarding marriage events that can be requested for ratification. In contrast to the two provisions, the Compilation of Islamic Law (KHI) regulates the isbat of marriage in a strict manner by providing limitations as described in Article 7 paragraphs (1) to (4) in which a marriage can only be proven by a Marriage Certificate. A marriage cannot be proven by a marriage certificate, its marriage certificate can be submitted to the Religious Court/Syar'iyyah Court. The marriage isbat submitted is limited to five things and those who are entitled to apply for itsbat marriage are husband or wife, their children, marriage guardians and parties with an interest in the marriage.

Abstract

In the business world, it is often found in businesses that contain elements of usury in them which makes many people tempted to take part in accepting it because the income obtained exceeds the specified principal limit. However, there are still many people who do not understand the dangers of a business that contains elements of usury. This business practice is not only common among large companies, but also among small people who really want more income than usual. One of these businesses is Multi Level Marketing or abbreviated as MLM which is still being discussed by business people in Indonesia. This system is really lucrative because it can guarantee success and offer riches in a relatively short time. However, the small community certainly needs to know or understand what provisions need to be applied based on a review of muamalah fiqh. Implementation of any business that is permitted and forbidden. Especially as a Muslim who wants to do business and run a business, these business people need to have understood and also implemented Islamic values ​​based on the Qur'an and Hadith.

Abstract

The COVID-19 pandemic has a major impact on life, not only causing a health and humanitarian crisis, the COVID-19 pandemic affects an economic crisis and an increase in poverty in various countries. A holistic policy of handling the pandemic is needed, both in the field of health and economic recovery. Based on previous studies, the infrastructure sector has an effect on economic development and is allegedly a potential sector for the economy of the province of Central Java. This study aims to analyze the impact of the COVID-19 pandemic on the economy and to determine sector linkages. infrastructure to the structure of the economy to then produce recommendations for economic recovery in the province of Central Java. The results of this study show that the COVID-19 pandemic has an impact on the economy of Central Java province, and there is a link between the infrastructure sector and the economic structure, so that the infrastructure sector is a potential sector in the context of economic recovery in Central Java province in the COVID-19 pandemic situation.

Abstract

In Islamic teachings the way to alleviate poverty already exists in one of its pillars, namely by paying zakat. This study explains the public's interest in paying zakat and the managerial ability of Baitul Mal Aceh Tamiang. The main objective of this study was to determine the effect of managerial ability on the public’s interest in paying and the managerial ability of Baitul Mal Aceh Tamiang. It is a quantitative research using primary and secondary data collected through questionnaire and interview. The populations in this study are 70 muzakkis with 41 samples taken using purposive sampling method. Data analysis techniques used are validity test, reliability test, normality test, and simple regression analysis with the help of SPSS. The results show that the influence of managerial ability on public interest is 38% while the remaining 62% is influenced by other factors outside this research. The influence of knowledge about usury towards saving interest has t count of 2.815> and t table 1.683. The coefficient value of the managerial ability variable is 0.298 which means that the independent variable has positive effect on the dependent variable. So that it can be concluded that managerial ability has a positive and significant effect on people's interest in paying zakat in the Baitul Mal Aceh Tamiang.

Abstract

Hadis merupakan ucapan, perbuatan, ketetapan, dan sifat Rasulullah Saw. Dalam Islam, hadis mempunyai peran penting sebagai norma dalam membentuk hokum. Social, dan budaya. Oleh karena posisinya yang sangat menentukan setelah AlQuran, semua umat Islam berupaya menjadikan hadis sebagai legalitas tindakan dalam kehidupan sehari-hari, termasuk menjadikan hadis sebagai legalitas ideology keagamaan. Kajian ini focus pada hadis dikalangan jamaah tabligh dengan menelaah dari proses pembentukan hokum hingga legaltas ideologis. Persoalan penting dalam kajian ini, bagaimana jamaah tabligh memahami hadis untuk diterapkan dalam kehidupannya? Dan bagaimana penginternalisasi hadis dalam menegosiasikan social jamaah dengan norma-norma yang dijelaskan dalam hadis? Dari kajian ini didapakan bahwa jamaah tabligh menjadikan hadis sebagai Sunnah yang hidup dalam keseharian. Penggunaan pakaian gamis merupakan bentuk nyata dari upaya menghidupkan Sunnah. Dalam hal ini, telihat bahwa proses penginterasian terlihat kreativitas jamaah terhadap model pakaian yang digunakan
