Abstract

Legal Standing The dissolution of political parties in Indonesia has never been given to Indonesian citizens. Legal Standing has always been given to the government. This affirmation is contained in Article 68 of the Constitutional Court Law and also confirmed in the Constitutional Court Decision No. 53/PUU-IX/2011 that the phrase “Government” in the dissolution of a political parties is the President. This makes citizens feel that the Government has monopolized legal standing because citizens did not have the same legal standing as the Government. This research aims to discuss the legal standing of citizens in the dissolution of political parties using an Islamic human rights perspective. The research method used is qualitative research using a normative juridical approach, namely conducting research using literature on the reality of the legal standing of disbanding political parties in Indonesia using an Islamic human rights perspective. From the results of this research, it is stated that (1) Legal standing in the dissolution of political parties in Indonesia is in accordance with Article 68 of the Constitutional Court Law that the applicant for the dissolution of political parties is the Government. (2) Based on the analysis of the legal standing of citizens in the dissolution of political parties according to the perspective of human rights in Islam, the legal standing that is only given to the government is not in line with human rights in Islam on, a) the principle of justice. b) Not in accordance with the principle of equality. and c) Not in accordance with the principle of freedom of expression.

Abstract

Pelaksanaan pemenuhan dan perlindungan hak penyandang disabilitas dalam fasilitas ruang publik perlu memperhatikan Peraturan Daerah Kabupaten Semarang Nomor 12 Tahun 2021. Hal ini telah mempunyai indikator khusus pada Pasal 39 ayat (1) dan (2) terkait infrastruktur pada fasilitas ruang publik. Tujuan penelitian ini adalah untuk mengetahui bagaimana pemenuhan dan perlindungan penyandang disabilitas ruang publik yang ada di Kecamatan Bringin terhadap Peraturan Daerah Kabupaten Semarang Nomor 12 Tahun 2021 perspektif Maqashid Syari’ah. Penelitian ini merupakan penelitian yuridis sosiologis dengan bersifat penelitian deskriptif-analisis. Metode pengumpulan data dilakukan dengan sumber informasi langsung dari narasumber, aturan peraturan daerah terkait pemenuhan dan perlindungan penyandang disabilitas. Permasalahan yang ditemukan dalam penelitian ini, kemudian dianalisis menggunakan pendekatan yuridis sosiologis dengan jenis penelitian Field Research yang didasarkan pada hukum positif Indonesia dan beberapa teori hukum Islam. Hasil penelitian pemenuhan dan perlindungan penyandang disabilitas ruang publik pada peraturan daerah Kabupaten Semarang nomor 12 tahun 2021 perspektif maqashid syari’ah, yakni Kecamatan Bringin harus membuat kebijakan terhadap fasilitas ruang publik yang kurang ramah bagi penyandang disabilitas. Adanya koordinasi terhadap proses pembangunan pada masyarakat sipil. Prioritas dalam pembangunan yang aksesibilitas bagi penyandang disabilitas (difabel) berdasarkan pada Pasal 39 ayat (2) yang diperjelas pada peraturan menteri pekerjaan umum nomor 30 tahun 2006 pada Pasal 4 ayat (1)  huruf a sampai p. Hasilnya adalah dalam ruang publik Kecamatan Bringin yaitu kantor Kecamatan Bringin, bangunan gedung, pasar tradisional, masjid dan taman karanglo bringin belum sepenuhnya sesuai. Pembangunan ramah hanya di kantor kecamatan saja kurangnya pemerataan dalam fasilitas ramah penyandang disabilitas dan belum sepenuhnya sesuai jika dilihat dari maqashid syari’ah.

Abstract

The sale and purchase of slashed rice with the cengklong system in Sranten Village, Karanggede District, Boyolali Regency is carried out by farmers and slashers where in the sale and purchase there is a price change that has been agreed at the beginning. This price change occurred due to the quality of rice is not good so that after all the rice was cut down and weighed the results did not match the initial prediction. Therefore, the slasher mencengklong the farmer's rice price that had been agreed at the beginning. The type of this research is field research, using a qualitative descriptive method with an empirical juridical approach. The theory used in this research is maslahah mursalah. Data collection techniques with the method of observation, interviews and documentation. The results of this research are the sale and purchase of slashed rice with the cengklong system in Sraten Village, Karanggede District, Boyolali Regency, the perspective of mashlahah mursalah has more benefits than madharot. The benefits are that the slasher can help  farmers to buy their rice quickly, farmers don't need to rent rice cutting tools, the services of people to pick rice and transportation costs are all from the slasher, farmers can help the slasher by buying the rice and then selling it back to selep (the rice grinder) place, if there is a problem or madharat regarding the price of rice in cengklong slasher and farmers resolve it amicably and through deliberation so that they are mutually pleased with each other.

Abstract

Abstract: Based on Presidential Regulation No. 112 of 2020, there were 10 non-structural state institutions that were disbanded with the aim of increasing the effectiveness and efficiency of implementing government affairs and national development strategies, so it is interesting to examine from the perspective of Bureaucratic Restructuring because this theory includes institutional structural reforms. The research method used in this research is qualitative research using a normative juridical approach, namely conducting research using literature or research on legal principles. From the results of this study, it is stated that (1) The main reason for the dissolution of non-structural state institutions according to Presidential Regulation No. 112 of 2020 is an effort to increase the effectiveness and efficiency of the implementation of government work, to achieve development strategy plans and the bureaucracy which is considered too full, (2 ) The position of Non-Structural State Institutions in the constitutional system of the Republic of Indonesia is directly under the leadership of the President of the Republic of Indonesia, (3) The dissolution of Non-Structural State Institutions based on Presidential Regulation No. 112 of 2020 in accordance with the Theory of Bureaucratic Restructuring because it is in line with the form of Bureaucratic Restructuring, namely: Downsizing, Delayering, Decentralizing, Reorganization, Cost Reduction Strategy, and  Competency. Where the theory of bureaucratic restructuring in the government system in Indonesia is currently seen as very important to realize a government system that is in accordance with the goals of the Indonesian state.

Abstract

Civil lawsuits are not only lawsuits for default, but are also dominated by lawsuits against the law. The difference between a breach of contract and against the law is that the claim for default is to place the loss in a position where the compensation given is the expected loss, while the lawsuit for the unlawful act of the plaintiff is in a position before the unlawful act so that the compensation given is a real loss. The results of the study show that civil lawsuits in the field are dominated by lawsuits against the law, besides of course the lawsuit for breach of contract. To file a lawsuit, the act against the law must be ascertained as stipulated in Article 1365 of the Civil Code, while to file a lawsuit for default, it must comply with the provisions of Article 1243 of the Civil Code. Based on this, the author examines it as a court that is simple, fast, and cheap in accordance with the law No. 48 of 2009 concerning Judicial Power with the concept of Merger of Lawsuits.

Abstract

The distribution of zakat is the process of distributing zakat that has been collected to mustahik which aims to create equitable community welfare. BAZNAS Grobogan Regency is a national zakat management institution with a large area and the majority Muslim population. So, zakat really needs to get attention seeing its great potential. This writing aims to find out how the distribution of zakat in BAZNAS in Grobogan Regency is evenly distributed and how the distribution of zakat in BAZNAS in Grobogan Regency is from the perspective of Law Number 23 of 2011 concerning Zakat Management. The writing method used is a qualitative method with a sociological juridical approach. Data collection was obtained from interviews with BAZNAS in Grobogan district and UPZ in Toroh sub-district. Then, this data analyzed using regulations on zakat, namely Law Number 23 of 2011 concerning Zakat management. The results of this research are in the implementation of the distribution of zakat, BAZNAS Grobogan Regency formed UPZ (Zakat Collector Unit) that located in each District. BAZNAS Grobogan Regency has 19 (nineteen) UPZ, one of which is Toroh District UPZ. The distribution of zakat in BAZNAS in Grobogan Regency is carried out in accordance in Articles 25 and 26 of Law Number 23 of 2011 concerning Zakat Management. However, efforts are needed in order to optimize distribution in UPZ Toroh District. Thus, the distribution of zakat can reach the indigent mustahik who are the area coverage of the UPZ.

Abstract

Rukun Tetangga (RT) merupakan salah satu Lembaga Kemasyarakatan Desa (LKD) sekaligus mitra kerja pemerintah desa dalam meningkatkan pelayanan kepada masyarakat. Permendagri No. 18 Tahun 2018 mengatur tentang Lembaga Kemasyarakatan Desa tak terkecuali dengan masa jabatannya. Namun, masa jabatan RT yang terjadi di Desa Wonorejo berbeda dengan peraturan yang berlaku. Oleh karena itu, peneliti meneliti bagaimana masa jabatan RT tersebut dalam perspektif Permendagri No. 18 Tahun 2018 dan perspektif maslahah. Metode penelitian ini menggunakan jenis penelitian yuridis sosiologis dengan pendekatan kualitatif. Pengumpulan data dilakukan dengan melalui wawancara dengan ketua RT di daerah desa wonorejo kemudian dianalisis menggunakan permendagri dan hukum islam. Hasil penelitian ini menunjukkan bahwa Ketua RT di Desa Wonorejo sebagian menjabat dengan masa jabatan lebih dari 10 tahun. Masa jabatan tersebut melebihi periode yang telah ditentukan dalam Permendagri No. 18 Tahun 2018 Pasal 8 Ayat (3) dan (4), sementara pada perspektif maslahah, masa jabatan tersebut tidak menjadi masalah selama pelaksanaannya dapat memelihara tujuan dari hukum Islam.

Abstract

Penelitian ini merupakan upaya untuk mengetahui bagaimana bentuk pelaksanaan perlindungan yang di berikan Pemerintah Daerah terhadap Perempuan Pekerja Seks Komersial berdasarkan Hukum Positif di Indonesia dalam bentuk Perda Nomor 1 Tahun 2015 tentang Pemberdayaan dan Perlindungan Perempuan di kawasan Karaoke Sukosari Kabupaten Semarang. Tujuan penelitian ini adalah Untuk mengetahui pelaksanaan perlindungan oleh Pemerintah Daerah Kabupaten Semarang terhadap Perempuan Pekerja Seks Komersial berdasarkan Perda Nomor 1 Tahun 2015 tentang Pemberdayaan dan Perlindungan Perempuan di kawasan Karaoke Sukosari Kabupaten Semarang Penelitian ini merupakan penelitian kualitatif yang bersifat penelitian lapangan. Sumber data diperoleh dari hasil wawancara, dokumentasi, dan observasi terhadap Perempuan Pekerja Seks Komersial di kawasan Karaoke Sukoasai, pengurus Paguyuban Karaoke Sukosari, dan Dinas Sosial Kabupaten Semarang. Hasil penelitian ini menunjukan bahawa bentuk perlindungan yang diberikan Pemerintah Daerah Kabupaten Semarang kepada Perempuan Pekerja Seks Komersial berdasarkan pasal 12 dan Pasal 22 Perda Kabupaten Semarang Nomor 1 Tahun 2015 tentang Pemberdayaan dan Perlindungan Perempuan dikategorikan dalam beberapa aspek yaitu sosial yang berupa penyuluhan, ekonomi yang berupa pelatihan keterampilan, hukum yang berupa pengayoman kepada Perempuan Perempuan Pekerja Seks Komersial, dan kesehatan yang berupa adanya cek kesehatan secara berkala.

Abstract

Marriage must be carried out by two people who believe in the same beliefs. The Islamic religion views that if in a marriage there is a husband or wife who changes religion, then the marriage becomes fasakh and is illegitimate to be maintained. But legally, marriages can only be broken up due to death, divorce and court decisions. A married couple who converted but did not apply for divorce in court is still considered a legal marriage. Therefore, the obligations and rights of husband and wife, one of whom has changed religions, must still be carried out considering that their marriage is still legally valid. One of the obligations described in the Compilation of Islamic Law Article 80 Paragraph 3 is that the husband is obliged to provide religious education to his wife. Therefore. This study aims to examine how the implementation of fulfilling the right of a Muslim wife to be given religious education by her non-Muslim husband from a positive law perspective. The type of research used is field research with a qualitative descriptive method and uses a juridical-empirical approach. As for data collection technique by way of interviews. Furthermore, emphasizing the results of observations and then drawing conclusions based on the results of observations in the form of data that has been collected in the form of words from interviews. The results of this study concluded that First, the implementation of fulfilling the rights of Muslim wives to receive Islamic religious education from non-Muslim husbands was not carried out This is because the fulfillment of the right to religious education by teaching prayers and teaching the knowledge of the Qur'an is not done by non-Muslim husbands. The representation of the fulfillment of the right to Islamic religious education granted by a non-Muslim husband is carried out only by giving permission to his wife to participate in the study of religious assemblies. Second, the analysis of the fulfillment of religious education regulated in the Compilation of Islamic Law Article 80 Paragraph 3 as the right of a wife from her husband is not appropriate, this is because the science of monotheism and the science of fiqh which should be taught is not taught by the husband because the husband is non-Muslim. Fulfillment of the right to religious education in accordance with Article 80 Paragraph 3 Compilation of Islamic Law is carried out by non-Muslim husbands, namely by giving permission to the wife to learn religious science from religious assemblies.

Abstract

Dewasa ini populasi masyarakat Indonesia semangkin meningkat, hal tersebut juga berpengaruh terhadap banyaknya konflik dimasyarakat, sehingga menuntut salah satunya kepada lebaga bantuan hukum yang harus mampu membantu menyelesaian permasalahan masyarakat sebagaimana ketentuan undang-undang no 16 tahun 2011 Tentang bantuan Hukum, namun disisi lain dengan minimnya perhatian lembaga bantuan hukum yang konsentrasi kepada masyarakat miskin mengakibatkan adanya subordinasi terhadap meraka yang tidak memiliki banyak uang namun mempunyai permasalahan hukum, karena para advokat hanya konsentrasi terhadap perkara-perkara yang ada uangnya, kendati demikian ada amanah baru pada permenkumham No 1 tahun  2018 tentang paralegal, bahwa penyelesaian hukum pada organisasi bantuan hukum tidak hanya pada Advokat melainkan juga Paralegal, dengan harapan para legal yang mempunyai nalar dan responsibilitas terhadap hukum ini mampu dan tidak tergantung kepada advokat lagi, dalam hal ini penulis meneliti LKBHI IAIN Salatiga sebagai organisasi bantuan hukum yang mempuyai kewajiban penyelesaian perkara pada pencari keadilan baik yang kaya atau miskin, namun dalam hal ini penulis tertarik pada apakah peran paralegal di LKBHI IAIN Salatiga sudah efektif dalam menjalankan perkara nonlitigasi. Penelitian ini menggunakan pendekatan yuridis sosiologis dengan menggunakan bahan hukum yang nantinya dipadukan dengan kondisi saat ini. Hasil penelitian ini bahwa, paralegal LKBHI IAIN Salatiga sudah berperan secara aktif dalam membantu masyarakat pencari keadilan menyelesaikan permasalahan perdatanya dan strategi yang digunakan paralegal menggunakan pencegahan melalui edukasi hukum, penyuluhan hukum dan dalam pendampingan menggunakan bentuk negosiasi dan mediasi sehingga penyelesaiannya lebih cepat, mudah murah namun dalam hambatannya paralegal LKBHI IAIN Salatiga masih perlu penambahan personil dan harus terus ekstra dalam memberikan penyuluhan hukum kepada masyarakat supaya lebih maksimal.
