Abstract

This article aims to examine the case of the distribution of clothing and food packages phase II in East Lombok Regency, or better known as Eid packages in terms of the legal considerations of the judge's decision. The point of policy confusion in state administrative law with criminal law or better known as administrative corruption. Government officials who must implement the policy, when the program is running, must deal with the criminalization of the policies that it implements. Based on these issues it is interesting to discuss related to the legal considerations of the judge's decision to release the accused and whether all government officials have the right to discretion in carrying out their positions. The research method used is a descriptive normative method, with a statutory approach, a conceptual approach and a case approach. The results of the discussion revealed that criminal law is used carefully and operationalized truly as the last drug (ultimum remedium) and not necessarily used as the main drug (primum remedium) so that government officials are no longer afraid to carry out work in the public interest and community welfare.

Abstract

The spirit of building a nation began before and after Indonesia's independence. One of the ways is by establishing a Social Organization, the provisions of the Law on Mass Organizations under the Staatsblad 1870 Number 64 concerning Legal Entities (Rechtspersoonlijkhied van Vereenigingen) which were established before the Proclamation of Independence of the Republic of Indonesia and consistently maintaining the Unitary State of the Republic of Indonesia. as a national asset and do not need to register in accordance with the provisions of this Law. Organizations are required to have AD and ART to be used as guidelines in carrying out organizational activities, ratification as a Association Legal Entity issued by the Minister of Law and Human Rights. CBOs are prohibited from spreading teachings and actions that are contrary to Pancasila. So that Law Number 17 of 2013 concerning Mass Organizations is no longer sufficient, finally the government issued Government Regulation in Lieu of Law Number 2 of 2017 to explain more broadly about prohibited teachings / understandings. The research method used is normative research, with the focus of the study being on the statutory approach to the establishment and dissolution of Community Organizations and reviewing the Supreme Court Decisions related to the establishment and dissolution of CSOs by taking case studies of NW and HTI decisions. The purpose of this study is to find out how the procedures for establishing community organizations and the dissolution mechanism of CSOs. Furthermore, conducting a case study based on the Decision of the Supreme Court Number 37K / TUN / 2016 concerning the establishment of Nahdlatul Wathan (NW) and Decision Number 27K / TUN / 2019 concerning the dissolution of the Indonesian Hizb ut-Tahrir Association (HTI).

Abstract

The writing of this journal aims to determine the form of regional government responsibilities in resolving disputes over the selection of village heads simultaneously in 2016 in East Lombok Regency and to determine the pattern of dispute resolution for village head elections in 2016 by the Regional Government in East Lombok Regency, using normative juridical research methods, the results of this study are the form of responsibility carried out by the local government in resolving village head election disputes in East Lombok Regency, namely the Establishment of the Committee, the Establishment of a Level Supervisory Committee, the Establishment of the District Election Committee and the Formation of the Dispute Resolution Team for the Village Head Election in East Lombok Regency and the Pattern settlement of village head election disputes carried out by the Regional Government is the pattern of negotiation, mediation, conciliation through the implementation of deliberations by taking into account input from the village head election committee, BPD, Camat, and district level dispute resolution teams formed directly by the Regent through the East Lombok Regent letter.

Abstract

Writing this thesis aims to find out the form of legal protection and restrictions on the right to information that can be done in cyberspace. Because of the rapid advances in technology, there are also more problems that arise from this virtual world, this is the background of this thesis writing because it is very important to know what can and should not be done according to laws governing the world this virtual. Some countries, including Indonesia, restrict the right to electronic information, although this kind of regulation, both formally and materially, is contrary to the rights of individuals to privacy and information, but there are other people's rights that also need to be protected and state security that must be protected. The birth of law number 11 of 2008 which was revised to law number 19 of 2016 is clear evidence of the limitation of the right to information in Indonesia, because Indonesia upholds human rights but with this law Indonesia also aims to maintain security or country stability. The conclusion reached is: that the state protects the right to information and the use of technology but is also obliged to protect the public interest from all kinds of disturbances arising from misuse of information, especially through electronic media that disturb public order, or so-called jurisdiction.

Abstract

The Bayan villagers are known as the Bayan Indigenous Peoples, where in their lives, they always apply customary law rules without abandoning state and religious law, one of which is related to marriage. This study aims to determine and analyze the existence of customary law in the aspects of the social and cultural life of the Bayan Village community and what factors are supporting and inhibiting the existence of customary law in the socio-cultural aspect of the Bayan Village community. The approach used is a qualitative approach with an empirical sociology method. The sampling technique is the Purposive Sampling technique. Sources of data in this study are primary and secondary data sources. To collect research data observation, interview, documentation and literature study techniques are used. Furthermore, the data that has been obtained from the field are analyzed by comparison, then analyzed to draw generalizations or conclusions. This research concludes that up to now the Bayan community has always carried out traditional marriages with a marriage system called Mulang, which in the process began with the Mulang implementation, which at the peak of the event was carried out by the Customary Marriage tradition. This proves that until now the existence of customary law in the socio-cultural life of the community is still strong. The factors that support the existence of customary law in life are: 1) The concept of life of the Bayan community, 2) The existence of Bayan adat institutions in overseeing Bayan customary law, and 3) The strict sanctions of customary law that apply to Bayan villagers. Furthermore, in general fatktor that impedes it is the desire of local people to change their living systems and the lack of Bayan young people who respect the value of customs.

Abstract

Permasalahan yang diangkat dalam penelitian ini yaitu pertama, Bagaimana batasan kewenangan mengadili Pengadilan Umum dan Pengadilan Tata Usaha Negara (TUN) dalam sengketa Perbuatan Melawan Hukum berdasarkan kompetensinya menurut peraturan perundang-undangan dan Kedua, Bagaimana pengaturan kewenangan mengadili Pengadilan Negeri dan Pengadilan Tata Usaha Negara (TUN) dalam perkara perbuatan melawan hukum apabila melibatkan Badan Negara atau Pejebat Pemerintah. Menurut PERMA No. 2 Tahun 2019. Penelitian ini pada prinsifnya bertujuan untuk mengetahui batasan kewenangan mengadili antara Peradilan Umum dan Peradilan Tata Usaha Negara, karena dalam pelaksanaan hukum acara dipengadilan sering sekali terjadi titik singgung terhadap kewenangan mengadili antara kedua Lapangan Pengadilan tersebut. Hasil penelitian ini menunjukkan bahwa, pertama tentang kompetensi absolut antara Peradilan Umum dan peradilan Tata Usaha Negara (TUN) yang sebenarnya telah diatur dalam undang-undang, baik itu di dalam Undang Undang Kekuasaan Kehakiman, dan Undang-Undang tentang Mahakamah Agung, akan tetapi pengaturan tersebut masih bias karena tidak menyebutkan secara spesifik batasan-batasan kewenangan tersebut, sehingga menimbulkan titik singgung dalam penerapan. Untuk menghindari titik singgung tentang kewenangan mengadili antara kedua pengadilan, yaitu Pengadilan Negeri dan Pengadilan Tata Usaha Negara maka Mahkamah Agung sebagai pemegang kekuasaan kehakiman yang tertinggi mengaturnya dengan mengeluarkan PERMA yang bersifat Lex specialist untuk mengatur tentang itu, sehingga dikeluarkan Peraturan Mahkamah Agung (PERMA) Nomor 2 Tahun 2019 tentang Pedoman Penyelesaian sengketa Tindakan Pemerintah dan Kewenangan Mengadili Perbuatan Melanggar Hukum oleh Badan dan/atau Pejabat Pemerintahan (Onrechmatige Overheidsdaad).

Abstract

This study aims to determine how the application of a simpleclaim court in the settlement of default cases at Selong DistrictCourt, and to find out what aret the obstacles to a small claimcourt in settling default cases at Selong District Court. Thebenefits of this research are expected to provide input in thedevelopment of legal science,especially in the field of civil lawrelated of the settlement of simple lawsuits, especially theclassification of cases breach of contract. The method used inthis research is empirically legal research. The result showedthat the implementation of Perma Number 2 of 2015 andPerma umber 4 of 2019 concerning Procedures for solvingsimple lawsuits at Selong District Court was carried outeffectively with constraints that were more due to theweakness of the Perma itself internally

Abstract

This thesis aims to determine how the impact on theapplication of the e-court application on advocates in theprocess of solving cases in the Selong district court, as well asto fine out what are the obstacles to the application of the ecourt application. The benefits of this research are expected toprovide knowledge about e-court and the steps in –ecourtoperation with the principle of simple, fast and low cost.Theresearch method used is empirical normative legal researchmethods. The results of this study indicate that the stipulationof perma no.3 of 2018 jo perma no 1 of 2019 concerning theadministration of cases and trials in court electronically showsquite good results and can be applied by all lawyers.

Abstract

Research to determine the position of the Pancasila IdeologyDevelopment Agency in the state administration system of theRepublic of Indonesia. This agency was formed as a concrete effortby the government to carry out its function as state administrator inresponding to the developing political situation in society, related tothe emergence of several political currents and identity politics whichare closely related to the role of Pancasila as the state ideology.Previously the President had issued Presidential Decree Number 54 of2017 concerning UKP-PIP which was considered to make it difficultfor the agency to coordinate with ministries and state agencies,because the UKP-PIP's authority was still at the level of the Ministry'sDirector General. This research uses normative legal research withstatutory and conceptual approaches. The analysis technique used isqualitative analysis by collecting legal material and then editing it firstto be used as material for analysis that is qualitative in nature.

Abstract

This study aims to find out how the Supreme Court decidescases of unlawful acts with the principle of nebis in idem andthe basis for consideration of the Supreme Court justicesexamining and deciding Case Number 405 PK / Pdt / 2017,related to the principle of nebis in idem. This research is a typeof normative law, with a normative juridical approach, namelydoctrinal law research which refers to legal norms. emphasizessecondary sources of material, both regulations and legaltheories, and examines legal principles that are scientifictheoretical in nature and can be used to analyze the problemsdiscussed. The method of analysis of normative legal researchis in the form of a prescriptive method, namely a method ofanalysis that provides an assessment (justification) of theobject under study whether it is true or false, or what shouldbe according to law.
