Abstract

Abstract: The doctrine of Abu Hanifa has spread in the country since Abu Yusuf empowered him after assuming the position of judge of judges in the Abbasid state. It was the official doctrine of it, in addition to the philosophy of Malik in the Hijaz. The Hanafi school became the only official school of thought when Malik died. It spread in Iraq and its east from the countries of the Persians: Persia and Beyond the River (Turkistan), Afghanistan, and India. It was also the official doctrine of many Levantine countries, such as the Seljuk State, the Gharnawi State, and the Ottoman State. Then they began to push people to embrace its doctrine until it became the most prominent Islamic school of thought with followers among Muslims due to the length of the rule of the Ottoman Empire, which spanned about seven centuries. Instead, they even imposed the recitation of Hafs on the authority of Asim, instead of the recitations that are widespread in the Islamic world (especially the recitation of al-Dawri), just because Abu Hanifa used to recite it! The Turks spread their doctrine in eastern Europe, Iraq, and northern Syria, but they failed to impose it in areas far from their influence, such as the island and Africa.

Abstract

Referral divorce practices must be carried out in the Religious Courts. However, there are still many people who divorce and reconcile without involving the Religious Courts, as is often done by people in Pedamaran Village, Pedamaran District, Ogan Komering Ilir Regency, South Sumatra. Therefore, this research wants to know about the implementation of the divorce practice in Pedamaran Village which will be studied in terms of Islamic law and applicable legislation. The aim of the research is to find out how the study of Islamic law and legislation regarding the practice of divorce is referred to in Pedamaran Village. This type of research is field research, meaning that this research is carried out directly on the research object to obtain complete data. The data collection techniques in this study were carried out using observation, interview and documentation techniques. The approach method uses the comparative method. The results of the study show that the practice of referral divorce carried out by the Pedamaran village community is in accordance with Islamic law, so that the practice of referral divorce is legal. However, according to Law Number 16 of 2019, the practice of divorce and reconciliation in Pedamaran Village is illegal, because the divorce was not carried out at the Religious Court and reconciliation was not carried out in front of the marriage registrar. This shows that there are still many people who have not complied with the applicable laws and regulations, so it is necessary to hold socialization so that people are aware of the law.

Abstract

There are many things that must be fulfilled by members of the legislature, bearing in mind that the task of a representative of the people is not only to represent the people but he must be able to act wisely, fairly, and be able to carry out his duties according to the duties and functions of the members of the legislature itself. Therefore, this research will conduct a review of the requirements for candidates for legislative members in the General Election Commission Regulation (PKPU) No. 20 of 2018 and Aceh Qanun No. 3 of 2008. The purpose of this research is to examine the comparison between PKPU No. 20 of 2018 and Aceh Qanun No. 3 of 2008 in regulating the requirements for candidates for members of the legislature. The type of research used in this study is a type of normative legal research using library research. A comparative approach is used to examine the comparison between the two rules. The results of the study concluded that PKPU is a regulation that is comprehensive, binding, and must be obeyed by all Indonesian citizens regardless of their knowledge and abilities in the field of religion. Meanwhile, the Aceh Qanun is a type of regulation that is binding and must be obeyed by all the people of Aceh. The Aceh Qanun views that having extensive religious knowledge and ability is the most important requirement for anyone who will become a representative of the people.

Abstract

People who have limitations such as weakness of mind must be under guardianship in doing everything, including carrying out transactional activities. Because, without guardianship it is feared that it will have a bad impact on both himself and others. Therefore, researchers conducted research with the aim of examining the legality of buying and selling transactions carried out by people who have mental limitations. This research specifically examines the judge's decision on related cases. The study will focus on the views of scholars. This study uses a normative and comparative juridical approach with library research methods. The results of the study show that there are differences of opinion regarding the legality of transactions carried out by people with mental disabilities. There are those who think it is legal and there are also those who think it is illegal. People who have mental limitations must involve their guardians if they want to make buying and selling transactions, this is based on the concept of al-hajr. This is intended so that the transaction does not cause harm to both himself and others.

Abstract

This is research on the prohibition of Menstruating Women Staying in the Mosque according to Imam al-Shafi'i and Imam Ahmad bin Hanbal. In Indonesia, the presence of menstruating women in mosques is still considered prohibited, because the Indonesian Muslim community generally adheres to the Shafi'i school of thought. However, this opinion began to be sued because it was considered to discriminate against women because it prohibited them from being involved in activities at the mosque. On the other hand, there is the view of Imam Ahmad who does not question the presence of menstruating women in the mosque. This study aims to compare the opinions of the two Imams to find which one is more appropriate to the times and not discriminatory. This research is library research that relies on data sources from written data, both in the form of books and journal articles. This study uses a comparative qualitative approach. The results of the study show that according to Imam Ahmad, there is no strong argument that prohibits menstruating women from entering and staying at the mosque. The hadith which prohibits menstruating women from entering and staying in the mosque is a daif hadith because there are majhul narrators. Meanwhile, Imam al-Shafii took an attitude of ihtiyath by continuing to practice the hadiths above, so that only menstruating women were allowed to pass inside the mosque, without stopping and remaining silent.

Abstract

The obligation to care for children does not end even if the parents are divorced. However, there is often a struggle over child custody, even having to involve a court to resolve it. One of them was the hadhanah case at PTA Palembang with decision Number: 005/Pdt.G/2018/PTA.plg. which will be the focus of this study. The purpose of this study is to examine the judge's decision in terms of Law Number 17 of 2016 and Islamic Law, so that a comparison between the two can be known. This research is a normative juridical research. The approach method is comparative. The data analysis technique that the writer uses is a qualitative descriptive analysis technique. In decision Number: 005/Pdt.G/2018/PTA.plg. Child custody is handed over to anyone because the lawsuit contains a formal defect so that the lawsuit cannot be accepted. According to Islamic law, hadhanah rights as stated in decision Number: 005/Pdt.G/2018/PTA.plg. handed over to the mother, but Law Number 17 of 2016 does not question this. This law stipulates that children must be cared for by their own parents, unless there are other justified reasons.

Abstract

Salah satu bagian dari pertukaran atau ekonomi adalah kolaborasi pembagian keuntungan. Dalam kenyataan kehidupan individu, banyak individu yang beragama Islam mengadakan partisipasi bagi hasil dalam berbagai bidang ekonomi dan pertukaran sebagai pekerjaan atau bisnis mereka, kenyataan ini dapat dilihat dalam budidaya padi. Untuk melakukan bisnis ladang pedesaan, ada banyak partisipasi antara pemilik ladang dan individu yang memiliki apa yang diperlukan dan kesiapan untuk mengolah. Karena terkadang pemilik tanah tidak dapat menggerogoti tanah miliknya sendiri, bertentangan dengan norma ada buruh yang memiliki kemampuan bercocok tanam namun tidak memiliki tanah tersebut. Isu yang diangkat dalam perbincangan ini adalah bagaimana cara melakukan bagi hasil sawah di Kota Cahaya Maju, Kelurahan Lemrub, Aturan Ogan Komering Ilir. Bagaimana survei regulasi Islam dan aturan baku tentang pelaksanaan pengambilan manfaat sawah di Kota Cahaya Maju, Kecamatan Lemrub, Rezim Ogan Komering Ilir. Dari hasil percakapan tersebut, diduga pelaksanaan pengambilan manfaat di kota Cahaya Maju Kecamatan Lemembu Peraturan Ogan Komering Ilir merupakan kesepahaman yang dilakukan secara lisan (tidak tersusun) dan pembagian manfaat dilakukan dengan pemahaman terhadap dua orang pemain/maro (secara adil) tanpa mempengaruhi orang ketiga, sedangkan eksekusi dilakukan setelah menuai dan jika terjadi kemalangan, kemalangan itu akan ditanggung oleh pemilik tanah dan penggarap. Tindakan pembagian hasil sawah di kota Cahaya Maju, Kecamatan Lemembu, Kabupaten Ogan Komering Ilir, sudah sesuai dengan aturan Islam (by contract) namun ada kelemahan yang tidak melibatkan pengamat dalam pemahaman, dan dalam Dilihat dari peraturan baku penataan di kota Cahaya Maju dilengkapi dengan kecenderungan yang sudah ada sejak lama.
