Abstract

The agreement made by the housing developer as stated in the Sale and Purchase Binding Agreement (SPBA) is first made before entering into other agreements in the house buying and selling process. In the implementation of SPBA between housing developers and consumers, there may be default acts committed by one party, resulting in losses incurred to the other party. Defaults in the implementation of housing SPBA in installments between housing developers and consumers can also occur. The type of research used in this study is normative juridical research. The nature of this research is descriptive analytical. The data used is secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The result of the discussion in this study is that the obligation of the buyer has been fulfilled in its entirety by paying the price of land and house buildings in full amounting to Rp 210,000,000 (two hundred and ten million rupiah). The relationship between the legal responsibilities of the housing developer PT Indojaya Pan Pratama in the case of refusal to make AJB is due to the stages of payment for land and house buildings that have not been accepted by the company as a seller. Legal protection for buyers/consumers for default is in accordance with the provisions of Articles 1365 and 1367 of the Civil Code regarding claims for compensation for default/unlawful actions from the seller who refuses to make AJB for the legal rights and interests of the buyer/consumer due to embezzlement committed by marketing employees of the selling company which is the responsibility of the selling company.

Abstract

Patents are exclusive rights granted by the state to inventors for their inventions in the field of technology, for a certain period of time. A simple patent is an exclusive right granted by the Patent Directorate Office to a patent holder to realize a new invention, either in the form of a product or a certain process. If a simple patent does not contain an element of novelty or does not contain an element of progress, a simple patent may be rejected for registration at the Directorate. The type of research used in this research is normative legal research. The nature of this research is descriptive analytical where this research seeks to describe, describe and analyze the problems that arise, then look for the correct answer as a solution to the problem. The results of the discussion of the problems that arise in this research, the rights to simple patents contain elements of novelty or are the development of a technology from simple patent products from existing simple patent products. Abstract

Notaris, selaku pejabat umum dalam setiap pelaksanaan tugasnya tidak boleh keluar dari rambu-rambu yang telah diatur oleh perangkat hukum yang berlaku. Notaris dituntut untuk senantiasa menjalankan tugas dan jabatannya, sesuai dengan kaidah hukum yang berlaku. Notaris wajib menjunjung tinggi martabat jabatannya, baik saat menjalankan tugas jabatannya maupun di luar tugas jabatannya, hal ini berarti bahwa notaris harus selalu menjaga agar perilakunya tidak merendahkan jabatannya, martabatnya, dan kewibawaannya sebagai notaris. Untuk itu dibentuklah Majelis Kehormatan Notaris untuk melakukan pemeriksaan dan pembinaan terhadap notaris. Keberadaan Majelis Kehormatan Notaris sebagai institusi yang akan memutuskan apakah notaris melanggar kode etik atau tidak serta memberikan sanksi hukum. Majelis Kehormatan Notaris merupakan lembaga baru yang sebelumnya tidak diatur dalam Undang-Undang Republik Indonesia Nomor 30 Tahun 2004 tentang Jabatan Notaris, sehingga termasuk hal yang diubah itu sebagaimana Penjelasan Umum angka 6 UU No. 2 Tahun 2014 tentang Jabatan Notaris bahwa beberapa ketentuan yang diubah dari UU No. 30 Tahun 2004 tentang Jabatan Notaris antara lain pembentukan Majelis Kehormatan Notaris. Anehnya pembentukan Majelis Kehormatan Notaris tersebut tidak disertai dengan definisi Majelis Kehormatan Notaris. Berdasarkan kondisi tersebut, maka selayaknya penjatuhan sanksi kode etik oleh Majelis Kehormatan terhadap notaris, harusnya disikapi sebagai suatu pembelajaran untuk mempertanggungjawabkan setiap aktivitas notaris yang tidak terlepas dari ruang lingkup hukum yang berlaku. Sanksi hukum yang dijatuhkan kepada notaris, harusnya menyadarkan notaris untuk lebih memiliki etika dan moral saat menjalankan profesinya di tengah-tengah masyarakat. Abstract

Undue influence is a factor that limits or interferes with the existence of free will to determine the agreement between the two parties who make the agreement. Therefore, when the situation occurs, there is a defect of will experienced by a person. Abuse of state can occur in three criteria such as state of economic advantage, psychological advantage and emergency advantage. This study has three problems, namely: how undue influence can be carried out in the case between Agus Susanto (Plaintiff I) et al against Lisa Juliana Tanjung (Defendant I) et al based on the consideration of the Supreme Court Decision Number 59 K/Pd/2017, how is the position of a notary as parties who do not support the Sale and Purchase Binding in the case between Agus Susanto (Plaintiff I) et al against Lisa Juliana Tanjung (Defendant I) et al based on the consideration of the Supreme Court Decision Number 1359 K/Pdt/2017, what are the legal consequences for the cancellation of the sale and purchase agreement in in the case between Agus Susanto (Plaintiff I) et al against Lisa Juliana Tanjung (Defendant I) et al based on the consideration of the Supreme Court's Decision Number 1359 K/Pdt/2017. This normative juridical research uses a statute approach and a case approach. Sources of data used in this study is secondary data collected by library research techniques. Undue influence became the basis for filing a sale and purchase agreement between Agus Susanto (Plaintiff I) et al. against Lisa Juliana Tanjung (Defendant I) et al. The cancellation of the agreement was initiated based on the Decision of the DKI Jakarta High Court Number 143/Pdt/2016/PT.DKI, then confirmed by the Supreme Court Decision Number 1359 K/Pdt/2017. The position of the notary as a party who does not support the Plaintiff of Sale and Purchase between Agus Susanto (Plaintiff I) et al with Lisa Juliana Tanjung (Defendant I) should not place the Notary Defendants such as Notary Marina Soewana (Defendant II). Several agreement deeds issued by Defendant II have actually been canceled by Agus Susanto (Plaintiff I) et al with Lisa Lusiana Tanjung (Defendant I) as the party who promised in the deed of agreement, thus there is no lawsuit if Plaintiff I et al withdraw Defendant II in their lawsuit only sue for canceled promises. The legal consequences of the cancellation of the sale and purchase agreement in the case between Agus Susanto (Plaintiff I) et al against Lisa Juliana Tanjung (Defendant I) et al are no longer legally binding. Therefore, the sale and purchase is considered to have never existed and a plot of land and building on the right of Building Use Rights Certificate Number 621/Petukangan Utara belongs to Agus Susanto (Plaintiff I) et al. Abstract

The Camat, in addition to having attributive authority because of his position as the head of the sub-district, also has delegative authority. Delegation of authority in land services to district/city and sub-district and kelurahan regional governments is the district/city regional apparatus closest to the community, so the role of sub-districts in land services will increase. This type of research is normative legal research. The nature of this research is descriptive analytical. Data collection techniques in this study were carried out using library research methods. The results of the discussion in this study are the sub-district head in carrying out his duties gets the delegation of authority from and is responsible to the regent/mayor. Delegation of part of the authority of the Regent/Mayor to the Camat The delegation of government affairs from the Regent/Mayor to the Camat in the field of land affairs in the form of the authority of the regency/city government in the land sector. The Letter of Release of Rights with Compensation is written evidence recognized by the government (land office) as the basis for the right to submit an application for registration of land rights at the land office and also as evidence of a legal letter/written on physical control of land by one party. Abstract

CV is a form of partnership business entity established based on the KUHD by one or several people who entrust money or goods to one or several people who run the company and act as leaders. The implementation of the establishment of a new CV and the implementation of registration of CV names that have been established for a long time before the issuance of Permenkumham No. The results of the discussion of the problems that arise in this study are the application for registration through the minister who carries out legal affairs, information storage regarding CVs, Firms, and Civil Partnerships in Indonesia, especially in the city of Medan, is more sophisticated because it is electronically so that the government in the future is easier to access. Notaries at this time must be able to use electronic media because according to the Regulation of the Minister of Human Rights No. 17 of 2018 concerning Registration of CV, Firms, and Civil Partnerships, there are no exceptions for non-electronic registration because Notaries must be able to carry out their duties electronically.

Abstract

PKPU Applications submitted by 11 PKPU Applicants who are Creditors of PT. Sumatra Beton Mandiri as PKPU Respondent based on the Medan Industrial Relations Court (PHI) Decision at the Medan District Court with Case Register No. 76/Pdt.Sus-PHI/2015 dated August 28, 2015. Whereas based on the Decision of the Industrial Relations Court, the Respondent PKPU has filed an cassation with the case of Reg. No. 450 K/ Rev. Sus-PHI/2015, which in its decision rejected the appeal from the Cassation Petitioner PT. Sumatra Concrete Independent. The type of research used in this research is normative juridical research. The nature of this research is descriptive analytical. The data used is secondary data which can consist of primary legal materials, secondary legal materials, and tertiary legal materials. The results of the discussion in this study are the Industrial Relations Court's decision can be used as the basis for a PKPU application referring to the conditions described above as stipulated in Article 2 paragraph 1 in conjunction with Article 8 paragraph 4 in conjunction with Article 222 paragraphs 1, 2 and 3 of the UUKPKPU as long as the PKPU application is submitted by 2 creditors, one of which is past due and can be billed. In the explanation of Article 2 paragraph 1 UUKPKPU that what is meant by debt that has matured and can be collected is the obligation to pay debts that have matured, either because it has been agreed upon, because of the acceleration of the collection time as agreed, due to the imposition of sanctions or fines by the competent agency. , or because of the decision of the court, arbitrator, or arbitral tribunal. The Judge's Decision on the PKPU Application with register No.20/Pdt.Sus-PKPU/2019/PN Niaga Mdn is in accordance with the principle of justice and based on applicable legal provisions so that both creditors and debtors are obliged to carry out the decision in good faith.

Abstract

Hukum waris sangat erat kaitannya dengan kehidupan manusia, karena setiap manusia pasti akan mengalami peristiwa hukum yang disebut dengan kematian (meninggal dunia). Sengketa hukum waris salah satunya yang timbul di kemudian hari salah satunya dalam hal kesepakatan waris dalam hal terjadi bencana alam. Hal ini disebabkan karena antara sesama ahli waris yang selamat dari bencana tersebut tidak memiliki lagi surat kesepakatan waris ataupun dokumen asli yang berkenaan tentang surat kesepakatan pembagian waris yang hilang akibat tsunami. Permasalahan dalam penelitian ini adalah: Bagaimana kedudukan kesepakatan pembagian warisan di dalam Hukum Perdata dan Hukum Islam, bagaimana akibat hukum hilangnya bukti kesepakatan terhadap pelaksanaan isi dari kesepakatan pembagian warisan, bagaimana pertimbangan hukum hakim terhadap bukti kesepakatan waris yang hilang dalam putusan nomor 127 K/ AG/ 2012. Penelitian ini bersifat deskriptif analitis dengan pendekatan yuridis normatif. Metode analisis kualitatif digunakan untuk mengolah dan menganalisa data hasil penelitian dan selanjutnya ditarik kesimpulan dengan menggunakan metode deduktif melalui kerangka normatif. Hasil penelitian menunjukkan: Kedudukan kesepakatan pembagian warisan hukum Islam ditentukan bahwa pembagian waris menurut hukum Islam harus mengikuti aturan hukum Nas yang berlaku, sedangkan didalam hukum Perdata porsi perjanjian waris tidak boleh bertentangan dengan undang-undang. Akibat hukum hilangnya bukti kesepakatan terhadap pelaksanaan isi dari kesepakatan pembagian warisan adalah tidak dapat dilaksanakannya isi dari kesepakatan perjanjian waris tanpa adanya kesepakatan dari para pihak mengenai porsi bagian waris masing-masing para pihak.Pertimbangan hukum hakim dalam putusan nomor 140/Pdt.G/2009/MSy-BNA sudah sesuai dengan hukum acara (khususnya perdata dibidang waris) yang berlaku. Bahwa gugatan yang dibuat oleh para Penggugat dinyatakan tidak dapat diterima (Niet Ontvankelij Verklaard), isi dari posita gugatan mengandung unsur cacat formil, yang diakibatkan syarat formilnya tidak terpenuhi. Sehingga yang menyangkut dengan pokok-pokok perkara tidak perlu dipetimbangkan lagi dan harus dikesampingkan sebagai dasar pertimbangan. Abstract

Building Use Rights on State Land and Management Rights Lands are granted for a maximum period of 30 years, and for the right holder, taking into account the needs and conditions of the buildings, this period can be extended for a maximum period of 20 years and renew.for a maximum period of 30 years. The right of building management on land rights can be extended or renew to the holder of the right to use the building if it meets the requirements and gets approval from the owner of the right of management. Abstract

Pesatnya perkembangan perusahaan pialang berjangka di Indonesia, transaksi dapat dialihkan dari transaksi yang awalnya secara langsung dilakukan oleh investor/nasabah di bursa berjangka kemudian dapat dilakukan di setiap perusahaan pialang secara online. Trading Online telah dikenal dan makin diterima di Indonesia, seiringnya dengan perkembangan masyarakat dan teknologi membuat banyak orang menjalankan bisnis online termasuk didalamnya berbisnis online di Perusahaan Pialang Berjangka Komoditi. Berdasarkan latar belakang penelitian tersebut akan dianalisa mengenai pelaksanaan perjanjian kerjasama investasi antara investor dengan perusahaan pialang berjangka, perlindungan hukum terhadap nasabah/investor perusahaan pialang berjangka dalam transaksi trading online, dan penyelesaian sengketa dalam perjanjian kerjasama investasi antara investor dengan perusahaan berjangka. Penelitian ini dilakukan dengan menggunakan metode penelitian hukum normatif. Data penelitian menggunakan data sekunder dan didukung oleh data primer. Data dikumpulkan dengan menggunakan studi pustaka dan wawancara. Analisis data dilakukan dengan metode analisis kualitatif. Pelaksanaan perjanjian kerjasama investasi antara investor dengan perusahaan Pialang Berjangka yaitu untuk melakukan transaksi di bursa berjangka nasabah diwakilkan oleh pialang berjangka atau wakil pialang berjangka. Berdasarkan amanat yang diberikan nasabah maka Pialang Berjangka akan memasukkan amanat tersebut dalam bentuk transaksi atas kontrak berjangka sesuai dengan kesepakatan dalam perjanjian kerjasama investasi yang sudah ada bentuk perjanjian baku yang diatur oleh BAPPEBTI. Perlindungan hukum terhadap investor pada PT. Best Profit Futures Cab. Medan telah diatur Undang-Undang Nomor 10 tahun 2011 tentang Perubahan Atas UndangUndang Nomor 32 Tahun 1997 Tentang Perdagangan Berjangka Komoditi tidak membatasi bahwa perlindungan hukum hanya dapat dilakukan dalam satu jalur saja, yakni antara jalur administrasi, pidana, atau perdata. Sistem penyelesaian sengketa terhadap investor yang mempunyai permasalahan dengan PT. Bestprofit Future Cab. Medan terkait perjanjian kerjasama investasi antara investor dapat dilakukan melalui penyelesaian secara non litigasi terlebih dahulu yang mencakup penyelesaian internal perusahaan pialang berjangka, dengan cara melakukan musyawarah mufakat.
