Abstract

This study tries to elaborate critically the globalized Salafi and its transnational movement with specific cases in Islamic Center Bin Baz (ICBB) of Yogyakarta. It focuses on how the institute modernized their education and propagation (dakwa) movements within global contexts. Its roles in globalized Salafi and persisted core values are inherent in the middle of globalization impacts. The research method applied in this study is cultural studies and field studies with data collection techniques of triangularily taken from documentation, interview and observasion. ICBB Yogyakarta, to some extend, applied modern information and communication technology to introduce and draw attention to transnational Islam. From inception, transnational linkage between ICBB and the Middle Eastern education, especially Makkah and Madinah ulamas and universities, had been linked since the establishment of the institute. Some ICBB’s students are come from surrounding villagers but the others from foreign countries such as Thailand, Singapore and Malaysia. On the other hand, Islamic traditional cultures, values and tenets are also manifested in daily life of whole pesantren communities in spite of modernization and globalization influences. Identities, like the way of live, clothes, foods and beverages, and ethical behaviors of these Salafi movements could easily be typically recognized, whereas that performance indicated the persistence of its values towards globalization and modernization. ICBB Yogyakarta represents adaptive position towards global changes and not anti-Government stands or involves directly in practical politics. This study intentionally elaborates the origins and pattern of globalized salafi at ICBB.

Abstract

Taking the focus of Salafism study in Indonesia, the article is intended to analyze the important shifts of the Salafi ideology in responding to regional and international political situations, particularly in relation to state policy which has resulted in a wide range of theological implications and pragmatism of the Salafi doctrine., The article also aims to place correctly about the existence of Salafi factions in Indonesia. Implementation of a non-monolithic Salafist ideology in Saudi Arabia has created a polemic and conflict that brought influence and resonated rapidly to the emergence of new forms of Salafism in Indonesia that not only used their approach to religion but also state ideology. Interestingly, fragmented Salafism in Indonesia into some of these factions initially began only from the doctrinal problems to spread into personal and even financial problems.

Abstract

Based on the pattern of relational dialectics, the relationship between Religion, Humanism and the Orientation of Nation should be understood as a single entity wich mutually reinforcing in achieving the ideal life of civil society. Indonesia as a country that recognizes the diversity of religion, language, ethnicity and culture has positioned the Pancasila as ideology of the state can not be contested legitimacy. NU as an social religious organization be aware of the Indonesian nation must be guarded sovereignty also dignity. Islam Nusantara as a religious idea of nationality strives to instill religion awareness in the state and nation. Its one important task is to unravel the roots of the conflict through awareness of ethics; ranging from Tyranny of the Majority issue to Human Rights issues in the application of the death penalty in Indonesian context. Therefore, this article head to examine the transformative process of religious values into a form of consciousness nationality oriented towards the sovereign and the dignity state.

Abstract

Local elections in Indonesia has always been a public concern. Various cases and long problem continues to occur in the local election process. So it makes the people of Indonesia moved to resolve the problems that exist. Likewise with the Nahdlatul Ulama. NU in Bahtsul Masail noted two problems; (1) not yet the change in voter behavior that impact on the flourishing practice of money politics and transactional politics. (2) Current local elections show the configuration of the political candidates varies greatly from one area to another area prone to conflict and dispute over the number of local elections. In this case the NU forward two plans: (1) Formed a special team tasked with monitoring the implementation of the elections and maintain institutional neutrality of the Nahdlatul Ulama in the implementation of election. (2) PBNU together with other components of society, particularly religious organizations, to continue to carry out propaganda aimed at providing political education in order to exercise the right to choose rightly, responsible and intelligent, so they can elect regional head candidate who has the capacity and integrity of the good.

Abstract

This paper distributed by many religious conflictsthat has happened in Indonesia. So,to prevent and resolve the issue, the Government has established regulations and legislation about  religious believiers protection even since the beginning of the founding the nation. However, the reality show us that religous conflict is still not over. Thus, author aim to describe and analyze NU criticism to  religious believiers protection laws in Indonesia as well as how the solution offered especially on Bahtsul Masail Muktamar NU 33th at 2015. On NU persfective, there are some things abaut religious believiers protection laws: (1) regulations and legislation about  religious believiers protection are scattering on many legistlation or regulation on under the act, so it does not focus talking about religious believiers protection only. (2) many legislation and regulation is not enough to be a foundation of nation to execute every religious conflict. (3) LITBANG reseach has proven there are seven factor that cause religious conflict. (4) some of regulations under the legislation judged is not have a strong position, because it is not included in hierarchy of legislation. Therefore, all these problems, on NU perspective proves that more existence of operacional and aplicable legislation are absolutely needed.

Abstract

The Islamic state idealized by Hizb ut-Tahrir has a system of government that is different from the existing system of government in the world today. The Islamic state has a different concept of power-sharing which is known in the growing doctrine of constitutional law. The concept of power sharing is similar to the concept of a state led by a king, since the caliph as head of state and head of government is given a very wide authority even including both judicial and legislative powers. This vast authority was given to the Caliph as an implementation of sovereignty in the hands of the Ummah who was then used to elect a caliph, so that the authority of the state derived from the Ummah was called by a caliph. The author analyzes the concept of the division of powers of Islamic countries according to Hizb ut-Tahrir to be applied in Indonesia which is a country with a majority of its population is Muslim. This analysis is based on the development of Indonesian constitutional phases since the founding of this country until today in order to find the possibility of conception to implementation of power sharing Khilafah Hizb ut-Tahrir Islamic state in Indonesia. This study suggests to Hizb ut-Tahrir for reconstruction and ijtihad new as "qoul al-jadid" to the concept of power-sharing formulated within the Islamic state Khilafah Hizb to be implemented in Indonesia and can help overcome the problems of the people associated with the concept of the Indonesian state administration, especially in the field of The division of state power.

Abstract

Each country has a political system in his country respectively. The political system is adopted that will affect the wheels of government in the country. The political system is always changing according to the situation of economic, community, social style and other external factors that can affect the country. In Indonesia alone, the system of government has undergone three changes. early period called the era of the old order, after President Sukarno to resign from office and replaced by President Sueharto bergantilah Become the New Order era, and setealh 1998 with called reform era. Government Regulation No. 10 of 1983 and No. 45 of 1990 which created the new order have been qualified fiqh siyasyah Yang expressed by Abd Rahman Taj. Government Regulation No. 10 of 1983 and No. 45 of 1990 also contains values that refer to maslahah maslahah expressed by Imam Malik. In another sense that Inside Government Regulation No. 10 of 1983 and No. 45 of 1990 There is a concept that has a goal of fiqh siyasyah maslahah for Civil Servants (PNS) in particular and to society in general.

Abstract

With the enactment of Law No. 1 of 1974 on Marriage, the authors noticed that the policy in question is to accommodate the aspirations of the majority Muslims who happen to choose schools of Shafi'i schools and realized in the form of legislation. The hope of course that the values of Islam, which had long color the way of arbitrate Indonesian people, then can have the firmness and recognition from the state. Thus the struggle of Muslims, which in certain portions require the enactment of Islamic law, at least one by one can be realized even with regard to the context Indonesian nation known multi-religious, ethnic and cultural. This is consistent with the theory put forward by the imam, al-Maliki al-mursalah mashlahah which can be translated "public interest". Al-maslahah occupy a very important position in determining the details of the general principles of the constitution in Islam. Through this principle all aspects of society that have not been regulated in the Quran and Sunnah Rasul can be arranged by the man, or the principles of a general nature contained in the Qur'an can be broken down further in order to determine a lot of applications in the life of society and the state extent not inconsistent with the spirit of Islamic law (sharia).

Abstract

The competence of the Religious Courts has undergone considerable dynamics and leads to the ups and downs. Although not until abolished, but the scope of jurisdiction of religious courts is often limited to certain civil cases. This fact is in fact inseparable from the political will of the rulers of their time reflected in the policies pursued by the authorities concerned. It is undeniable that the political dynamics of law and the political will of the rulers from time to time have drawn important notes for the existence, position, and authority of religious courts in Indonesia, which in reality are not always on a relatively smooth journey.

Abstract

Sharia built upon the principle of obtaining benefit for humans and avoiding damage (mafāsid) both now and in the future. Allah will not make anything except for mashālih (human mashālih). One aspect regulated in the Shari'a is the Islamic family law (al-ahwāl al-syakhshiyyah) which is also for the orderliness of human life. Meanwhile, the greatness of the Islamic Shari'ah is due to its primary position in regulating human life. This is because the source comes from the holy Qur'an and as-Sunnah. The Shari'ah is fully and thoroughly listed in these two sources. The rest, the shari'a is in accordance with the nature of human beings and is the greatest Shari'a from the others.   Hukum-hukum Islam terbangun di atas prinsip mendapatkan kemashlahatan bagi manusia dan menghindari kerusakan (mafāsid) baik saat ini maupun yang akan datang. Artinya, Allah tidak akan mensyariatkan sesuatu kecuali untuk kemashlatan (mashālih) manusia. Salah satu aspek yang diatur dalam syariat adalah menyangkut hukum keluarga Islam (al-ahwāl al-syakhshiyyah) yang hal tersebut juga untuk tertibnya kehidupan manusia. Sementara itu, keagungan syariat Islam adalah karena posisinya yang utama dalam mengatur kehidupan manusia. Hal ini karena sumbernya berasal dari al-Quran dan as-Sunnah yang suci. Syariat Allah tercantum secara lengkap dan menyeluruh dalam dua sumber tersebut. Selebihnya, syariat dimaksud sesuai dengan fitrah manusia dan merupakan syariat yang paling agung dari yang lain.
