Philosophy of Science significantly contributes to the development of Economics toward the improvement of economical science and analyses as well as the improvement of quality of Economists, having capability of thought, of behaving and of acting as wise scholars. The roles of Philosophy of science in developing Economics have been: as a tool of evaluation of scientific thinking; as an instrument to reflect, evaluate, criticize assumptions and scientific methods; and as a tool of basic logic for scientific methods. Abstract

The Doha Declaration was developed after protests from developing and least developed countries asserting the TRIPS safeguards were unclear and ambiguous. Developing countries and least developed countries sought an interpretive tool for the TRIPS safeguards which fulfills the requirements of international law, in particular the Vienna Convention on the Law of Treaties and the legislative process of negotiation under the WTO decision making framework. Through the Doha Declaration, developing and least developed countries achieved their goal to clarify the TRIPS safeguards. The different level of economy, technology and interests among the members of the WTO will color the ongoing debate about the benefits of pharmaceutical patent protection under the WTO and effect upon access to essential medicines. The debate will reflect those favoring pro status quo for the TRIPS Agreement and the large number of countries which rely on the existence of the Doha Declaration. Abstract

Court decisions releasing the accused both in the cases of corruption and those of illegal logging could be influenced by juridical factor, for example the regulation on the criteria for decisions releasing the accused. This regulation would be a guide for judges. Besides, court decisions releasing the accused could also be influenced by non-juridical factor, such as return fee payment. The implication of such decisions on human rights is that the conducts of corruption and illegal logging tend to decrease and destruct the economic life, safety, peace, and welfare of people. The ideal judge decisions should be combination of normative, philosophical, and sociological considerations. Abstract

To describe the struggle of moslem community regarding Islamic Shariah enformcement in Indonesia legal-formally in parliament. This should be started from describing the forming of the constitution of the state philosophically and the theory of the changing of the constitution. These needs to be done because of at New Order regime era has ever sacralized the consti- tution 1945 , and the changing of the Constitution 1945 is equal to the end of the state. In this context, because of the difficulty to amend article 29 of the Constitution 1945 about religion, it implies to modify the law, for instance the implementation of Shari’ah based on the Constitu- tion 1945. In other word, to interpret article 29 of the Constitution 1945 by paying attention to the historisity of articles when they are constructed. Based on this way, shariah implementation in Indonesia could be done without amending article 29 of the Constitution 1945. Kaywords: Amendments, Politic, Shari’ah Enforcement

Abstract

This paper aims to measure performance measurement of Islamic University of Indonesia by balanced scorecard approach. The balanced scorecard, a performance and strategic management system, has been adopted in for-profit organizations with success and its application in the public sector is explored in this study. Accordingly, the paper uses a survey to measure and analyse a stakeholders’s perception about UII’s performance. Respondent of this study are student, employee, and lecturer of this university. The questionares are proposed with four perspective of balanced scorecard approach.The findings of the study indicate how, in different ways, stakeholders are fully satisfy with performance served by UII. Respondent students, in general, have confidence in the quality of the UII’s performance. Respondent employees and lectures are satisfy in perspective of operating efficiency, inno- vation and change, and employee performance. In the last of this paper, we design model balanced scorecard for UII based on result of survey. Kaywords: Balanced Scorecard, Performance Measurement, Stake- holders.

Abstract

In the discourses of contemporary social and humanitarian sciences, Jurgen Habermas cannot be ignored. His works have been influential not only in social sciences and philosophy, but also in other sciences, including theology. In this context, theology of every religion may be completed based on The Habermas paradigm, namely the theory of Communicative Action. This effort should be done as a dialog between theology and the development of contemporary sciences, so that theological statements can be expressed communicatively to the present peoples. Through the assistance of critical theories, religious institution together with theological apparatus should not be alienated from the experience of modern people. Abstract

In the perspective of legal culture corruption denotes a behavior that contradicts to values and norms either those of honesty, social, religion or the law. But, the emerging of the corruption itself is influenced by individual and collective need and demand, and also iit is supported by social culture environment that inherited the corruption tradition. Besides, legal culture of the government dose not justify law and pays priority over social status, economy, and that of politics of corruptor. The internal legal cultutre of law enforcement itself does not support to solve the corruption that shows the corruption in the process of court. Departing from this phenomenon it is clearly that corruption is regarded as society culture that difficult to solve, instead the corruption can be proved legally but it can be regarded as other meaning for instance commission, kompensation, reward, insentive, return fee and so on. Abstract

This paper focusses on fiscal policy practice in local government. This research attempts to analyze the impact of government spending for education, health and infrastructure to regional gross domestic product in Kabupaten Majalengka for the period of 1988-2004. We used simple linear regression to test the relationship between independent variabels and dependent variable. In this research, we try to adopt the Skiner (1987). The result of analysis shows that all independent variables, namely government sepnding for educa- tion, health and infrastructure, are statistically significant influence the dependent vari- able. The implications of this finding is that the level of income is strongly depend on local government activities. Kaywords: Fiscal, Government, Policy, Spending

Abstract

This article shortly discusses ‘ushul al-fiqh’ theories developed by prominent scholars, especially those related to two concepts: conventional and contemporary. These appear in relation to contem- porary Islamic Family Law reform in the form of codification. In determining legal status of a prob- lem, in some cases, only one of the concepts is usually used. However, in many cases, combina- tion of two or more concepts is used. In case of polygamy, for example, both concepts require fairness and capable for men to be allowed polygamy. Yet, to guarantee such fairness, contempo- rary concept requires more concrete criteria, such as fairness in distribution of properties. Abstract

In the last few years, numbers of university student candidates have been decreasing significantly at most universities in Yogyakarta. This may indicate that performance and competitiveness of these universities have also been decreasing. Such a condition should be responded by university managements, especially head of departments. In order to revitalize their performance and competitiveness, an evaluation should be done, regarding especially two aspects: their customers and virtual capitals. The previous relates to inter- nal, intermediate, and external customers, whilst the latter refer to intellectual, credibility, and social capitals.
