MILRev Is a scientific law journal with a focus on studies in the field of Islamic law, starting from fiqh, fatwa, or qanun (laws, shariah regional regulations, compilations of Islamic laws). The aim is to develop knowledge in the field of Islamic law, in order to be able to respond to the needs of the wider community for scientific and contemporary Islamic law studies. This journal is intended for academics, researchers, and practitioners, who conduct research on Islamic law, both normative (library) and empirical (socio-legal) research. Di Negara kita Indonesia memiliki nilai sosial budaya yang sangat tinggi dimana budaya budaya yang terdapat didalam Negara Indonesia sangatlah beraneka ragam. Abstract

The digital era or commonly known as 4.0 where everything is strived to shift to digitalization. One of the impacts of digitalization is in the fieldof muamalah (buying and selling transactions). Especially at this time in Indonesia experiencing a corona virus outbreak (Covid-19), where the government provides rules of life to the community so that activities are carried out at home as an effort to protect themselves. This activity will provide a surge in buying and selling transactions online, be it through Shoope, Tokopedia, Lazada, and others. Legal efforts are needed to identify whether the transaction is in accordance with the law in muamalah, namely fiqh muamalah? The method used in this research is legal research methods with qualitative analysis, the approach uses normative data. The result of the research is that online transactions are in accordance with muamalah fiqh, the use of the contract is the salam contract. This is because the community orders by giving the characteristics of the object of the item to be purchased, while the seller provides a description of the item itself in detail.

Abstract

The concept of a system of government of Democracy and Shura is often debated. Opinions related to the Islamic system of government are interconnected with the democratic system arises because in Islamic government, there is a concept of shura which is considered the same as the concept of democracy. Shura is a constitutional principle in Islamic nomocracy because, at the time of the Prophet SAW, the application pattern varied, then in the development of Islamic government. At the same time, democracy can be interpreted as a government managed by the people in a society. The people are important as the source of sovereignty and power. In this study, researchers describe the similarities and differences between democratic and shura government systems. In this study, the author used library research data collection techniques. Based on the research that has been done, it can be concluded that the difference between democratic and shura government systems is the source of democracy. The voice of the people is the legitimacy of the voice of God. Whereas in Shura, God's voice must be the people's voice. The similarity of the concept of shura with the idea of democracy is that they both recognize and respect the right of each individual to express an opinion. Conversely, both have the principles of equality, freedom, and justice in deliberation. Keywords: shura, democracy, government, system.

Abstract

Marriage is a worship and complement of religion, marriage is also one of the scopes of discussions on Family Law. Marriage is the sunnah of the Prophet SAW. Marriage is a human right given by Allah SWT. To create a family that is sakinah mawadah, warohmah besides that the purpose of marriage is to continue the offspring, and to carry out its biological integrity. In the Department of Family Law, marriage is discussed in detail in order to create a marriage according to the Shari'a of Allah SWT. This article is entitled The Need for Rights and Obligations of Husband and Wife in the Family. This paper aims to find out what are the rights and obligations of a husband and wife in a household. In writing it uses research methods by collecting data from journals related to this discussion.

Abstract

Wacana pemikiran berangkat dari realitas para penegak hukum (khususnya hakim) yang mengabaikan nilai-nilai moralitas. Meskipun para pelaku profesional (hakim) sudah memilki kode etik profesi sebagai standar moral, ternyata belum memberikan dampak yang positif terutama belum bisa merubah image negatif masyarakat terhadap wajah. Salah satu jalan untuk menegakkan supremasi hukum adalah dengan cara menegakkan etika, profesionalisme, dan disiplin. Kode etik profesi hakim pada prinsipnya mengandung nilai-nilai moral yang mendasari kepribadian secara profesional, yaitu kebebasan, keadilan dan kejujuran.

Abstract

Child marriage is a social phenomenon that is common in all places. This kind of marriage is like an iceberg phenomenon that appears a little on the surface, is rarely disclosed, but is commonly practiced in the wider community. Child marriage has become one of the most controversial issues in Islamic family law. Some scholars approve of the practice without disapproval while others do not. The substance of Islamic law is to create a better life for society today and in the future. If it is found that child marriage in contemporary society has caused many negative impacts, then this matter must be legally rejected.

Abstract

Marriage is a bond between a female guardian (prospective wife) and a male (prospective husband) which is carried out in the presence of two witnesses who meet the requirements. Maturity of age is important to form a prosperous family without ending in divorce. So the government sets the age limit for marriage in Law No. 1 of 1974 whose application creates discrimination, then Article 7 which regulates the age limit for marriage in the Law is changed to Law No. 16 of 2019. This writing aims to determine the effectiveness of the age limit for marriage according to Law No 16 of 2019 in East Lampung, based on data obtained from the case tracking information system at the Sukadana religious court, East Lampung, it turns out that there are still many applications for marriage dispensation, almost 80% of which are granted. This article uses interview and documentation methods. The type of research used is descriptive quantitative research and qualitative research using data from the Sukadana Religious Court SIPP, this article is in the form of the number of applications for marriage dispensation which is expected to provide an overview through the calculation of the data obtained regarding the effectiveness of the marriage age limit in Law No. 16 of 2019 in East Lampung. Based on the results found, it turns out that the application of the Marriage Age Limit in Law No. 16 of 2019 has not been effectively implemented in East Lampung, especially at the Sukadana Religious Court, seen from the large number of marriage applications that have been granted.

Abstract

Sistem hukum yang dipergunakan di Indonesia adalah sistem hukum civil law, yaitu sistem hukum kodifikasi atau tertulis. Kontribusi hukum islam di indonesia dilakukan pembangunan, pembinaan dan penerapan hukum Islam sebagai hukum positip dalam rangka usaha pembangunan dan pembinaan hukum nasional. Peranan Hukum Islam dalam Pembangunan Hukum di Indonesia adanya watak dinamis hukum Islam harus dikembangkan untuk menunjang perkembangan hukum nasional di alam pembangunan hukum di Indonesia ini. perlu memberikan batasan atas ruang lingkup daerah kehidupan yang dijangkau oleh hukum Islam dalam rangka pembinaan hukum nasional. Pembatasan bidang penggarapan hukum Islam ini harus ditindak lanjuti oleh para ahli hukum Islam. Penggarapan hukum Islam ini dilakukan dengan upaya merumuskan prinsip-prinsip pengambilan keputusan hukum Islam yang lebih mencerminkan kebutuhan masa kini disertai dengan perimbangan-pertimbangan kemanusiaan secara proporsional. Pada masa kemerdekaan Indonesia, hukum Islam, hukum Barat dan hukum adat sama-sama menjadi bahan bagi pembangunan unifikasi hukum nasional.

Abstract

Abstract: Corruption is an extraordinary crime, and efforts to eradicate it must be taken seriously. In deciding corruption cases, judges must consider the consequences of the defendant's actions. Judges can decide cases, but this freedom is not absolute; the community must consider it. Thus, judges cannot act arbitrarily in deciding cases. Decree Number 10/Pid.Sus-TPK/2021/PT DKI regarding corruption cases committed by the Pinangki Prosecutor's Office has juridical considerations regarding the gender of the accused, which is used as one of the reasons for the reduction. The duration of detention is from 10 to 4 years. Therefore, many parties consider the consideration and consideration of Decision Number 10/Pid.Sus-TPK/2021/PT DKI is wrong. This study aims to analyze the validity of judges' decisions based on criminal liability and the validity of judges' rulings and court decisions. The results of this study show that the judge's consideration and verdict against the Pinangki Public Prosecutor are unreasonable. Keywords: Pinangki, Judge's Verdict, Corruption

Abstract

If the marriage is broken up due to divorce, the former husband and wife concerned who are the father and mother of their children are still obliged to look after and educate their children. In the Compilation of Islamic Law, when a marriage is broken up by divorce, the ex-husband is given the obligation to give mut'ah to his ex-wife and children who have not yet been mumayiz, who are entitled to hadnanah. Rights at the time of divorce are efforts to empower the dignity of a woman. Thus, this paper aims to find out how when an ex-husband is negligent in fulfilling obligations towards his ex-wife and child. This is because when a divorce occurs because of divorce, a husband thinks that there is no more maintenance that must be given to his ex-wife so there are obligations that the ex-husband ignores.
