MILRev Is a scientific law journal with a focus on studies in the field of Islamic law, starting from fiqh, fatwa, or qanun (laws, shariah regional regulations, compilations of Islamic laws). Abstract

Marriage is a worship and complement of religion, marriage is also one of the scopes of discussions on Family Law. Marriage is the sunnah of the Prophet SAW. Marriage is a human right given by Allah SWT. To create a family that is sakinah mawadah, warohmah besides that the purpose of marriage is to continue the offspring, and to carry out its biological integrity. In the Department of Family Law, marriage is discussed in detail in order to create a marriage according to the Shari'a of Allah SWT. This article is entitled The Need for Rights and Obligations of Husband and Wife in the Family. This paper aims to find out what are the rights and obligations of a husband and wife in a household. In writing it uses research methods by collecting data from journals related to this discussion.

Abstract

Child marriage is a social phenomenon that is common in all places. This kind of marriage is like an iceberg phenomenon that appears a little on the surface, is rarely disclosed, but is commonly practiced in the wider community. Child marriage has become one of the most controversial issues in Islamic family law. Some scholars approve of the practice without disapproval while others do not. The substance of Islamic law is to create a better life for society today and in the future. If it is found that child marriage in contemporary society has caused many negative impacts, then this matter must be legally rejected.

Abstract

Marriage is a bond between a female guardian (prospective wife) and a male (prospective husband) which is carried out in the presence of two witnesses who meet the requirements. Maturity of age is important to form a prosperous family without ending in divorce. So the government sets the age limit for marriage in Law No. 1 of 1974 whose application creates discrimination, then Article 7 which regulates the age limit for marriage in the Law is changed to Law No. 16 of 2019. This writing aims to determine the effectiveness of the age limit for marriage according to Law No 16 of 2019 in East Lampung, based on data obtained from the case tracking information system at the Sukadana religious court, East Lampung, it turns out that there are still many applications for marriage dispensation, almost 80% of which are granted. This article uses interview and documentation methods. The type of research used is descriptive quantitative research and qualitative research using data from the Sukadana Religious Court SIPP, this article is in the form of the number of applications for marriage dispensation which is expected to provide an overview through the calculation of the data obtained regarding the effectiveness of the marriage age limit in Law No. 16 of 2019 in East Lampung. Based on the results found, it turns out that the application of the Marriage Age Limit in Law No. 16 of 2019 has not been effectively implemented in East Lampung, especially at the Sukadana Religious Court, seen from the large number of marriage applications that have been granted.

Abstract

If the marriage is broken up due to divorce, the former husband and wife concerned who are the father and mother of their children are still obliged to look after and educate their children. In the Compilation of Islamic Law, when a marriage is broken up by divorce, the ex-husband is given the obligation to give mut'ah to his ex-wife and children who have not yet been mumayiz, who are entitled to hadnanah. Rights at the time of divorce are efforts to empower the dignity of a woman. Thus, this paper aims to find out how when an ex-husband is negligent in fulfilling obligations towards his ex-wife and child. This is because when a divorce occurs because of divorce, a husband thinks that there is no more maintenance that must be given to his ex-wife so there are obligations that the ex-husband ignores.

Abstract

The discourse of thought departs from the reality of law enforcers (especially judges) who ignore moral values. Even though professional actors (judges) already have a professional code of ethics as a moral standard, it has not had a positive impact, especially not being able to change society's negative image of faces. One way to uphold the rule of law is by maintaining ethics, professionalism, and discipline. The code of ethics for the profession of judges in principle contains moral values that underlie professional personality, namely freedom, justice, and honesty.

Abstract

There are many things about the sakinah, mawaddah, and warohmah families, but how do people recognize and apply these concepts, namely to the sakinah, mawaddah, and warohmah families that many married couples dream of the purpose of this research is to use qualitative research methods to find out the application of the sakinah mawaddah warahmah family concept and what factors influence the creation of a sakinah mawaddah warahmah family. This research uses a type of qualitative research, and the type of research is descriptive research. The results of the study show that the sakinah mawaddah warahmah family is formed on the basis of mutual understanding between men and women in marital relations, multiplying offspring, and developing human life on the ground of love and compassion. This will create peace, peace between the two. Basically, according to the Islamic view, the factor that aims to achieve a good family life is to create a peaceful and peaceful family environment.

Abstract

The presence of a stepchild in a marriage requires a certainty of legal rights for inheritance and bequest division given by parents because of the difference status of stepchild with biological children, the purpose of this journal is to determine the rights of a stepchild in the division of inheritance and bequest division that can be obtained from their parents, especially in terms of the islamic law of inheritance. Method used is normative law research by approaching to reviewing and analyzing the law and positive regulations. The conclusion of this journal is that stepchild is not an heir in the family but reserves the right to inherit by way of will or bequest.

Abstract

This Scientific Writing contains the application of an online Marriage Management Information System (SIMKAH) to improve service quality. The research method used in this paper is normative legal research, which uses secondary or library data. The results of this study indicate that the application of a web-based online Marriage Management Information System (SIMKAH) at KUA is a form of modernizing marriage registration which is usually done manually in the KUA sub-district in serving the community. However, it is still not optimal because servers and networks often experience interruptions, which affect application speed. The implementation of the urgency system is an effort to support the implementation of government programs in maximizing IT-based services to the community and assisting KUA officers in the fields of marriage registration, marriage registration, marriage examinations, same marriages, and reconciliation. The quality of the information generated from the system is relevant to the needs and the output is complete and can be directly felt by users of the system and the community as recipients of the information, in this case, the procedure for recording which is usually done in writing by the administrator, can be typed into the SIMKAH program and operated by the administrator. itself so that the shape of the NB, N, and NA models can be printed/printed, and is more effective than writing. However, not all KUA apply SIMKAH optimally. As for the application of SIMKAH, it has followed the Instructions of the Director General of Islamic Community Guidance Number DJ.II/369 of 2013 concerning implementing the Marriage Management Information System (SIMKAH) at the Sub-District KUA.

Abstract

Dissolution of a marriage due to a court decision results in several other legal consequences, including the imposition of the obligation to pay 'iddah, mut'ah, maskan, kiswah, hadhanah, and child maintenance to be borne by the husband. This paper aims to find out how when a court decision is not carried out voluntarily and find a solution so that the decision is not only a pseudo-justice but can guarantee the justice and benefits of the decision in real terms. Based on the author's analysis, it can be concluded that if the decision regarding the ex-husband's obligations is not carried out voluntarily, an application for the execution of the decision can be submitted to the Religious Court which examines the case. The request can be based on the procedural law of the general court, namely article 197 HIR or 207-208 RBg. This effort can be carried out by the ex-wife even though the results are based on the assessment of the panel of judges who examined the case.

Waqf is no longer synonymous with land earmarked for educational institutions, cemeteries, places of worship, or other things, but waqf can also be used as a source of strength to realize the welfare of the people and to move the empowering sectors of waqf assets which can be professionally managed by the nazir with good management. appropriate, then the benefits derived from the management of waqf will be wider in its designation so that in the future it can strengthen the role of waqf in improving the economy and welfare of the people.
