Attempts at the implementation of shari’a in Indonesia have always been marked by a tension between political aspirations of the proponents and the opponents of shari’a and by resistance from the secular state. The tension had led to the profound and ongoing legal political dissonance in the formal application of shari’a rules in the country. A continuum between conflicts in meanings and direct contradictions in terms has resulted in a debate of which and whose shari’a to be implemented. This paper looks at the roots as well as the sources of those dissonances. It observes a number of conditions that make the articulation of religious law dissonant. It argues that more direct dissonance is discernible between the aspiration for the formal implementation of shari’a and constitutional rights of religious freedom. Arguing that despite shari’a has been able to seep into scattered legal aspects within Indonesian state and society and that the state has allowed shari’a to be incorporated in many ways into its legal system, nationally and regionally, it concludes that the state continues to control and restrict this dispersion and that shari’a remains tightly confined in Indonesia

The study wants to provide an insight into the importance of reward and punishment in relation to education. It is realized that the learning method by using reward and punishment can encourage students to have motivation to learn. As for the results in this study Reward and punishment are techniques to touch someone's psychic side so that they understand if they make a mistake, as a result the child will continue to be optimistic if what he did is right and stop after making a mistake.

This article offers a contextual study model on the Islamic law in Indonesia where Muslim people expect their religion to be able to adapt to the complex current developments, such as administrative affairs and state legislations, in the country. This issue also takes place globally, particularly in the Muslim world. Here, this paper delves this problem by exploring some factors that lead people to partake that expectation.

Artikel ini menyimpulkan entrepreneuship orang Lamongan di Jakarta terkonstruksi dalam sebuah dialektika bukan karena faktor lingkungan sosial budaya yang bersifat ekslusi sosial. Melainkan motivasi dalam konfigurasi mobilitas sosial climbing sebagai opsi mentransformasi status sosial (achieved status) di masyarakat secara vertikal. Konklusi ini sesuai dengan deskripsi informan yang berwirausaha dalam sektor kuliner. Temuan ini menunjukan lingkungan sosial budaya hanya memberi implikasi terhadap tipologi kesadaran diskursif pada pola migrasi masyarakat Lamongan ke Jakarta.Perilaku kewirausahaan orang Lamongan di Jakarta ditentukan oleh motivasi berprestasi (need of achievement) yang memberikan stimulus terhadap perkembangan masyarakat. Adanya interaksi masyarakat Jawa dengan pasar disertai dengan intensitas kepemilikan lahan. Memberikan implikasi pada aktivitas ekonomi berskala makro yang menyebabkan heterogenitas profesi masyarakat Jawa. Lebih lanjut, kebudayaan Jawa tidak kontras dengan sistem perdagangan dan kewirausahaan.Sementara itu, penulis tidak sependapat dengan konklusi yang mengidentifikasi pandangan mengenai korelasi antara nilai-nilai budaya dan perilaku kewirausahaan. Penjelasan mengenai konstruksi entrepreneurship didasarkan atas asumsi masyarakat yang menanamkan nilai-nilai kewirausahaan akan banyak orang yang menjadi wirausaha. Seperti adanya warisan culture priayi yang menyebabkan masyarakat Jawa berorientasi sebagai Pegawai Negeri Sipil (PNS) di kota-kota administratif.Kata Kunci : Migrasi, entrepreneurship, mobilitas sosial, budaya.

Artikel ini mengkaji persinggungan nilai antara etika dan estetika-artistik dalam karya sastra, kendatipun keduanya dapat berjalan berdampingan, tetapi tidak dapat disangkal dalam beberapa praktiknya terkadang menimbulkan pergesekan. Blasphemy dan kebebasan subjek creator-licentia poetica-merupakan dua contoh yang mewakili persinggungan nilai tersebut. Beberapa pendekatan dari pelbagai mazhab teori kesusastraan dipaparkan dalam artikel ini. Argumentasi yang menjadi dasar dari masing-masing pendekatan dalam teori kesusastraan tersebut seakan menutup diri dari pelbagai kemungkinan yang muncul pada pihak lain, oleh karena itu, penulis berupaya mengemukakan kembali konsep strukturalisme genetik yang diperkenalkan oleh Bourdieu sebagai sebuah bentuk pendekatan yang mengakomodasi persinggungan, setidaknya dua nilai tersebut.

Human uses symbol in its communication activity. The symbol can manifest in verbal and non-verbal things. Original culture of a society defines the way how they communicate and the symbol they use. The society of desa Nepa is not an exception. They have used a symbol in performing their local tradition, Rokat Tase’. The symbol used in Rokat Tase’ is a non-verbal symbol of communication, which is manifested in actions and delivery of foods and goods (sesaji). This article discusses the Tradisi Rokat Tase’ and its meaning within the society of desa Nepa. Using bibliographical and empirical inversitigation, this article argues that the main meaning and aim of that symbol is to pray and hope that God (Allah) protects the society in general and sailors in particular. That is also to prevent the occurrence of disaster and calamity and to ask for prosperity and for abundant fishes from sailing. It also stresses that the meaning of this symbol is reached within society’s interaction process and is agreed by all the parties involved in the interaction.

This paper attempts to examine to what extent the verdict of the Indonesian Mahkamah Konstitusi on the judicial review about the Law No. 1/PNPS/1965 on the eradication of blashphemy and defamation on religion has given perspective on the religious freedom and defamation of religion. It argues that the term ‘penodaan agama’ defined in the Indonesian Criminal Law is vague and has not clarified such relevant concepts as blashphemy, defamation of religion, and hatred speech. In fact, these three concepts are interchangeablely and chaotically used in this law. It also concludes that the Mahkamah Konstitusi has failed to take ‘middle way’ as to bridge and accommodate several interests retained in this legal attempt of judicial review and the Mahkamah Konstitusi takes not only constitutional but also political issues for its legal considerations, demonstrating that MK has obliviously revived the political ideology of ‘Piagam Jakarta’.
