Abstract

The legal implication from difference religion marriage (lslam law and Marriage Law No.l year 1974 perspective), there is no reason whatever thut dilference religion marriage can at agree, because Islam law and Marriage Law No.l year 1971 perspective is prohibit, therefore, if happen difference religion marriage, so the marriage status not valid, so also with child status. wtlhout the valid difference religion marriage, so bring consequence to wards marriage license, divorce, iheritance, death and ratification birdhs  child certificate. The diference religion marriage contain risk towards soul development, because many factors that be marriage confict, well- being in one of also the two so also with lhe children soul development  also will have towards society environment,because marriage not only involve two individual but also deliver family and society,nation and country.

Abstract

This study is about WTO ratification and its impa on economic development andIndonesia legal reform (an ontological approach). WTO law is based on positivismneoliberalismparadigm. WTO law substance againsts pancasila paradigm and 33articles of the 1945 constitution. In addition to the substance of WTO law negatesthe substance of the article 7 of legal drafting regulation, it will have an impact on:(a) loss of Pancasila as the position fundamentalnorm paradigm and must make thelegal establishment of the indonesian economy as fundamental WTO law, (b) loss ofPancasila as the position recht and must make the legal establishment of theindonesian economy as recht WTO law paradigm, (c) loss of standing of Pancasilaparadigm as the validity of the presupposition and the needs for the establishment ofthe economic laws in indonesia to the WTO as a presupposition the validity of the act

Abstract

The basicly, humans is social beings who relating to others. However, relationshipswith others are not impossible will cause a problem, the problem is one of them isdomestic or family violence. It is criminal act, because it has violated the law. Theapproach used is the problem of the normative approach, it is reviewing regulations,book/ /literature and other scientific papers, empirical approach is performed as asupport for the completeness of normative data, data analysis in qualitative analysis.The result of this research has shown about strenght of Visum Et Repertum. Visum EtRepertum as complementary instrument to seacrhing for material truth, because thejudge is limited by certainly jugde principle and application of the minimun thresholdof authentucation, so that certainly jugde principle to became dominant faith.

Abstract

Crime is a form of behavior that is contrary to human morals (immoral), harmful to society and break the law, the problem of evil is unavoidable and is always there, crime and insecurity cause public disorder, development to achieve the welfare of the community, one form of crime or crime is extortion, as in article 368 of the Criminal Code, it is necessary to police efforts to prevent and combat crime in accordance with the Law. 2 in 2002. The issue in this study are: a. whether the legal basis in criminal extortion by ruling case number: 560/Pid-B/2011/PN.TK, The results of this study concluded that: consideration of criminal law decision extortion case number: 560/Pid-B/2011/PN.TK is Article 368 paragraph (1) of the Criminal Code, the defendant's criminal extortion's. Anugra Imanudin, Hasan Basri and M. Hidayat sentenced to imprisonment for 6 months, factors that cause crime of personal and situational factors.

Abstract

Crime "stellionaat" which means the crime in respect of goods not moving (onroerende goederen). What is meant by the goods do not move it, especially land, rice fields, and buildings. The main element in stellionaat crime is an act that prohibited acts include selling, trading, saddled with dependents, rent, mortgage, and object actions are prohibited include: the right to use land, building/ construction and plant seedlings on land owned, while knowing that another person have rights to land and goods thereon.

Abstract

Rights of the house of representatives to present and give information to someone byforce (subpoena rights), accompanied by sanctions hostage is controversial. On oneside, the autorities forcibly required for the functions of the House to run well. Buton other side, the force is potential to create uncertainty due to the arbitrariness ofits implementation mechanisms. Parliament is not a law enforcement agency but apolitical institution. Ideally, the sactions also held political sactions. Moreover,subpoena rights design owned by Parliament can be used in every implementationthe functions. Initially, the right to subpoena can only be used in the implementationof inquiry as the most special rights owned by the House of Representatives. But now,in legislation the right to subpoena expanded scope. The implication, in every forumsession, the Parliament has the ultimate weapon that make it as a superior institution.

Abstract

The pro and contra towards gender perspective in Marriage law No.1 year 1974, there two perspective, is : 1) contra perspective, wife in domestic area and husband presents in public area, this wisdom doesn’t  give justice, puhes woman improverishment process. In Marriage law found discrimination towards woman should be abolished, with be ratified woman be Law No. 7 year 1984 about Discrimination, Abolition Towards Woman, so that, necessary right formulation revision and spouse duty in marriage law. Pro perspective, marriage laws correct and unnecessary at revision because right and duty must not be interpretted corred but be seen based on moral and the philosophy. The marriage is pray, hoppy family must basd on affection, mutual respect,love to love and mutual give good aid borns and mind. Task situating and responsibility must be discriminated by harmonization and symmetrical so that firm and shoulderred with responsibility .

Abstract

This study is about of the MajelisPermusyawaratan Rakyat decision under the legalprocedures of 1945 Constitution. The presence of MPR after the Amendment of 1945Constitution is still causing problems, because there are three MPR is declared valid.In fact, MPR had no longer a source of formal law since the enactment of Law No.10of 2004 on the establishment of legislation. It happened because most of the substanceof the MPR is not deposited in the legislation and just to avoid a legal vacuum. Forexample some of the problems caused by the separation of East Timor from Indonesia.To that end, the MPR was declared no longer valid should be viewed as a formalsource of law but as a legal source material. However, with the enactment Law No.12year 2011 on the establishment of legislation, the MPR Decisions have another runway.Article 10 Law No.12 year 2011 stipulates that MPR is one of the hierarcy of legalnorms in Indonesia.

Referring to this matter problems of this writing  is Attorney function and duty as Public Prosecutions in civil dispute This research use method approach of empiric and normatif, source of data of sekunder Data collecting primary data and bibliography study and field study and analysis qualitative. Result of research indicate that Attorney function and duty as Public Prosecutions in civil dispute for example as straightening of law, giving legal aid, giving consideration of law, giving service of law, and conduct action other law.

Abstract

Class Action in Indonesia to be see in Environmental Management Law No.23/1997and have amanded Protection and Management of Environment Law No. 32/2009,on the followed by Forestry Law No.41/1999, and so on. In Indonesia, there are 3(three) cases that attract attention: First, Kapak LPG Lawsuit, decision requets ofthe plaintiff is won, but Jakarta Province Court decision was rejected. Second, thevictim of consumer of railways in Brebes. In this case requets of the plaintiff claimwas granted is won. Third, Flooding lawsuit in Jakarta year 2002, in this case requetsof the plaintiff was rejected, on the based of Indonesian Presiden, Governor of Jakartaand Governor West Java is not responsible for flooding in Jakarta, but the mayor infive regions of Jakarta Province under Law Local Governance No.22/1999.
