Abstract

This article discusses the institution and the aplication of human rights courts in Islamic court system based on data revealed from the books of hadīth, al-sīrah al-nabawīyah, history, Islamic law, and others. From a comparative analysis, it can be concluded that the institution of Wilāyat al-Maẓālim can be seen as human rights court in Islam due to the similarity with the jurisdiction of Indonesian human rights court. If the authority of Indonesian human rights court is limited, that of Wilāyat al-Maẓālim is much wider as to cover the duties and authorities of other state bodies like the Commission of Truth and Reconciliation, State Administration Court, and the Commission of Ombudsman. Various regulations and practices of human rights in Islamic court as played by Wilāyat al-Maẓālim can be used as positive input for building the institution of human rights court.

Abstract

This article attempts to answer two questions: how is the genesis of Islam in Central Asia and how is the dynamics of ‘ulama related to the fragmentation of qadimism and jadidism. There is no doubt that ‘ulama played important role in spreading Islam and Islamic civilization, including in Central Asia. They got involved in the process of diversification of Islamic teaching and contributed to the struggle against colonialism. However, with modernity the ‘ulama underwent fluctuative relation with each other. Diverse responses to modernity resulted in the diversity of ways of actualization in coping with social problems. The rise of jadidism that was reacted by qadimism constituted a modern phenomenon in Central Asia when the ulama attempted to respond modernity. The diversity of ways of actualization caused the relation between qadimism and jadidism problematic. On another occasion, however, the ulama could contribute to each other, especially when they shared the same interest.

Abstract

This article attempts to discuss the views of Banjarese ‘ulama and the legal method used in responding to the issue of polygamy. The Banjarese ulama interviewed are nine. This study reveals the existence of different opinions among the Banjarese ulama. There are many ulama who accept polygamy, the minority being not too rigid in terms of conditions for polygamy, while the majority emphasize rigid conditions. However, there are ulama who reject polygamy due to various considerations and recent conditions. The desire to polygamy can be tolerated, but the conditions are required. The difference of opinions between the Banjarese ulama cannot be separated from the method of Islamic law used in understanding this phenomenon. If related to uṣūl al-fiqh, most views of the Banjarese ulama with regard to polygamy can be concludedas using the method of istiḥsān and dharī‘ah.

Abstract

This paper discusses the phenomenon of urban sufism among the majelis Shalawat Muhammad under the murshid Gus Kahar in Surabaya with followers (disciples) spreading in various places especially East Java, even abroad. The theory of continuity and change is used to critically review Howell’s concept on urban sufism, and to present key concepts on sufism in its generic sense in terms of doctrine and empirical praxis. Although based in Surabaya, the doctrine and praxis of urban sufism in the Majelis Shalawat Muhammad reflects generic sufi teachings. The findings of this research reveal that the principle of continuity and change prevails in sufi tradition from time to time. This finding is different from Howell’s theory which stress on ritual dimension. The followers of Shalawat Muhammad emphasize more on education on the basis of praxis (sālik-sulūk, riyāḥah, and mujāhadah), in addition to the dimension of doctrine itself.

Abstract

This article answers the problem of continuity and change of salaf tradition in the educational system of Pondok Pesantren Lirboyo Kediri. Using system theory along with historical, sociological, anthropological and phenomenology-cal appraoch, this article reveals some important points. First, the salaf tradition of pesantren undergoes substantial continuity, where knowledge structure of pesantren are conserved in learning of religious sciences originated from classical books, and partial change, where changes occur in the aspect of learning method, curriculum development, and teachers from outside pesantren. Second, there are internal and external factors that drive continuity and change in salaf tradition in the educational system of Pesantren Lirboyo. The internal factor is the attitude and thought of kiai as the servant of ummah (khādim al-ummah) and the objective condition of santri. While the external factor occurs because the development of the system of public education and the development of science and technology.

Abstract

This article attempts to unravel the failure of Arabic learning in formal education institutions and tries to offer alternative solutions. The failure of formal education institutions in learning Arabic is mostly due to the lack of clarity in the vision of the policy makers on the position and significance of Arabic materials. This is reflected in the policy regarding the frequency of face-to-face learning, qualificat-ions of teaching staff, preparation of textbooks, and the position of Arabic language materials which are still not included in the category of national examination materials. The success of Assunniyyah Islamic Boarding School in Kencong Jember in learning Arabic is because they are able to present bī’ah ‘Arabīyah (Arabic milieu) in the pesantren, even though they use ta’zīr as one of their approaches. Formal education institutions are less successful, or even fail in learning Arabic because they fail to present bī’ah ‘Arabīyah in their neighborhood. There are many points that need to be addressed in the context of designing Arabic learning in the formal education environment, both related to the creation of the environment, teacher qualifications and standardization of textbooks as learning resources, or related to the position of Arabic as material that adequately deter-mines student graduation.

Abstract

The article discusses nyadran celebration in the village of Jambe Gemarang Kedunggalar Ngawi with a humanistic psychology’s Carls Rogers. The community welcomes the enthusiasm for nyadran, because the event has meaning for abangan community in carrying out the ritual. The enthusiasm of the community with the preparation of ritual ritual: gambyong dance complete with sinden (handlebar), tumpeng, cleansing, offerings and drinks. The purpose of nyadran is for the safety and well-being of the village community of Jambe Gemarang. The humanistic psychology of Carls Rogers contributes to analyzing the implementation of nyadran in building relationships or communications among citizens. The community’s belief in rituals is significant, in particular the belief in sendang as a source of springs and large trees. The behavior of the people who believe in the ritual nyadran image of people who love local traditions and have a personality organism against the positive potentials of the community Jambe Gemarang. The nyadran ritual gives birth to a mature personality and a form of self-actualization of a prosperous society and has the pride of the nyadran tradition as (selfregard) formed from its experiences.

Abstract

This article analyzes the background of the legal pattern of the community at Kalisat Pasuruan in making local mediation as the main model to resolve divorce cases. This study uses a socio-legal approach with the Legal System Theory initiated by Lawrence Meir Friedman. This article is based on the emergence of the Supreme Court Regulation on Mediation in order to change the image of the Religious Courts from judicial paradigm to dispute resolution paradigm, including in divorce cases. The mediation in the case is imperative and the denial of mediation process in the court results in the cancellation of the decision by law. This study concludes that the alignment of the Kalisat community towards local mediation is much more due to non-legal factors which are categorized into elements of legal culture than to structural elements or legal substances. The legal culture element that is intended for example concerns the understanding of the Kalisat community on the teachings of their religion, their perceptions of the proceedings in the Religious Court in resolving divorce cases, or other factors such as the emotional closeness between them and community leaders who are local mediators.

Abstract

This study takes up the challenge of investigating Ibn Khaldūn’s concept of tasawuf by relating it to his overwhelming idea of al-‘Umrān. The man has been widely known for his innovative assessment on various issues relating to society, organization, civilization and above all, forms of knowledge. He has been acknowledged as a pioneer and father of modern sociology. Nonetheless, little has been done to study his thought on Sufism and how this form of knowledge works in social context. Ibn Khaldūn himself has not worked out to explain this problem. But one may reconstruct it within his comprehensive concept of al-‘Umrān, which is understood by some as a form of theories on social organization. It is toward this aim that this study is carried out. It argues that in Ibn Khaldūn’s mind, tasawuf a) is part and parcel of his notion of social organization without which a society may not emerge; and b) society has its roots not only in material, civilisational and biological needs of both man and society, but also in their spiritual needs. This spiritual need in its turns is the very motives why many undertakes spiritual quest. It is also, socially speaking, the raison de’etre for social cohesion to emerge. Hence, Ibn Khaldūn’s sociology of tasawuf as it were, has its epistemo-logical underpinning in his implicit idea of spiritual cohesion in society.

Abstract

This article examines the disappearance of the dimension of servitude among the members Sholawat Wahidiyah. The results of this study indicate that the variety of human normative responsibilities as a manifestation of the dimension of servitude to God (takālif) is valid for negation without reducing the degree of obedience. The validity of the negation occurs when the members are on their spiritual journey in the phase of fānī al-majdhūb. The provisions of the validity of the negation depend on the time of the phase of the journey. Practitioners who have arrived at this degree are totally free from all their responsibilities theo-centrically, as servants who are bound by devotion to their Lord. The validity of the negation refers to the mystical perspective and experience of prominent sufis, such as Ibn ‘Arabī and ‘Abd al-Wahāb al-Sha‘rānī. As an inseparable part of mujāhadah, the doctrine of fānī al-majdhūb is also transformed into a formal education environment managed by the practicioners Sholawat Wahidiyah. Thus, this doctrine is not only projected for members who have been mature in terms of age and spiritual journey, but also for students at the elementary and secondary levels of education.
