Abstract

This paper is set to find out whether the competition of Sino-Nationalism will have been influenced by the mutual benefit of their economics relations rather than by the historical hard-line military power. Post-Cold War era has shifted the ideological issue from capitalism/liberalism versus socialism/communism model to nation-wide economic welfare competition which made People’s Republic of China (PRC) to redefine their national entity towards its contending part, the nationalist Republic of China (RoC). While Sino-American relations may have warmed under the Taiwan’s new administration and the increasing role which Taiwan plays in Mainland China economics may have been well noted, may still lead to an undesired conflict.

Abstract

The critiques towards Cosmopolitan conflict resolution theory that it cannot be applied universally because it is incompatible with the characteristics of the conflict in the other part of the world beyond Western significantly influence the field. Several scholars argue that the theory - specifically cannot help to solve the current conflicts that generally happen in the Islamic Worlds or Countries or involved Islamic fundamentalist group because it was taken from the culture, the norms and the values of Christian Western Europe and North America experiences. Thus, this rise a question, do we need to have new perspective or theory of Conflict Resolution to solve particular conflicts in the Islamic World or Countries - such as from the Islamic perspective? However, it is not easy since Islam particularly after 9/11 is commonly identified as religion and culture that inherently violent. Stand from this point of view the author want to explore on the essay whether the Cosmopolitan Conflict Resolution seriously cannot be applied universally especially in the Islamic World and pop up with the possibility of Conflict Resolution theory from the Islamic perspective.

Abstract

Globalization on the one hand has reduced significantly the traditional roles of the state in the international level, while on the other hand it strengthened the positions of new transnational actors such as international organization, MNC, and society. At the domestic level, in many democratic nations, it changed the quality of democracy in which policies are no longer based on the interests of the people but to protect the penetration of global corporations. This article tries to explain, particularly in the case of Indonesia, how those decisions do not accommodate people as majority but only serve the interests of both local ruling elite and the transnational bourgeois. Democracy which ideally should be able to ensure the participation of the people in the decision making process apparently has been manipulated by a group of minority elites.

Abstract

On November 18, 2012, ASEAN countries signed ASEAN Human Rights Declaration. Since structured as a draft, this declaration has drawn controversy. The supporters argued that the declaration is a starting point for ASEAN countries to respect human rights. The Opponents considered that the declaration actually provide opportunities for ASEAN countries to commit human rights violations. Although both arguments are right, there is one thing that need to be underlined that the ten ASEAN countries have already signed the ASEAN Human Rights Declaration. This paper will examine the legalization of the ASEAN Human Rights Declaration. By examining its three dimensions -obligation, precision and delegation- ASEAN Human Rights Declaration is categorized as a soft legalization. The obligation of ASEAN Human Rights Declaration is low because it has no binding force. All ASEAN countries do not have obligation to implement the articles of the declaration. The precision of the declaration is also low because the words used in the declaration are ambiguous. It provides opportunities for the members of ASEAN countries to interpret them in different ways. Finally, the delegation of the declaration is also low because there is no third party that has authority to monitor the states’ compliance to the declaration and resolve conflicts that arise in case of human rights violations.
