Abstract

Waqf has an economic value where waqf is a potential source of funds for people who need to be developed, utilized, and managed professionally to obtain optimal results. In order to mobilize the potential of waqf, a partnership should be made of the endowments established by the community and the representative bodies established by the Government. The purpose of waqf regulation from the economic aspect is to improve the welfare of Muslims and the Indonesian nation. In addition, to accommodate the growing potential of waqf that is increasingly diverse in line with modern economy such as cash waqf. There are several obstacles that impede the implementation of cash waqf in accordance with the provisions of Law no. 41 of 2004, among which are; first, the Indonesian Waqf Board (BWI) does not have the operational power in the area of  sufficient money waqf. Second, the principle used in the implementation of waqf money is too rigid, ie the bank is purely as a bank. Thus, the Wakifwho performs cash waqf is treated the same with other customers.

Abstract

In jurisprudence there is an idea of  waqf mu’aqqat (waqf only in a certain duration). Imam Malik argues that the waqf contract is Mulazamat (the possession of a waqf object passes from wakif belongs to God-general). However, he argues that waqf is not necessarily done by Mu’abbad (forever); it may be done within a certain period of time, provided that the waqf shall not be withdrawn until the agreed duration is completed. Indonesian Muslims for hundreds of years have already identified waqf with (in the form of) land, and movable objects of a long lasting nature. Thus, Law no. 41 of 2004 and PP No. 42/2006 is projected as a means of social engineering (social engineering), make changes in thoughts, attitudes and behavior of Muslims to breathe with the spirit of the Act. One of the new regulations in the Waqf Act is the development of waqf objects.

BAZNAS has now transformed into a large and influential zakah institution in the life of Indonesian society due to the power of the Law that shelter it. This is an institution awaited by Muslims in general. This institution is the Shariah institution authorized entitled to receive and distribution of zakat, infaq and alms. Therefore this institution should be established by each region throughout Indonesia both at provincial and district levels. Therefore, transparency becomes crucial because of the many parties who are interested in zakah institutions. Transparency can be done by presenting reasonable financial statements. The organizers of zakat institutions should be obliged to understand the preparation of financial statements. This is in some areas are still frequent inequality and lack of understanding of the basics in the preparation of zakah institutional financial statements.

Abstract

The importance of the Quranic principle in the Qur>an is actually nothing but a departure from social reality, that diversity and diversity are social facts. Nevertheless, for some people it still assumes that diversity is a threat, but for some others diversity undermines the monism that is inherent in tribal, national and religious clothes. The number of social conflicts that occur in society today is pointed out as an indication that some parties are still unwilling and not ready to accept the diversity even many ways that are used in rejecting the fitrah and destiny of God, which is by forming a religious understanding that rejects various forms of understanding that lead to diversity include the diversity of ideology and contemporary-modern thought theory. Seeing this fact, it is important to immerse tolerance within the framework of diversity in the life of society, nation and state. Tolerance is needed and become a pillar in realizing a life of mutual respect for each other so as to create a harmonious life. To realize it all required the role of educational institutions is no exception wakaf educational institutions where it is considered to have a noble and great role in the history of human life that is shaping the character of learners who are capable, independent, creative, democratic, responsible and tolerant tailored to the concept of curriculum based on values  of tolerance according to Islamic teachings.

Abstract

Zakah is one of the characteristics of the Islamic economic system, because zakah is one of the implementation of the principle of justice in the Islamic economic system. Trade is one form of legal business. The predominantly Muslim village of Mejobo has considerable potential associated with zakat, where the mejobo village has a prominent market commodity in the south of the southern part of the potential Brayung market in which a total of approximately 1000 traders in the Mejobo Village market. Materially the traders gain prosperity through two things: capital turnover and reasonable trade margin. However, in reality the merchants are distributing their zakah directly to mustahiq without going through zakah institution in the form of money every close to Eid al-Fitr. In addition, they also channel their zakah to a person who is not assigned as an amilin or zakah officer but to a person who is trusted to distribute. It is unfortunate if this large potential is not touched optimally by the zakah amil institutions in both the private and government. So it can be ascertained that the prospect of Brayung Desa Mejobo market must be developed maximally so that in addition to the obligation of Muslims to pay zakah, it also affects the social good and reduces the burden of the government.
