Abstract

From the results of this study, it can be seen: The delay of marriage in the midst of the Covid-19 outbreak in Kenten Laut Village, Talang Kelapa District, Banyuasin Regency was motivated by several things, namely a circular letter from the minister of religion, prospective husbands who were out of town, and wanted to hold a big reception. -magnitude. Abstract

Inheritance in Islam has a very clear source of law in the Al-Quran and Hadith, but there are still many Muslim communities who carry out inheritance practices not based on Islamic inheritance law but make custom as the law that applies to the local community. This also happens to the people of Pengarayan Village, Ogan Komring Ilir where according to tradition only the descendants of the eldest son can control the inheritance from the heir if when the heir dies and there is no male heir, then the heirs of the simayit inherit the property. passed to the eldest simayit simayit even though he was still another heir. This research method uses field research methods, the source of the data used is the primary data source obtained from interviews with respondents in the field, then secondary data is obtained from books and scientific works. Data collection techniques are direct interviews, field surveys and documentation. The data analysis used is inductive qualitative, namely drawing conclusions from general statements drawn from specific statements. Then the results of the study were obtained, namely: the implementation of the distribution of the inheritance of the Pengarayan Village community based on the tradition of the distribution being carried out by family deliberation, where only male descendants distribute and control the inheritance. If there is no son, he will support a simayit simayit who will control all the inheritance, for female heirs such as mother, wife and daughters, they do not get the inheritance. Abstract

The polemics and controversies of interfaith marriages in Indonesia are still due to the uncertainty of the laws governing them. The reality in the interfaith marriage community is that there is no legal certainty in it. This makes children born from interfaith marriages protected by the state as regulated in Law no. 23 of 2002 concerning Child Protection Article 1. Meanwhile, according to Islamic law a child can be said to be legitimate if he has a lineage with his father if he is born from a legal marriage, this makes the child can be called a legitimate child. This study uses a normative juridical method with a normative theological approach. This research is classified as library research. The results of this study indicate that according to the applicable positive law, namely Law Number 1 of 1974 concerning Marriage, it does not recognize interfaith marriages, so interfaith marriages cannot be legalized in Indonesia. Marriages of Muslim couples are registered at the Office of Religious Affairs (KUA) and marriages of non-Muslim religious couples are registered at the Civil Registry Office (KCS). Legal protection for children according to Islamic law is the fulfillment of all children's needs for the future. As contained in the QS. At-Thala verse 6, children will get education and health insurance, only if the child is born from an unregistered interfaith marriage then he only has a nasab relationship with his mother because interfaith marriage is an illegitimate marriage and will lead to adultery. Abstract

The form of the marriage ceremony in Islam is commonly known as walimah al-urs. The Qur'an does not mention the implementation of walimah al-urs, but only recommends getting married. In the past, the wedding party was enough to invite neighbors and family. Usually the family who will be the witnesses attend a very historic event for the bride and groom, accompanied by reading the Koran, prayers and praise of gratitude to Allah SWT. However, at this time the implementation of walimah al-urs has undergone a change or a shift that is almost out of the goal of walimah al-urs itself, it has become a common culture that a wedding or walimah al-urs must be luxurious, starting from giving dowries and holding a big party. -size and so on. This is what happened in the community of Pedamaran District, Ogan Komering Ilir Regency. This research is classified as field research with empirical normative research methods. Based on the results of the study, it was concluded that walimah al-urs or wedding parties in Pedamaran District, Ogan Komering Ilir Regency had become a tradition or habit and had even become a necessity whose implementation was related to the holding of a marriage. The initial goal of the people of Pedamaran District, Ogan Komering Ilir Regency in walimah al-urs was very good, namely to please children and to entertain invited guests and as an expression of gratitude, but in practice it has experienced a shift and the resulting impact is social jealousy between communities, used to gain profit (business), the nature of prestige, disturbing the peace caused by the community. Abstract

This research is motivated by the use of money formed in decoration as a wedding dowry. The purpose of this study is to determine the factors that cause people to use money made as decorations as a marriage dowry and to find out how Islamic law reviews the use of money formed by hisan as a marriage dowry. The method used in this research is a qualitative descriptive method with the type of field research. Based on the results of the study, it can be concluded that first, the factors that cause people to use decorative money as a wedding dowry, among others, because it has unique elements, follows trends, the number of craftsmen for decorative dowry money, can be used as decoration and can be used as a keepsake. Second, a review of Islamic law on the use of money made as decorations as a dowry, among others, based on the hadith of the prophet from Sahal bin Sa'ad al Sa'adiy in the form of muttafaq 'alaih, that the dowry is an obligatory thing in a marriage and does not burden the husband in marriage. giving a dowry to his wife, even from an iron ring and memorizing the Qur'an is allowed as a dowry. Furthermore, based on the rules of fiqhiyyah, the law of origin of something is permissible, until there is a proof that shows its prohibition. In addition, the dowry of money can also be useful at a time when a husband and wife need funds so that they can take the money from within the frame to meet their needs. Abstract

This article discusses women's rights after divorce in positive law and Islamic law. Women's rights after divorce are deemed necessary to be discussed further, because in the Indonesian legal system women's rights after divorce are guaranteed by the Supreme Court regulations, considering that marriage in Indonesian law is regulated based on positive law and Islamic law. The method used in this research is normative juridical with the type of literature study. The results of this study show that after the divorce, women's rights, especially a living are guaranteed in the Marriage Law, as well as the issuance of Perma number 3 of 2017. Then according to Islamic law, ex-husbands have an obligation to provide iddah and hadhanah to their wives and children, mut'ah maintenance for women who are divorced, as well as dowry debts that must be repaid immediately. Abstract

HIV/AIDS is often associated with deadly diseases that are transmitted through promiscuity and homosexual behavior. HIV/AIDS is also said to be a cursed disease as a result of inappropriate behavior, so that it often creates stigma and discrimination against its sufferers which makes children with HIV/AIDS get bad treatment. This study aims to determine the perspective of Islamic law on legal protection for children with HIV/AIDS in Law Number 35 of 2014 concerning Child Protection. The research method used in this paper is a normative juridical method with the type of literature study. The results of this study show that legal protection for children with HIV/AIDS is in the form of special protection through surveillance, prevention, treatment, care, and rehabilitation efforts. Meanwhile, according to the perspective of Islamic law, protection of children with HIV/AIDS is a form of using maqashid shari'ah, which aims to protect children's self-esteem (hifz nafs) and provide peace in all aspects of social life. Abstract

Marriage is a bond between a man and a woman who unite and complement each other to live as husband and wife in a marriage bond. Along with the times, the government issued new regulations relating to the minimum age limit for marriage in Law Number 16 of 2019 Article 7 Paragraph (1) Amendment to Law Number 1 of 1974 concerning Marriage. This study aims to examine the effectiveness of setting the marriage age limit after Law No. 16 of 2019 has been implemented at the Palembang City Religious Affairs Office. The research method used is the empirical normative juridical method with the type of field research (field research). Based on the results of the study, the authors concluded that the effectiveness of setting the age limit for marriage after Law Number 16 of 2019 at the Palembang City Religious Affairs Office had been carried out well for several reasons as evidenced by each religious affairs office, namely because of the parties involved. the parties concerned both from the Ministry of Religion and from the Office of Religious Affairs have complied with the regulations as stated in the Circular from the Ministry of Religion regarding the enactment of Law Number 16 of 2019. The factors that influence its effectiveness are the important roles of the Office of Religious Affairs in carrying out their duties and socializing the Law. Abstract

Penelitian ini dilator belakangi oleh adanya peran KUA terhadap kebijakan pemerintah dalam pencegahan pernikahan anak dibawah umur pasca berlakunya Undang-Undang Nomor 16 Tahun 2019. Tujuan penelitian ini adalah untuk mengetahui peran KUA dalam pencegahan pernikahan anak dibawah umur di KUA Kecamatan Lubuk Batang Kabupaten OKU dan untuk mengetahui Efektivitas peran KUA terhadap kebijakan dalam pencegahan pernikahan anak dibawah umur di KUA Kecamatan Lubuk Batang Kabupaten OKU. Jenis penelitian dalam penelitian ini adalah jenis penelitian Lapangan (field research). Jenis Data adalah Data Kualitatif, dengan sumber data Primer, sekunder dan tersier. Sedangkan tehnik pengumpulan data dalam penelitian ini menggunakan wawancara dan dokumentasi. Tehnik analisa data yang digunakan yaitu deskriptif kualitatif. Kemudian pembahasan ini disimpulkan secara deduktif yaitu dari umum ke khusus. Dalam penelitian ini penulis ada beberapa hal yaitu pertama peran KUA Kecamatan Lubuk Batang Kabupaten OKU terhadap kebijakan dalam pencegahan pernikahan anak dibawah umur pasca berlakunya Undang-Undang Nomor 16 Tahun 2019. Keterangan tersebut menjelaskan bahwakepala KUA Lubuk Batang Kabupaten OKU berperan sebagai BP4 Kecamatan memiliki program yang dinamakan dengan Suscatin atau Kursus Calon Pengantin sebagai wadah yang ditujukan bagi para pengantin untuk dibimbing, diarahkan dan dinasehati termasuk pernikahan dini yang akan dilakukan, dalam program suscatin ini para remaja yang akan menikah dijelaskan mengenai dampak pernikahan, permasalahan dalam pernikahan khususnya mengenai aturan batasan umur yang ditetapkan oleh Pemerintah bagi masyarakat yaitu berumur 19 tahun. Jika umur calon pengantin belum berumur 19 tahun maka tetap di berikan program suscatin namun mereka belum bisa untuk menikah dikarenakan belum cukup umur berdasarkan Undang-Undang Nomor 16 Tahun 2019. Kedua, efektivitas peran KUA terhadap kebijakan dalam pencegahan pernikahan anak dibawah umur di KUA Kecamatan Lubuk Batang Kabupaten OKU. Berdasarkan data yang saya dapatkan dari kepala KUA Kecamatan Lubuk Batang Kabupaten OKU bahwa peran kepala KUA dalam keefektipan mengenai kebijakan dalam pencegahan pernikahan anak dibawah umur di KUA Kecamatan Lubuk Batang Kabupaten OKU belum dapat dilaksanakan sepenuhnya.di sisi lain jika masih ada remaja yang masih ingin melakukan pernikahan maka akan diberikan dispensasi nikah. Sebagaimana dijelaskan dalam Pasal 7 ayat (2) Undang-UndangNomor 16 Tahun 2019 tentang Perkawinan. Kata kunci : Peran KUA, Pernikahan dibawah umur, Undang-undang Nomor 16 Tahun 2019

Abstract

Sejak tahun 2020 Indonesia dilanda pandemi covid-19, pemerintah melalui Kementrian Agama (Kemenag) mengeluarkan Surat Edaran Nomor: P-004/DJ.III/Hk.00.7/04/2020 Tentang Pengendalian Pelaksanaan Nikah di Masa Darurat Bencana Wabah Penyakit Akibat Covid-19. Lalu bagaimana dengan ritual adat Mandi Kasai yang harus ditiadakan pada masa pandemi COVID-19 ini. Maka tulisan ini menganalisis mengenai larangan ritual adat Mandi Kasai pada upacara perkawinan masyarakat Lubuklinggau pada saat pandemi COVID-19. Hasil dari penelitian ini, perkawinan tetap dilaksanakan hanya dengan akad nikah tanpa adanya ritual adat. Tujuan diberlakukan larangan ini yaitu menunda perkawinan adat pada masa pandemi COVID-19 adalah perbuatan yang mulia karena menyelamatkan banyak jiwa. Segala hal yang lebih banyak menimbulkan mudharat harus dijauhi.
