Abstract

Perkembangan Hukum di Indonesia, senantiasa mengalami perubahan.  Begitu juga dengan Hukum Pidana. Salah satu hal substansial yang mengalami perubahan dalam Hukum Pidana adalah terjadinya perubahan dalam Kitab Undang-undang Hukum Pidana (KUHP). Perkembangan Hukum Pidana yang terjadi memungkinkan dilakukan dekriminalisasi terhadap delik. Seperti Pasal 134,136 bis 137, 154, 155, 209,210, 387,388, 415 sampai dengan 420, 423, 425, 435 dan beberapa pasal lainnya. Sementara itu, Pasal 1 ayat (2) KUHP menyebutkan bahwa Jika sesudah perbuatan dilakukan ada perubahan dalam perundang-undangan, dipakai aturan paling ringan bagi terdakwa. Subyek  Hukum Pasal 1 ayat (2) KUHP  adalah terdakwa, begitu juga bila terjadi dekriminalisasi maka Subyek Dekriminalisasi adalah Terdakwa. Terjadinya dekriminalisasi terhadap delik didasarkan oleh adanya pertimbangan Filosofis, Sosiologis dan Yuridis, sehingga peraturan dapat berubah. Dengan adanya perubahan paradigma terhadap suatu delik. Maka, perubahan ini sepatutnya juga dirasakan oleh para Terpidana maupun mantan terpidana.  Status terpidana dan mantan terpidana yang disandang oleh seseorang namun delik yang dilakukan tidak lagi dianggap sebagai tindak pidana, sudah tentu harus mendapat perhatian khusus. Tulisan ini mengangkat isu Keadilan bagi Terpidana dan mantan terpidana atas delik yang dilakukan bukan lagi menjadi delik hukum. Metode yang digunakan  yaitu secara Normatif berdasarkan pendekatan Kepustakaan.

Abstract

Data shows that 24 cases in Central Sulawesi in 2019 were all sentenced to prison or imprisonment which is still the favorite type of sanction. How not, even 18 of the 24 cases did not need to serve a period of detention, but underwent various probationary periods, at least 1 month of probation and a maximum of 12 months. However, it needs to be realized that if the imposition of this criminal sanction does not need to be implemented, why should it impose sanctions in the form of conventional punishment, the answer is of course because the legality principle only gives room to the criminal, so it is necessary to have an alternative description of what the maker can use the law in formulating the sanctions for resolving election criminal acts as an effort to redesign the model for tackling election crime in Indonesia, particularly in the Central Sulawesi region. The issue in this research covers criminalization in case study election crimes in Central Sulawesi with the perspective of ius constitutum and alternative punishment in case study election crimes in central Sulawesi from the perspective of ius constituendum. The research method uses normative juridical research methods. The results achieved are that the type of Election Crime as an ius constitutum still uses the conventional system, so to achieve the ius constituendum it is necessary to modify the sanctions in the form of alternative types of sanctions that are more efficient, such as the cancellation sanction as a candidate for candidate in the election contest.

Abstract

The purpose of this study is to analyze the factors that hinder the implementation of government policies against the elimination of minimal capital of legal entities as an effort to develop MSME to improve the regional economy in Palu of Central Sulawesi. This research was an empirical research method using a qualitative descriptive approach. The results showed the factors inhibiting the implementation of government policy on the elimination of minimal capital of legal entity making is the lack of information about Government Regulation Number 29 of 2016 concerning Changes in The Basic Capital of The Establishment of Limited Liability Companies, Constraints on the requirements of making Limited Liability Companies both due to large capital constraints for the manufacture of Limited Liability Companies and Due to Administrative System Constraints that are quite difficult, and the latter is the Orientation of Individualist Thinking.

Abstract

Omnibus law menjadi perdebatan dikalangan masyarakat sejak pemerintah mencanangkan menggunakannya dalam pembentukan undang – undang, pro dan kontra hadir dikarenakan metode Omnibus law cenderung digunakan oleh negara yang bermatra common law sistem. Namun, kehadiran Undang-Undang Cipta Kerja menjadi jawaban bahwa metode ini juga kontekstual dan relevan untuk digunakan pada civil law sistem. Penelitian ini berfokus untuk menjawab (a) Omnibus law Dalam pembentukan Peraturan Perundang-Undangan; (b) Hakekat Peraturan Daerah; (c) Penggunaan Metode Omnibus law dalam Pembentukan Peraturan Daerah. Tujuan dari penelitian ini untuk mengetahui, memahami, dan menganalisa Omnibus law Dalam pembentukan Peraturan Perundang-Undangan, hakekat Peraturan Daerah, dan merumuskan Penggunaan Metode Omnibus law dalam Pembentukan Peraturan Daerah. Metode penelitian yang digunakan ialah penelitian yuridis normatif, dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukan bahwa penggunaan metode Omnibus law dapat diimplementasikan terhadap subtansi materi muatan Peraturan Daerah yang ketentuan pembentukannya didasarkan atas pelaksanaan undang-undang yang juga dibentuk melalui metode Omnibus law.

Abstract

Diversi merupakan salah satu sistem penyelesaian tindak pidana anak, yang dilakukan di luar pengadilan pidana. Sistem Peradilan Pidana Anak, merupakan lex spesialis dan satu-satunya sistem dalam hukum pidana yang menggunakan sistem diversi. Keterlibatan banyak pihak menjadi salah satu keunikan sistem ini, serupa namun tak sama, begitulah perbandingan antara sistem diversi dengan mediasi. Keterlibatan beberapa pihak inilah menjadi ciri pembeda antara diversi dengan mediasi, bila mediasi hanya melibatkan pihak-pihak yang berkonflik, diversi melibatkan bukan hanya pihak yang berkonflik namun juga melibatkan pihak lain seperti tokoh masyarakat, orang tua (anak pelaku tindak pidana), tokoh agama, guru dan aparat penegak hukum. Namun dari semua pihak yang terlibat, guru dianggap salah satu pihak yang memiliki peran besar. Sebab guru sebagai pengganti orang tua, memiliki waktu bersama anak lebih banyak dibandingkan dengan pihak-pihak lainnya. Olehnya dalam penelitian ini mengangkat isu tentang bagaimana peran guru dalam proses diversi tindak pidana tindak pidana anak? Tujuan penelitian untuk mengetahui sejauh mana peran seorang guru sebagai tenaga pendidik dalam penyelesaian perkara pidana melalui sistem diversi. Adapun metode penelitian dengan menggunakan sistem social jurosprudence. Dan kesimpulan pada penelitian ini, bahwa peran guru terhadap pelaksanaan diversi pada tindak pidana anak sangatlah dibutuhkan, sebab guru mampu melakukan pendekatan dengan menggunakan psikologi pendidikan melalui konteks kepribadian, intelektual, maupun emosi kejiwaan anak guna mengarahkan anak menjadi pribadi intelektual masa depan. Oleh sebab itu, undang-undang memberikan ruang terhadap guru hadir dan berperan pada proses diversi tindak pidana anak. Kata Kunci : Guru, Diversi, Tindak Pidana dan Anak

Abstract

Abstract Deconstruction is a thought based on the method of reading texts that are based on philosophical values, since the 2015-2020 regional elections there have been several problems in handling structured, systematic, and massive administrative offences by Bawaslu. This research is a normative juridical research by analysing the laws and regulations related to the simultaneous local elections. This study concludes that the presence of a structured, systematic, and massive concept in the simultaneous Pilkada is based on the concept that was born in the examination of the dispute over the election results by the Constitutional Court which was then normalized into the Pilkada Law. The handling of administrative violations that are structured, systematic, and massive is categorized as difficult to prove because it uses a cumulative element. Deconstruction is carried out by changing the element of evidence in handling TSM administrative violations with an alternative – cumulative element, with the provision that alternative evidence is carried out against acts of promising or giving money or other materials proven massively. This study also suggests making changes in the construction of norms governing structured, systematic, and massive administrative violations in the Pilkada Law by using alternative – cumulative elements to achieve justice. Abstrak Dekonstruksi merupakan suatu pemikiran yang berbasis pada metode membaca teks yang bertumpu pada nilai filosofis. Sejak Pilkada Tahun 2015-2020 terdapat beberapa problematika dalam penanganan pelanggaran administrasi terstruktur, sistematis dan masif (TSM) oleh Bawaslu. Penelitian ini merupakan penelitian yuridis normatif dengan menganalisis peraturan perundang–undangan yang terkait dengan Pilkada serentak. penelitian ini menyimpulkan bahwa hadirnya konsep terstruktur, sistematis dan masif pada Pilkada serentak didasarkan atas konsep yang lahir dalam pemeriksaan sengketa hasil Pilkada oleh Mahkamah Konstitusi yang kemudian dinormakan ke dalam UU Pilkada. Penanganan pelanggaran Administrasi terstruktur, sistematis dan masif terkategori sulit dibuktikan karena menggunakan unsur kumulatif. Dekonstruksi dilakukan dengan mengubah unsur pembuktian dalam penanganan pelanggaran administrasi TSM dengan unsur alternatif–kumulatif, dengan ketentuan pembuktian secara alternatif dilakukan terhadap perbuatan menjanjikan atau memberikan uang atau materi lainnya terbukti secara masif. Penelitian ini juga menyarankan agar melakukan perubahan dalam konstruksi norma yang mengatur pelanggaran administrasi terstruktur, sistematis dan masif di dalam UU Pilkada dengan menggunakan unsur alternatif-kumulatif sehingga dapat mewujudkan keadilan.

Abstract

The purpose of this paper is to find the ideal form of punishment for perpetrators of sexual violence who suffer from deviant sexual behavior. The method in this study is a normative legal research type, where activities are carried out by researching and analyzing the forms of sanctions and punishments regulated in positive law, in addition to conducting a comparative study of the provisions in positive law in Indonesia in the perspective of the types of sanctions against perpetrators of sexual violence crimes. who suffer from deviant sexual behavior. The results show that the ideal form of sanctions imposed on perpetrators of sexual violence who suffer from deviant sexual behavior should not only focus on imprisonment, however, it must be accompanied by other treatments or actions to treat the deviations in sexual behavior he suffers as mandated in the Sexual Violence Criminal Act, which is to combine imprisonment and special rehabilitation to cure his sexual behavior deviations. With the imposition of imprisonment alone, it will not be able to treat the main factor that triggers sexual violence crimes committed by perpetrators who suffer from deviant sexual behavior, so that rehabilitation or treatment efforts are important things that must be done so that there is no repeated or recidive crime.

Abstract

Global criminal political considerations are strengthening national laws to realise Restorative Justice for the achievement of recovery for victims, perpetrators and the social order of society. The perspective of Restorative Justice can not only be seen from the concept of national law but of course, it can also be seen from the perspective of International Law. One form of Restorative Justice includes Diversi in the Juvenile Criminal Justice System, where Diversi is the result of International Conventions, one of which is the United Nations Rules for The Protection of Juvenile Deprived of Their Liberty (UNRPJ). This paper focuses on the principle that the purpose of criminalising and rectifying criminals is not only a national problem by a particular state but also a general problem by all countries. The research uses a Normative Juridical method with a statute approach, concept and doctrine approach. This research specifically how the contribution of international law in strengthening the ideas and values of Restorative Justice, and its conclusion, restorative justice in the development of criminal policy needs to be given a special space, namely given space for the implementation of restorative justice through policy modify which of course puts forward the idea of recovery for victims, perpetrators and also the community. Restorative justice is familiar in international law, even via the UN congress greater than as soon as it has issued thoughts of struggle by promoting restorative justice. An extra humanist purpose is to be the primary character of international law, as is the precept of worldwide law that each conflict that arises requires a decision that has to be primarily based on humanity.

Abstract

The ideal election is an election whose process is good, qualified, and fair. Since the direct elections in 2014 until the simultaneous elections in 2019, election violations have often occurred, including election administration, election crimes, and the code of ethics of election organizers. The design of handling election administrative violations after the determination of the results: handling of the election administrative violations after the determination of election results, the original intense of Article 454 paragraph (6) and Article 461 paragraph (1) of the Election Law, and the ideal redesign in handling administrative violations in Bawaslu after the determination of election results. Research results: first, Bawaslu still receives election administrative reports after the determination of results. Second, the original intense of the norms limit the handling of election administrative violations to the process stage. Third, redesign the norms and the mechanism, then provide strict limits in the Constitutional Court Regulation.

Abstract

Handling election violations abroad is one of the determinants of the quality of elections in Indonesia. With the rise of cases that occurred abroad during the 2019 general election, it is hoped that this will be a lesson to make an ideal design for handling election violations abroad in 2024. This research is executed differently from existing or previous research, for Example “The novelty of this research will make a significant contribution to determining the means, size, and function of the parliamentary threshold in the legislative election.” The conclusions of the research show that first, the urgency of handling election violations abroad to create order and peace, protect constitutional rights and uphold justice. Second, to realize the ideal design for handling election violations abroad in 2024, it is carried out increasing the number of members of the Overseas General Elections Supervisory committee from 3 to 5 people, making changes to Article 112 letter c, Article 507 of the Election Law, Article 13 paragraph (4) of the Regulation of General Elections Supervisory Agency Number 7 of 2018 and Article 60 paragraph (1) of the Regulation of General Elections Supervisory Agency Number 8 of 2018, and changing the paradigm of law enforcement from compliance level to internalization of legal Compliance in the 2024 elections.
