Abstract

Abstract Religious diversity is often a challenge in harmony, there is still statically addressed (exclusive), has not led to a motion proactive in building unity among religious. Harmony among religious believers in the perspective of criminal law refers to one of the articles in the Code of Penal about setting Crimes Against Public Order, namely Article 156a, which is the rider with the Presidential Decree of the Republic of Indonesia Number 1 / the 1965 on the Prevention of Abuse and / or blasphemy. Treatment of the perpetrators either individual or organization or belief is preceded procedural measures and stages of criminal sanctions for perpetrators of violations of Article 1 of the Republic of Indonesia Presidential Decree No. 1 / the 1965 as the final sanction which wants peace.Keywords: harmony, religious communities, the criminal law.

Abstract

Perdagangan orang merupakan salah satu kejahatan serius dan masih berkembang setiap tahunnya. Salah satu peran penting dalam penanganan kejahatan ini adalah kepolisian. Limitasi terhadap peran kepolisian diharuskan sesuai dengan prosedur dan memperhatikan Hak Asasi Manusia. Penelitian ini bertujuan untuk menemukan dan menganalisis pola penanganan dan penindakan kepolisian terhadap pelaku tindak pidana perdagangan orang di Sumatera Utara. Tipe penelitian yang digunakan adalah Non-Doctrinal. Analisis dilakukan dengan cara deskriptif untuk menggambarkan korelasi antara regulasi dan kinerja Polda Sumatera Utara dalam penanganan Tindak Pidana Perdagangan Orang. Hasil kajian menggambarkan bahwa permasalahan dalam penindakan pelaku tindak pidana perdagangan orang adalah tidak dimungkinkannya penyidik menggunakan kekerasan, sehingga pola yang digunakan oleh Kepolisian Daerah Sumatera Utara adalah melakukan 3 (tiga) hal, yakni Pre-Emtif, Preventif dan Represif. Cara yang lebih efektif dilakukan oleh kepolisian adalah melakukan pendampingan dan koordinasi dengan pihak Imigrasi untuk melakukan pengawasan, ini dilakukan untuk meminimalisir terjadinya Tindak Pidana Perdagangan Orang. Merujuk pada Undang-Undang Nomor 21 tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang, kepolisian daerah Sumatera Utara pada tahap pengumpulan bukti, ada kalanya menggali data dari korban dan merekam atas ijin dari korban supaya pelaku kejahatan dapat dilakukan penindakan.

Abstract

The operational implementation of Public Order and Order (Trantibum) carried out by the Regency/Municipal Civil Service Police Unit (Satpol PP) in Blangkejeren must be based on a humane and authoritative attitude. To improve the image, Satpol PP must have a sense of humanity and authority in carrying out their duties. "So with this attitude, the image of Satpol PP can improve and be better. It's not like what people say that Satpol is the enemy of the small people, has a bad image, and is a tool for ruling over the little people. Thus, the community will be able to understand by creating a high sense of awareness regarding the attitudes and actions they take. From their observations regarding the actions taken by the district/city Satpol PP when carrying out control in their area, it has referred to the regulations that have been set by the Minister of Home Affairs No. 26/2005 concerning Procedural Guidelines. Still Operational Satpol PP.” Where in the regulation has been stipulated related to the implementation of the Trantibum, raids. Before the Satpol PP carries out the operation, socialization will be carried out first, so that when the operation is carried out there is no anarchic attitude.

Abstract

The excess housing in the Indonesian Correctional Institution does not abate. This condition is faced with criminal efforts which should be a final diversion related to the effort to include convicted persons in Corrections Institutions. The aim is to analyze whether the mediation of penal as the application of Restorative Justice can be an alternative effort to minimize excess occupancy inmates in correctional institutions. The use of this research as a recommendation for law enforcement officials in the handling of criminal acts by promoting penal mediation. The research uses normative legal research methods with literature studies. Mediation Penal is considered able to be an intermediary process of mediation or peace between perpetrators of criminal acts with victims of criminal acts as minimizing the excess occupancy that starts from handling the police and prosecutors stage.

Abstract

Settlement of criminal cases through restorative justice in stage two (2) or since the handing over of responsibility for suspects and evidence to the Public Prosecutor has been regulated in the Attorney General's Regulation No. 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice. The legality of the application of restorative in Indonesia has been used in Law No. 11 of 2012 concerning the Juvenile Justice System (SSPA) and the Circular Letter of the Chief of Police No. 8 of 2018 concerning the Application of Restorative Justice before the start of the investigation sent to the Public Prosecutor. a law enforcement in a slow direction because law enforcement is carried out at various levels from the Police, Attorney General's Office, District Courts, High Courts and even to the Supreme Court. In the end it has an impact on the accumulation of cases that are not small in number in court. The purpose of this study is to find out the application and problems that occur in the application of restorative justice through efforts to stop prosecution in the process of resolving cases of criminal acts of vandalism associated with the Attorney General's Regulation No. 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice. This research is normative-empirical juridical using a case approach and a statutory approach. Data collection techniques using primary data are field interviews at the Pematang Siantar District Attorney and library research to obtain secondary data. Referring to the principle of fast, simple and low cost justice, PERJA No. 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice has been accommodated, especially in cases of destruction by making peace between victims and suspects, and the peace process is carried out voluntarily, with deliberation and consensus, without pressure, coercion and intimidation. In this peace process the facilitator is the Public Prosecutor, this is because there is no interest and connection with the case, against the victim and the suspect. In the implementation of PERJA No. 15 of 2020, it turns out that there are many obstacles, including the lack of understanding among law enforcement regarding restorative justice, lack of infrastructure, and public misunderstanding.

Abstract

The need for technology today is increasing and continues to be developed in order to make it easier for humans to carry out their daily activities, because apart from being a medium for providing information, through the Internet, commercial community activities will also become the largest and fastest growing part and can penetrate various national borders. In fact, the existence of some types of business is impossible without this network, market activities in the world can be known for 24 (twenty four) hours. But in reality what is happening today, the development of this era is like a double-edged sword because for the positive we all have to be grateful for it because there are many benefits and conveniences obtained from this technology, for example we can do banking transactions anytime with e-banking, e-commerce It also makes it easy for us to buy or sell an item without knowing the place. In addition, we can find references or information about science is not difficult with the e-library and many more conveniences obtained with the development of the internet. Whereas in a negative nature, the use of this information technology has influenced every attitude and behavior of members of the community, even as a result has also formed a new world society that is no longer hindered by the territorial boundaries of a country to become a "mayantara world" (a world without boundary) or “virtual reality”. The author's purpose in this study is to find out about criminal law policies against bullying in electronic media at this time in Indonesia and criminal law policies in the future as an effort to minimize bullying in electronic media. The current criminal law policy regarding bullying in electronic media in Indonesia is identified with the Criminal Code, and lastly on November 25, 2016, Indonesia has issued Law No. 19 of 2016 concerning amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions involve several articles relating to the form of bullying in electronic media. If we look closely at the laws and regulations in Indonesia, there are still many weaknesses in the criminal provisions regulated in the Criminal Code and the ITE Law to reach the crime of bullying in electronic media. Criminal law policies as an effort to minimize bullying in electronic media can be found in the Draft Criminal Code and comparative studies with other countries on bullying, so that with the establishment of a new Criminal Code and make comparisons from other countries as an effort to minimize bullying in electronic media so as not to jump from year to year in order to see the cheerfulness of Indonesian children.

Abstract

Pelaporan dana kampanye pasangan calon merupakan salah satu informasi publik bentuk kejujuran atas laporan transaksi keungan yang valiud dan transparan. Pendanaan dalam proses kampaye pemilihan umum di Indonesia menjadi salah satu sorotan modus terjadinya tindak pidana korupsi dan pencucian uang. Undang-Undang Republik Indonesia Nomor 7 Tahun 2017 tentang Pemilihan Umum telah menentukan perbuatan yang dapat dipidana sebagai bentuk tindak pidana pemilihan umum dalam hal dana kampanye Pemilihan Umum yang tidak sesuai dengan ketentuan peraturan undang-undang, yakni pendanaan yang digunakan untuk kampanye berasal dari tindak pidana korupsi berupa suap ataupun gratifikasi. Perbuatan tersebut diantaranya adalah dengan sengaja menjanjikan atau memberikan uang atau materi lainnya sebagai imbalan dan setiap orang, kelompok, perusahaan, dan/atau badan usaha non pemerintah yang memberikan dana kampanye pemilu melebihi batas yang ditentukan. Hasil suap ataupun gratifikasi yang digunakan untuk pendanaan kampanye pemilihan umum inilah yang berindikasi sebagai modus baru terjadinya tindak pidana pencucian uang. Permasalahannya dalam penelitian ini adalah rekonstruksi pemidanaan pelaku tindak pidana korupsi dan pencucian uang dalam pemilihan umum. Pemidanaan bagi pelaku tindak pidana korupsi dan pencucian uang dalam pemilihan umum seyogyanya menerapkan ketiga undang-undang tersebut melalui surat dakwaan yang berbentuk komulatif. Sistem pemidanaan tersebut sebagai rekonstruksi dalam melakukan pemberatan pidana bagi pelaku tindak pidana korupsi dan pencucian dalam pendanaan kegiatan pemilihan umum.

Abstract

Prostitusi di Indonesia dianggap sebagai kesusilaan atau melawan hukum dan menjadi masalah yang rumit oleh karena itu masalah ini sangat butuh perhatian khusus dari masyarakat. Bagaimana Pertanggungjawaban Pidana Pelaku Yang Menawarkan Pekerjaan Prostitusi Online (Studi Kasus Putusan No 70/Pid.Sus/2019/PN Bjn). Adapun penelitian ini metode analisis yang dilakukan untuk mengumpulkan data dengan cara studi kepustakaan. Dalam perkara putusan Nomor 70/Pid.Sus/2019/Pn Bjn, Jaksa mendakwa terdakwa dengan dakwaan kesatu yakni Pasal 27 Ayat (1) jo Pasal 45 Ayat (1) UU RI No 19 tahun 2016 tentang perubahan atas UU No 11 tahun 2008 tentang ITE dan unsur-unsur dalam pasal tersebut telah terpebuhi dan dakwaan kedua Pasal 296 KUHP dan unsur-unsur dalam dakwaan tersebut telah terpenuhi. Maka Jaksa hanya menuntut terdakwa dengan dakwaan kedua yaitu selama 1 (satu) tahun. Majelis Hakim tidak menemukan hal-hal yang dapat menghapuskan pertanggungjawaban pidana sebagai alasan pembenar dan alasan pemaaf, maka terdakwa harus mempertanggungjawabkan perbuatan dan karena terdakwa mampu bertanggungjawab maka harus dinyatakan bersalah dan dijatuhi pidana penjara selama satu 1 (satu) tahun 2 (dua) bulan. Perlu penindakan secara tegas terhadap pelaku prustitusi online, maka diharapkan kepada Aparat Penegak Hukum terutama Hakim memberikan sanksi yang berat agar pelaku tindak pidana prostitusi online mendapatkan efek jera.

Tindak pidana yang dilakukan oleh korporasi dapat berbentuk penipuan dan pencucian uang. dalam Putusan Nomor 3096 K/Pid.Sus/2018.
