Abstract

In a construction contract, there are potential delays in the project, and both parties try to avoid this situation. For the reason, the customary in construction contracts to state a completion date by which the works must be completed. This is usually based on an estimate of how long the project will take or may be determined by the date when the employer wants the project to be completed. To answer the above problems, the method used is normative legal research. The objective of this research was to understand clearly and holistically the complexities of construction contracts. Some contractors request an extension of time to finish the duty because delay, which fails to complete on time, is generally referred to as a critical situation. The worst situation happens if it is not stipulated in a construction contract, and it can eliminate the contractor's obligation to complete the work promised or create a condition called "time at large.” Of course, this is very undesirable for the owner. Especially if the contractor who carries out work is a foreign company, it certainly adds to the complexity of this condition. Therefore, to avoid this, it is essential to ultimately make an extension of time clause in an international construction contract.

Abstract

Anti-dumping adalah pengenaan bea masuk tambahan terhadap barang yang diimpor dengan tingkat harga ekspor yang lebih rendah dari nilai normalnya di negara pengekspor (barang dumping). Sehingga hanya dumping yang merugikan industri sejenis di negara pengimporlah yang dapat dikenakan tindakan anti-dumping. Kriteria untuk penggunaan sistem dumping maupun anti-dumping telah diatur pada Agreement on Implementation of Article VI GATT dan Agreement on Subsidies and Countervailing Duties. Namun, hal ini akan menjadi suatu sengketa apabila penentuan kebijakan tidak sesuai dengan pengaturan ataupun perjanjian hukum internasional yang dapat merugikan negara lain. Dispute Settlement Mechanism merupakan salah satu penyelesaian sengketa Internasional melalui WTO guna memberikan prediktabilitas dan keamanan dalam perdagangan internasional. Penelitian ini bertujuan menganalisis bagaimana penyelesaian sengketa terkait kebijakan anti-dumping melalui WTO menggunakan dispute settlement mechanism menggunakan metode penelitian normatif dengan pendekatan perundang undangan dan studi kasus negara Indonesia dan Uni Eropa terkait kebijakan anti-dumping Uni Eropa yang diduga melemahkan sektor ekspor baja nirkarat Indonesia. Penyelesaian sengketa melalui WTO dinilai tepat dikarenakan memiliki tahapan yang jelas dan memiliki prinsip yang mengikat, sehingga penyelesaian sengketa melalui WTO ini dapat menjadi upaya yang baik dalam menjaga stabilitas perekonomian dunia dengan menyelesaikan sengketa antara negara-negara anggota.

Abstract

Indonesia is the largest island nation on the continent of Asia. The islands of Indonesia have some 17,000 islands recorded in 2021. Of these, there are still many small islands and outer islands that remain undetected by the Indonesian government. With the presence of the outermost islands of Indonesia, the republic's sovereignty grows clearer as its borders are detected. The boundary region is an important aspect of a country because it is a highly strategic region for a country to build. The boundary region is the daily interaction between globalization and locality. Indonesia has some dispute with neighboring countries linked to the outermost island directly to one another. Sebatik island became one of the islands that had an issue with its position. Indonesia gets its territory in accordance with colonial jurisdiction. The region is obtained on the basis of the principle of uti possible. Using a qualitative approach, the writing addressed Indonesia's potential to keep the island seusing the possible principle of uti Indonesia, which is the main basis for Indonesia to win the lawsuit against Indonesia.

Abstract

This research explores the urgency of Recordation by intellectual property rights (IPR) holders in the context of customs protection systems. Recordation, as the process of documenting intellectual property rights, plays a crucial role in enforcing IPR protection within the customs environment. The study aims to analyze the effectiveness of Recordation in enhancing IPR protection, identify barriers faced by IPR holders in the Recordation process, and explore its impact on law enforcement and international trade. The research methodology includes policy analysis, case studies, and interviews with relevant stakeholders. The findings of this study are expected to provide in-depth insights into the role of Recordation in optimizing customs protection systems to support IPR holders. The implications of the findings can serve as a foundation for policy enhancements and practices in promoting the effective use of Recordation as a tool to safeguard intellectual property rights on a global scale.
