Abstract

Notaris dalam menjalankan kewenangan dan kewajibannya sangat memerlukan bantuan tenaga kerja yang dalam hal ini adalah pekerja/karyawan notaris. Hubungan kerja antara Notaris sebagai pemberi kerja dengan pekerja timbul berdasarkan kontrak/perjanjian kerja. Ada dua jenis kontrak kerja yaitu perjanjian kerja untuk waktu tertentu (PKWT), dan perjanjian kerja waktu untuk tidak tertentu (PKWTT). Masing-masing bentuk perjanjian/kontrak kerja akan menimbulkan akibat hukum yang berbeda. Field research dikantor Notaris Sulin, S.H., M.Kn. Kota Blitar, Jawa Timur dilengkapi dengan library research menghasilkan penelitian bahwa bentuk kontrak kerja di kantor Notaris Sulin, S.H., M.Kn. Blitar adalah perjanjian kerja waktu tidak tertentu yang hanya menggunakan karyawan tetap, dengan pelaksanaan dan penerapannya sesuai dengan amanah Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan.

Abstract

This research departs from the subject matter of the arrangement of appointment of village officials in Blitar Regency after the expulsion of the domicile requirements of prospective village officials by the Constitutional Court of the Republic of Indonesia (Article 50 Paragraph 1 letter c) of Law Number 6 of 2014 concerning Villages) because it proved unconstitutional. To answer questions, it is used for normative legal research, draw conclusions about disharmony in the arrangement of appointment of village officials, and arrangements for the appointment of village officials in Kab. Blitar contains a substance that is not legal certainty.

Abstract

One of the efforts of the Rural Bank (BPR) based on Article 13 of the Republic of Indonesia Law Number 10 of 1998 concerning Banking is to provide credit. But in credit matters, especially in the BPR Berkah Pakto, it does not always run smoothly. Bad credit, becoming one type of non-performing loans with the largest amount in this BPR. Through sociological (juridical-empirical) juridical research at BPR Berkah Pakto Kandangan-Kab. Kediri, East Java, the research results are obtained that the factors that cause the occurrence of bad credit in BPR Berkah Pakto consist of factors originating from customers (debtors), factors originating from BPR Berkah Pakto, and other party factors. The process of settling bad debts at the Perkreditan Rakyat Berkah Pakto Bank optimizes non-legal channels to be able to settle its obligations.

Abstract

Demi terwujudnya kepastian hukum materiil yang mengatur mengenai pelaku tindak pidana, aparat penegak hukum khususnya jaksa dan hakim harus memperhatikan secara cermat dan jelas mengenai unsur-unsur dalam setiap pasal, karena jika salah dalam menerapkan pasal maka hal tersebut batal demi hukum. Penelitian yuridis normatif dengan data sekunder Putusan Perkara Nomor 482/Pid. B/2018/PN Blt. menunjukkan bahwa Surat dakwaan dan tuntutan (requisitoir) yang dibuat oleh Penuntut Umum dengan Nomor Registrasi Perkara PDM 201/BLTAR/Epp.2/12/2018 sudah memenuhi syarat formal dan materiil sesuai Pasal 143 Ayat (2) KUHAP.

Abstract

Melalui penelitian yuridis normatif guna meneliti perwujudan perlindungan hukum pemerintah di tingkat daerah di Kota Blitar secara preventif dan represif terhadap aktifitas merokok di Kota Blitar, diketahui bahwa regulasi Perda KTR Kota Blitar yang mengandung sanksi administratif bagi pihak terkait yang tidak melaksanakan kewajiban dan sanksi pidana bagi pelaku tindak pidana pelanggaran, memperbolehkan smoking area di tempat kerja, dan melarang smoking area di kawasan fasilitas pelayanan kesehatan, tempat proses belajar mengajar, tempat anak bermain, tempat ibadah dan angkutan umum.

Abstract

Ada lima undang-undang bidang kesehatan yang diubah pasca pemberlakuan UU Cipta Kerja. Mengingat dampak pemberlakuan UU Cipta Kerja yang luar biasa mengubah peraturan perundang-undangan di sektor kesehatan, menjadi sangat penting untuk menganalisis peranan dan tanggungjawab pemerintah dalam pelayanan kesehatan pasca berlakunya UU Cipta Kerja sebagai bagian pemberlakuan Omnibus Law di Indonesia. Melalui penelitian yuridis normatif, dihasilkan penelitian bahwa pemerintah sebagai penanggungjawab terhadap perencanaan, pengaturan, penyelenggaraan, pembinaan, dan pengawasan penyelenggaraan upaya kesehatan yang merata dan terjangkau oleh masyarakat, melalui UU Ciptaker mengubah aturan di bidang kesehatan seperti penyederhanaan pasal-pasal dalam UU Kesehatan dan UU Rumah Sakit, jasa pelayanan kesehatan medis tidak dikenakan PPN, pemberian jasa pelayanan kesehatan medis tidak hanya pada tenaga kesehatan dan asisten tenaga kesehatan, dan mengharuskan rumah sakit melakukan akreditasi setiap tiga tahun sekali. Terkait hal tersebut, pemerintah berperan mengatur praktik pelayanan kesehatan di rumah sakit berupa pembinaan dan pengawasan terhadap rumah sakit, meminimalisir pembuatan kebijakan yang merugikan kepentingan tenaga kesehatan yang bekerja di rumah sakit, dan memastikan masyarakat mendapatkan pelayanan kesehatan sesuai ketentuan pelayanan publik, kompetensi, dan standar operasional prosedur.

Abstract

This article discusses how the development of efforts to marriage age maturity in Indonesia. This effort is not only as a manifestation of the government in responding to marital problems such as the prevalence of underage marriages, also as another means to curb the behavior of some people who still often deviate marital age regulations through requests for marriage dispensation in court. The research findings conclude that there are important arguments that need to be considered for the government's efforts to reduce the rate of underage marriage in Indonesia, such as through the marriage age maturity program. This can be started by building integration or cooperation between institutions in order to maximize the function of the rule of law and their respective social roles, so that underage marriage can be minimized as well as possible.

Abstract

The enactment of the extraordinary job creation law changes the legislation in the health sector. However, the status of the Job Creation Law became unconstitutional or conditionally unconstitutional after the decision of the Constitutional Court 91/PUU-XVIII/2020 which granted part of the formal review of the Job Creation Law. Through normative legal research, research is produced that; even though Law 13/2022 has been promulgated on the Formation of Legislation which accommodates the preparation of laws and regulations using the omnibus law method; implementation of the law on: simplification of the articles in the Health Law and Hospital Law, medical health services that are not subject to VAT, providing medical health services not only for health workers and assistants for health workers, and implementing hospital accreditation every three years; remain valid and for two (2) years there may be no other related (new) regulations, for the sake of realizing benefits, certainty, justice, and the greater interest of many.

Abstract

Permasalahan prioritas yang dihadapi mitra ialah dari adanya kasus-kasus penyebaran berita bohong yang banyak terjadi, dikarenakan adanya ketidaktahuan masyarakat termasuk kalangan pelajar tentang pengaturan-pengatuan yang ada dalam UU ITE, baik bentuk maupun jenis sanksi pidana. Untuk itu perlu untuk mengadakan kegiatan sosialisasi berupa pendidikan UU ITE dalam bermedia sosial dikalangan pelajar di Blitar. Dari adanya kegiatan ini diharapkan pengetahuan pelajar mengenai UU ITE lebih bertambah dan lebih pintar dalam bermedia sosial. Metode yang dilakukan pada kegiatan Pengabdian kepada Masyarakat dilakukan dalam 3 tahapana yaitu Sosialisasi rencana kegaitan kepada mitra, Tahap persiapan, Tahap Pelaksanaan kegiatan webinar dan Evaluasi. Hasil kegiatan pengabdian kepada masyaarakat ini berjalan lancar dan para peserta merasa bahwasanya kegiatan webinar ini sangat bermanfaat bagi kalangan bagi kalangan pelajar yang aktif menggunakan media sosail untuk lebih berhati-hati akan hukum yang berlaku.

Abstract

The minimum requirements for presidential and vice presidential nominations (presidential threshold) in Indonesia ahead of the 2024 General Election (Pemilu) continue to be a source of debate in the context of Constitutional Law. This debate arose due to factors such as allegations that the previous regime which won the election wanted to ensure its position as the determinant of presidential candidates in the next election. Through normative legal research methods, research was produced that this threshold was applied to the 2019 Election through Article 222 of Law Number 7 of 2017 concerning General Elections. This article stipulates that candidate pairs must be proposed by political parties or combinations of political parties participating in the election that succeeded in winning at least 20% of the total seats in the House of Representatives or 25% of the valid national votes in the previous election. This has the potential for the emergence of transactional politics in the formation of political party coalitions that are not based on shared ideology. Empirical facts and experience from the last election show that due to the presidential nomination threshold, the 2019 election produced the same two pairs of candidates as the 2014 election. This indicates that the implementation of the presidential threshold effectively eliminates competitors or potential challengers in the presidential and vice presidential elections, violating the general election principles of honesty and fairness. If this threshold remains, it is likely that the threshold for presidential and vice presidential candidacy will become even higher in the future, strengthening the dominance of transactional politics.
