Abstract

Child custody encompasses parental rights and responsibilities for raising and nurturing their children. In Indonesia, child custody often triggers disputes, especially in divorce cases. This research seeks to present a fresh perspective by examining the deconstruction of joint custody within the context of child guardianship. This study, focusing on legal aspects, employs a comparative approach to deconstruction concepts, drawing from Jacques Derrida's radical deconstruction and Thaha Abdurrahman's ethical deconstruction. The analysis aims to unearth possibilities and offer recommendations for implementing Joint Custody in Indonesia, particularly regarding post-divorce parental custody regulations. Both deconstruction concepts challenge the conventional maternal role in child custody, especially for children under 12. Embracing this deconstruction opens the door to considering joint custody as a new norm in Indonesia. Joint custody is no longer just a concept; empowering judges to consider it based on court proceedings is the fastest route to its adoption in the child's best interest. Abstract

Selama ini poligami dipahami sebagai bagian dari perbuatan yang dianjurkan karena disebut sebagai sunnah rasul. Tidak sedikit penceramah yang menganjurkan pelaksanaan poligami dan kerapkali-baik sengaja ataupun tidak-memojokkan wanita untuk menerima dimadu oleh suaminya. Paham ini hidup dan secara tidak sadar diterima sebagai nilai yang hidup (living law) dalam masyarakat muslim Indonesia. Padahal terdapat pendapat lain yang menempatkan poligami sebagai perbuatan mubah belaka. Beberapa madzhab bahkan mensunnahkan agar suami cukup menikahi satu orang istri saja, karena poligami cenderung akan menyakiti perempuan. Pendapat fiqh inilah yang melatarbelakangi Mahkamah Agung menerbitkan petunjuk teknis dan sejumlah Sema berkaitan dengan praktik poligami. Melalui medium tersebut, diberikan jaminan kepastian hukum bagi istri untuk bersuara di depan sidang serta mempertahankan hak-haknya atas harta dalam perkawinan. Poligami liar juga telah dilarang untuk disahkan serta sejumlah hak keperdataan antara suami dan istri tidak diakui di depan hukum. Mahkamah Agung tengah menggunakan hukum (law as tool of social engineering) untuk menghidupkan pendapat-pendapat fiqh yang berpihak pada perlindungan perempuan dan sedikit demi sedikit diharapkan dapat mengikis pemahaman fiqh yang cenderung menegasikan kedudukan perempuan.

Abstract

The privileges associated with an active internet account revert to the account holder while they are alive. However, if the account becomes inactive or the holder dies, most service providers lack provisions for transferring these entitlements to their heirs. With Indonesia’s 207 million account users as of 2021, the rights of the deceased account holder may be forfeited without legal safeguards. This research explores the entitlements linked to virtual account ownership and legal protections for the inheritable rights of inactive account holders through qiyās method. Employing a normative and philosophical approach, the study reveals various entitlements connected to the account owner. Legal safeguards for inactive digital account owners are present through argument and qiyās (analogy), ensuring their rights as heirs and enabling inactive digital account assets to be inherited in non-digital assets. At this point, it is essential to explore the inheritance rights of digital assets further by studying positive law and Islamic law to guarantee personal rights in the digital space.
