Abstract

impeachment tidak diartikan sebagai sebuah turunnya, berhentinya atau dipecatnya Presiden dan/atau Wakil Presiden dari jabatannya. Putusan impeachment di MK sebagai proses politik tidak berarti dapat diberhentikan Presiden dan/atau Wakil Presiden karena harus tetap melalui keputusan MPR yang diberikan kewenangan dalam memberhentikan Presiden dan/atau Wakil Presiden. Penelitian ini bertujuan untuk menganalisis implikasi sifat putusan impeachment MK terhadap status hukum Presiden dan/atau Wakil Presiden yang telah dinyatakan telah melakukan pelanggaran secara konstitusional. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif, yaitu penelitian yang dalam pengkajiannya dengan mengacu dan mendasarkan pada norma-norma dan kaidah-kaidah hukum. Tulisan ini dimaksudkan untuk mencari formulasi konstitusional yang bersifat fundamental sesuai dengan konsep supremasi hukum terhadap daya ikat putusan impeachment MK. Format mekanisme impeachment yang ideal tersebut harus menempatkan MK pada posisi yang menentukan, bukan hanya sekedar lembaga yang menjustifikasi pendapat DPR dalam proses impeachment.

Abstract

The implementation of decentralization will be successful if the process of determining regional heads is not in the shadow of the national political elite. More broadly, this did not provide an opportunity for people in the city of Medan to freely determine their future leader. At some level, such a process would destroy regional democratization. Therefore, the problem to be examined is how the influence of the centralization of political party policies in relation to the election and determination of regional head candidates carried out by political parties, we need to discuss in advance what causes the direct implementation of regional head elections and how the role of political parties in recruiting candidates. District head. The research method used is normative legal research. The results show that the regional head elections that have undergone a shift from indirect elections in the DPRD to direct elections by the people have constructive consequences for democracy and the concept of people's sovereignty in the context of elections and the role of political parties which are very strategic because they are able to carry regional head candidates to become head candidates. regions in regional head elections experience conceptual ambivalence, and also political parties have a dominant influence on first-time voters in the 2020 Medan mayoral election

Abstract

Indonesia's Corruption Perceptions Index (IPK) in 2018, put Indonesia up seven places to position 89 out of 180 countries. The increase in the ranking is a breath of fresh air in fighting corruption in Indonesia. As for the breakthroughs made in creating a deterrent effect on criminal acts of corruption, namely by depriving political rights through judges' decisions in court. Prohibition of former convicts in cases of corruption, drug dealers, sexual crimes against children, becoming candidates for legislative candidates (bacaleg) in the 2019 Election. restrictions on political rights, on the one hand there are those who are against restrictions on political rights which are considered to injure human rights. Revocation of political rights is considered to be a legal construction in eradicating criminal acts of corruption, where the revocation of the right to be elected is carried out in order to prevent the election of leaders who have been involved in corruption in public positions. Among the fundamental rights, one of which is affirmed in Article 28D paragraph (3) of the 1945 Constitution, "the right to obtain equal opportunities in government". However, the guaranteed constitutional rights of citizens are of course not absolute and can be limited in accordance with the provisions stipulated in the 1945 Constitution

Abstract

Tujuan dari penelitian ini adalah untuk mengkaji kebijakan insentif yang berkelanjutan dalam perlindungan lahan pertanian pangan di masa mendatang. Untuk menahan laju konversi lahan pertanian menjadi lahan non-pertanian, Pemerintah bersama dengan Dewan Perwakilan Rakyat mengesahkan lahirnya Undang-Undang Nomor 41 Tahun 2009 tentang Perlindungan Lahan Pertanian Pangan Berkelanjutan. Undang-Undang ini diharapkan dapat menahan laju konversi lahan pertanian menjadi non-pertanian. Salah satu hal yang diatur dalam undang-undang tersebut adalah terkait dengan kebijakan pemberian insentif, akan tetapi kebijakan tersebutmasih berbasis lahan, sehingga insentif hanya diberikan kepada pemilik lahan pertanian yang tidak mengalihfungsikan lahan pertanian pangan. Di mana dengan perkembangan teknologi sekarang ini serta untuk menjaga ketahanan pangan, maka pengembangan varietas unggul pertanian tidak harus dikembangkan berbasis lahan. Oleh karena itu, untuk menjaga ketahanan pangan, diperlukan suatu upaya untuk mengembangkan kebijakan yang tidak hanya berbasis lahan. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum yuridis normatif dengan menggunakan pendekatan perundang-undangan (statute approach). Analisis data dilakukan dengan menggunakan metode kualitatif berdasarkan logika berpikir deduktif. Berdasarkan penelitian yang dilakukan diperoleh bahwa kebijakan pemberian insentif kepada petani masih berbasis luas lahan, di mana salah satu pertimbangan pemberian insentif adalah memiliki luas tanam paling sedikit 25 (dua puluh lima) hektar dan kebijakan pemberian insentif kepada petani dalam rangka perlindungan lahan pertanian dinilai kurang tepat, karena insentif yang diberikan masih berupa program reguler yang dilaksanakan oleh pemerintah.

Abstract

Permasalahan kebangsaan saat ini begitu beragam sampai pada keinginan sekolompok orang merubah dasar negara merdeka yakni Pancasila, pemahaman dan gerakan ini sering sekali tersiar kepada banyak orang dan membangun gerakannya pun sangat sistematis, misalnya membangun isu kekhilafahan di Indonesia, membangun gerakan momentum Islam sebagai mayoritas dengan isu negara Islam, tentu pemikiran ini sangat bertentangan dengan cita-cita pendahulu kita, bahwa Pancasila tidak bertentangan dengan ajaran Islam bahkan nafas Pancasila merupakan ajaran Islam. Sehingga pengabdian ini perlu dilakukan pertama meberikan pemahaman mendalam bagi warga persyarikatan Muhammadiyah di Cabang Percut Sei Tuan, menangkal arus globalisasi dan menjadi tantangan atas jawaban perubahan zaman, mengukuhkan Pancasila sebagai Ideologi, dasar negara merdeka dan cara hidup berbangsa dan bernegara, nilai-nilai Pancasila tidak bertentangan dengan ajaran Islam bahkan satu nafas dengan ajaran Islam, dan Muhammadiyah mampu membangun gerakan dakwah moderasi Islam yang berkemajuan

Abstract

Muhammadiyah Business Charitable and the founder of Muhammadiyah Islamic College (MIC), the obligation of an academic community is added to the understanding and practice of Al-Islam Kemuhammadiyahan as a teaching doctrine that follows the Prophet Muhammad SAW, one of the courses that should intersect with Muhammadiyah understanding is the Pancasila course, this course not only describes how the history of Pancasila used as the basis of an independent state, moral value, ethics and diversity that exist, but this Pancasila course should also describe the ideology of Muhammadiyah, the State Law of Pancasila and the ways of practicing it in everyday life of course with Muhammadiyah rules, so that the Pancasila course this is one of the characteristics of the practice of Al-Islam Kemuhammadiyahan in the Legal Studies Program. The research method used in this research is normative juridical.

Abstract

Indonesia sebagai Negara Kesatuan dengan kedaulatan tertinggi dalam pemerintahan berada ditangan Presiden. Salah satu asas Negara Kesatuan yang didesentralisasikan (otonomi), maka ada tugas-tugas tertentu yang diurus oleh Pemerintah Daerah sendiri. Adanya kewenangan yang diurus sendiri oleh Pemerintah Daerah, terdapat berbagai bentuk disharmonisasi antara Kabinet (Pemerintah Pusat) dengan Pemerintah Daerah. Sengketa kewenangan lahan, masalah harmonisasi regulasi, perimbangan keuangan, merupakan bagian dari problematika antara Pusat dengan Daerah.            Penataan kembali hubungan pusat-daerah yang lebih harmonis dengan didasarkan pada kemitraan dan saling ketergantungan sistem pemerintahan. Konstruksi hubungan tersebut setidaknya memuat pemikiran ulang mengenai tingkatan pemerintahan, status dan kedudukannya; pembagian wewenang antar berbagai tingkatan pemerintahan; perimbangan keuangan antar tingkatan pemerintahan; partisipasi daerah dalam pembuatan keputusan di tingkat nasional; dan intervensi pusat terhadap daerah.            Struktur kabinet pemerintahan mendatang perlu dipastikan mampu mendorong adanya koordinasi dan sinkronisasi yang lebih baik dalam menyelesaikan berbagai persoalan, baik antar-kementerian, lembaga, maupun hubungan pusat dan daerah. Sebagai bagian dalam penguatan sistem presidensial, maka hubungan antara Pemerintah Pusat dan Pemerintah Daerah harus harmonis agar terwujud koordinasi yang baik, sinkronisasi kebijakan, serta kerja sama yang solid. Dengan demikian, pembangunan yang dirancang pemerintah pusat, provinsi, dan kabupaten/kota dapat selaras.

Abstract

In the 1945 Constitution there are two regulations regarding emergency situations (danger) which are regulated in two articles, namely Article 12 and Article 22. Article 12 of the 1945 Constitution states, "The President declares a state of danger, the conditions and consequences of a state of danger are determined by law". Then Article 22 paragraph (1) of the 1945 Constitution states, "In the event of a compelling urgency, the President has the right to stipulate government regulations in lieu of law". From the above provisions, it can be seen that there are two categories of circumstances according to the 1945 Constitution, namely (1) conditions of danger and (2) matters of compelling urgency. The terms (legal terms) used in the two articles are clearly different, the first term uses the term "danger" which is nothing but the same as the definition of an emergency. This research uses normative juridical research. The problem approach used in this research includes a legal approach, a conceptual approach, a case approach and a comparative approach. This research is a deductive research that describes legal events and legal consequences associated with the establishment of state emergencies in several countries. The data obtained were collected and analyzed qualitatively with a descriptive-analytical model. So that the results can be described comprehensively and systematically regarding the basic considerations in establishing the rule of law. The provisions regarding Article 12 and Article 22 paragraph (1) of the 1945 Constitution are basically also related to Article 10 and Article 11 paragraph of the 1945 Constitution. The problem in this research is how to regulate the legal basis for determining the status of a state emergency in Indonesia. with the United States? What is the President's authority in determining the state of emergency status in Indonesia with the United States?

Abstract

The problem of the realization of regional autonomy-decentralization will be successfully achieved if in the process of determining regional leaders are still in the shadow of the national political elite. More broadly, this does not provide an opportunity for the people of the region to freely determine their future leaders in the area. To a certain degree, this kind of process will destroy regional democratization. For that reason, the problem to be examined is how the influence of the centralization of political party policy in relation to the election and determination of regional head candidates carried by political parties, we need to discuss in advance what is the cause of the direct implementation of regional head elections and how the role of political parties in recruiting regional head candidates. The research method used is normative legal research. The results showed that the election of regional heads that had experienced a shift from indirect elections in the DPRD to direct elections by the people had constructive consequences for democracy and the conception of popular sovereignty in the context of elections and the role of political parties that were very strategic in being able to carry prospective candidates for heads regions become candidates for regional heads in the regional head election experiencing conceptual ambivalence.

Abstract

The Supreme Court (MA) has the authority legality review on regulations under the law against the law as stated in Article 34A paragraph (1) of the 1945 Constitution. Unlike the Constitutional Court (MK) in the examination process until the ruling applies Open Court Principle the Supreme Court does not implement it because apply the legal provisions that apply to the application case in the shortest possible time. This research uses normative legal research methods with conceptual approaches, philosophical approaches and statute approach. “There are two research questions of this study namely why is the principle of the trial open to the public in the right of judicial review in the MA in the concept of modern legal states and what is the constitutional basis for a trial open to the public based on the principle of Audi et Alteram Partem.? Based on principle as law country, Indonesia should emphasize on transparency to make public decision at court so that justice will prevail. The Supreme Court can make rule that accommodate the spirit of a trial that is open to the public as in the principle of Audi et Alteram Partem.
